<![CDATA[Tujuan penelitian menganalisis aturan-aturan Militer ketika berada disatuannya Dalam menjalankan tugasnya, militer memiliki peraturan-peraturan yang harus dipatuhi. Penelitian ini menggunakan Bahan Hukum Primer yang diperoleh secara langsung dilapangan dengan sumber hasil wawancara maupun pengamatan langsung dilokasi penelitian di Oditurat Militer Tinggi IV Makassar, yaitu data kasus perkara tindak pidana desersi dari tahun 2019-2021.Data analisis dengan menggunakan metode kualitatif. Hasil penelitian ini menunjukan bahwa (1) Proses penegakan hukum tindak pidana desersi di oditurat militer tinggi IV Makassar antaranya (1) UU RI nomor 31 tahun 1997 tentang peradilan militer (2) UU RI nomor 58 tahun 2009 tentang kekuasaan kehakiman (3) Peraturan Panglima TNI nomor 7 tahun 2018 tentang kedudukan daerah hukum pengadilan militer, Oditurat Militer tinggi. Sehingga setiap penyelesaian setiap perkara tindak pidana mempunyai keabsahan hukum yang berlaku di negara kesatuan RI, serta hasil putusan tersebut akan menjadikan pembelajaran parajurit untuk menjadi prajurit yang baik dan dapat dijadikan contoh prajurit lainnya. Faktor yang mempengaruhi penegakan hukum tindak pidana desersi di oditurat militer tinggi IV Makassar: (1) faktor internal yaitu : faktor rumah tangga ,faktor ekonomi, faktor niat, faktor usia, faktor pendidikan si pelaku,faktor kurang siapnya ditempatkan di daerah konflik dan daerah terpencil (mental). (2) faktor eksternal yaitu: kurang dipahaminya peraturan yang berlaku dilingkungan TNI, faktor tugas,faktor lingkungan faktor perlakuan atasan atau penguasa. The research objective to analyze the military rules when they are in the unit. In carrying out their duties, the military has regulations that must be obeyed. Data analysis uses qualitative methods. The results of this study indicate that (1) The process of law enforcement for the crime of desertion in the high military oditurat IV Makassar includes (1) Law of the Republic of Indonesia Number 31 of 1997 concerning Military Courts (2) Law of the Republic of Indonesia Number 58 of 2009 concerning Judicial Powers (3) Regulation of the Commander in Chief TNI number 7 of 2018 concerning the legal area of the military court, the High Military Authority. So that every settlement of every criminal case has legal validity in the unitary state of the Republic of Indonesia, and the results of the decision will make the learning of soldiers to be good soldiers and can be used as examples for other soldiers. Factors influencing law enforcement for desertion in the high military oditurat IV Makassar: (1) internal factors, namely: household factors, economic factors, intention factors, age factors, education factors of the perpetrators, factors that are not ready to be placed in conflict areas and remote areas (mentally). (2) external factors, namely: lack of understanding of the regulations that apply within the TNI, task factors, environmental factors, treatment factors of superiors or authorities.]]>
