<![CDATA[Tujuan penelitian menganalisis penggunaan diskresi oleh kepolisian dalam pelaksanaan tugas yang mengancam keselamatan nyawa petugas, dan faktor yang mempengaruhi. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian penulis mendapatkan bahwa: Penggunaan diskresi oleh kepolisian dalam pelaksanaan tugas yang mengancam keselamatan nyawa petugas pada wilayah hukum Kepolisian Daerah Sulawesi Barat berdasarkan pada penilaiaannya sendiri terhadap situasi dan ancaman yang dihadapi sehingga terpenuhi prinsip Legalitas, Nessesitas, serta Proporsionalitas. Faktor yang paling berpengaruhi dalam penggunaan diskresi oleh kepolisian dalam pelaksanaan tugas yang mengancam keselamatan nyawa petugas yaitu; Substansi hukum yang mana pada substansi hukumnya belum mengatur secara rinci mengenai bentuk dan jenis tindakan yang termaksud kedalam diskresi oleh anggota Polri.
