Abstract

Tujuan penelitian menganalisis urgensi pengaduan konstitusi sebagai perlindungan konstitusional warga negara di Indonesia serta menganalisis dan menjelaskan konsep penambahan kewenangan mahkamah konstitusi RI untuk menjalankan Pengaduan Konstitusi. Tipe Penelitian yang digunakan adalah penelitian Hukum Normatif. Hasil penelitian ini menunjukkan bahwa : (1) Kebutuhan akan kewenangan Pengaduan Konstitusi perlu ditambahkan kepada Mahkamah Konstitusi yang dapat dipandang sebagai Ius Constituendum, yang merupakan suatu keniscayaan dan tidak dapat ditunda-tunda lagi. Urgensi Kewenangan Pengaduan Konstitusi di Indonesia merupakan wujud perlindungan terhadap hak konstitusional warga negara. (2) Pengadopsian perkara Pengaduan Konstitusi dan Pertanyaan Konstitusi dapat dilakukan dengan berbagai cara diantaranya: melakukan amandemen UUD NRI 1945, Revisi UU Mahkamah Konstitusi, dan Penafsiran Konstitusi. Dengan merancang/ menyusun mekanisme pengajuan, cakupan objek perkara, sampai kepada antisipasi beban perkara akibat penambahan. The research objective to analyze the urgency of constitutional complaints as constitutional protection of citizens in Indonesia and to analyze and explain the concept of adding the authority of the RI Constitutional Court to carry out Constitutional Complaints. The type of research used is normative law research. The results of this study indicate that: (1) The need for the authority to Complain to the Constitution needs to be added to the Constitutional Court which can be seen as the Ius Constituendum, which is a necessity and cannot be postponed any longer. The urgency of the Constitutional Complaints Authority in Indonesia is a form of protection of the constitutional rights of citizens. (2) The adoption of cases of Constitutional Complaints and Constitutional Questions can be carried out in various ways including: amending the 1945 Constitution of the Republic of Indonesia, Revision of the Constitutional Court Law, and Interpretation of the Constitution. By designing/compiling the submission mechanism, the scope of the object of the case, to the anticipation of the caseload due to the addition.
