Abstract

Bank syariah selama ini dikenal sebagai representasi dari kegiatan transaksi Islam di lembaga keuangan. Akan tetapi disebabkan karena kegiatan ekonomi sangat dekat dengan kepentingan bisnis yang sangat kompleks, maka bank syariah dihadapkan pada dua pilihan, antara idealitas dan profitabilitas. Salah satu bagian penting dalam melihat idealitas bank syariah adalah pada aspek asas-asas akad yang dikembangkan. Beberapa asas yang ada dalam hukum Islam secara garis besar bermuara pada dua asas, yaitu apakah bank syariah berbasis pada asas konsensualisme (yang berlandasakan pada ketentuan fikih) atau asas formalisme (bagian dari lembaga berbasis hukum positif). Dari beberapa metode pendekatan dalam pembentukan akad di bank syariah, terlihat bahwa asas konsesualisme yang berbasis hukum Islam berpengaruh pada Fatwa DSN, meskipun DSN juga mengeluarkan fatwa yang berbasis pada formalisme. Di sisi lain, pada saat akad sudah murni masuk dalam dunia perbankan sebagai lembaga aktifitas ekonomi yang bersifat bilateral antara institusi dan lembaga, maka asas akad bank syariah secara mutlak berbasis pada formalisme.

Abstract

The aplication of Syariah bank financial which is based on profit and loss sharing, known as margin profit sharing, seems facing many challenges. From the financing side, the obstacles are asymmetric information problem, side streaming, adverse selection, and moral hazard. The indirect obstacles are the sociological aspect, such as a domination of capitalist system in banking and the non optimum human resources.

Abstract

human resource problems in Indonesia resulted from education that having low quality and uncompetitive in regional and international level. The problem more complex when commendation of APBN budget allocation, which is 20% for the education, cannot be fully realized. State College on Islamic Studies (STAIN) have to reconstruct themselves to find design and paradigm so that can produce alumnus which qualified, capable, and represent akhlakul karimah in implementing Islamic teaching that kafah (perfect). One of them is quality instructor resource that able to explore curriculum, that is based on competence. Curriculum that based on religion in the reality can be conducted with the availability of software programs, like The Holy Qur’an, Al-Kutub At-Tis’ah Li al-Hadits asy-Syarif, Maktabah At-Tafsir, Maktabah Al-Ushul al-Fiqh and others. These are several things to be aimed by STAIN /IAIN as part of their strategic plans. .

Abstract

Islamic economy discourse tend to viewed as no more than conventional economy that developed with ethic-religious content, but actually it’s have wide and specific area. To elaborate that width, nowadays urgently needed a study media or special education related with Islamic economy science discipline. Abstract

prenuptial agreement (Perjanjian pranikah) is social phenomenon that still uncommon among Indonesian society. However,polygamy practice that still controversial necessitates such an arrangement and prenuptial agreement can become basic to alleviatepolygamy that not based on Islamic law. prenuptial agreement content not only cover polygamy, but also harta gono gini (joint marriageproperty) arrangement, even touched family life design that will practiced by spouse.
