Abstract

Discussions upon the use of LPS by Sharia banks are interesting due to the existence of LPS which is believed to be identical to conventional finance system. Sharia banks have their own particular characteristics that make them different from that of conventional ones. Sharia baks operate based on the general rules of banking system and on Islamic faith and morals as well. However, laws on LPS points out that warranty functions are also applicable to sharia banks. LPS is needed to keep the public trust toward banking industries and to promote national economic stability. National economic stability is important. However, being committed to sharia laws is the most important.

Abstract

This article is motivated by the special tasks carried out by thePT. Madani National Capital (PNM), which is only to carry out business activities to channel funds without making efforts to raise funds because this business unit is not a banking institution. The Micro Capital Service Unit (ULaMM) is a capital loan service for micro and small businesses accompanied by guidance to develop their business.UlaMM has been running business activities and providing financing services for the development of cooperatives, micro, small and medium enterprises. The agreement made by both parties was made in writing in accordance with POJK Number 16/POJK.05/2019 concerning the Supervision of PT. Permodalan Nasional Madani, Micro Capital Service Unit (ULaMM). This research uses descriptive qualitative method with data analysis used with descriptive analysis. Based on the method that has been used, it can be concluded that the agreement made is stated in writing in an agreement, this is in line with the provisions contained in POJK article 7 paragraph (2) which regulates that the financing service agreement must be made in writing. The agreement made is also in accordance with the provisions contained in Article 1320 of the Civil Code which regulates the legal terms of agreement.

Abstract

The development of sharia banking law can be seen from the accommodation of the state towards Islamic law in the field of sharia economics, including the development of sharia banking regulations. It is also due to the fact that the development of sharia banking regulations in Indonesia is based on the needs of the Indonesians whose majority are Muslims.  During its development, sharia banking regulations have been carried through three stages, namely introduction, recognition, and purification. Meanwhile, the current legal fact shows that sharia banking existence does not meet its target of development, both institutionally and legally. To answer this problem, a normative legal method was used in conducting this research. The secondary data were qualitatively analysed concerning the purification of sharia banking law in the national banking system. The results shows that purifying sharia banking law can be done by strengthening the existence of sharia banking institutions through banking law policies. Refining the aspect of institutional can also be carried out by setting provisions regarding the settlement of sharia banking disputes in Indonesia.

Abstract

Tulisan ini mengkaji tentang pelaksanaan pembatalan perkawinan oleh jaksa selaku pengacara negara dalam perkara No 62/Pdt.G/2019/PA.SWL. Dengan tujuan mendeskripsikan pelaksanaan pembatalan perkawinan oleh Jaksa pada Pengadilan Agama Sawahlunto Kelas IIB yang telah terlebih dahulu diputuskan pada Pengadilan Negeri Sawahlunto No 42/Pid.B/2018/PN SWL dan pada tingkat Banding oleh Pengadilan Tinggi Padang, berdasarkan Putusan No 113/PID/2018/PT.PDG sebagai putusan a quo. Terdapat kendala-kendala yang dihadapi dalam pelaksanaan pembatalan perkawinan, serta upaya-upaya yang dilakukan oleh jaksa dalam penaganan perkara No 62/Pdt.G/2019/PA.SWL. Jenis penelitian adalah field research pada Pengadilan Agama Sawahlunto Kelas IIB dan Kejaksaan Negeri Sawahlunto dengan bentuk penelitian kualitatif deskriptif. Teknik pengumpulan data dilakukan dengan wawancara dan dokumentasi. Pelaksanaan pembatalan perkawinan pada tahap mediasi yang ditiadakan, karna perkara yang telah diputuskan sebelumnya pada Pengadilan Tinggi Padang yang telah bersifat a quo. Kendala yang dihadapi oleh jaksa dalam pengajuan permohonan pembatalan perkawinan Perkara No 62/Pdt.G/2019/PA.SWL, ialah dalam hal administrasi biaya perkara dan pelaksanaan eksekusi putusan majelis hakim. Upaya yang dilaksanakan oleh Jaksa dalam menyikapi kendala-kendala yang ada, dengan tetap mengacu pada Standar Operasional Prosedur (SOP) dan pengajuan anggaran pada Kejaksaan Tinggi Padang, guna hal menempatkan kepentingan bersama dalam penegakan hukum yang diprioritaskan dibandingkan dengan kepentingan induvidu, agar proses pelaksanaan perkara dapat terjalankan sebagaimana mestinya.

Abstract

This study discusses the implementation of the political rights of disability voters in the 2019 simultaneous elections in Tanah Datar District according to the Disability and Fiqh Law Siyasah Dusturiyah. This type of research is field research in which materials are collected through interviews and documentation. The method used is a sociological juridical research method. Theories used are general election theory, political rights theory, disability political rights theory and siyasah dusturiyah fiqh theory. From the results of the research that the author did, it can be concluded that the implementation of fulfilling the political rights of persons with disabilities in the 2019 Simultaneous Elections in Tanah Datar District has not been carried out optimally. The obstacle faced by KPU in implementing the political rights of persons with disabilities is the difficulty in providing socialization to persons with disabilities. A review of fiqh siyasah dusturiyah on the implementation of the political rights of persons with disabilities was carried out by the Ahlu Halli Wal Aqdi institution which is an institution to accommodate the aspirations of the people. The fulfillment of political rights of persons with disabilities in the election is not in accordance with the fiqh siyasah dusturiyah.

Abstract

The main problem in this thesis is how to implement the main tasks and functions of the head of affairs in the Nagari Simawang government and how to review Islamic constitutional law on the implementation of the main tasks and functions of the head of affairs in the Nagari Simawang government. The purpose of this discussion is to find and describe the implementation of the main duties and functions of the head of affairs in the government of Nagari Simawang and to find out and describe the review of Islamic constitutional law on the implementation of the main tasks and functions of the head of affairs in the government of Nagari Simawang. The type of research that the author uses is field research (field research). Based on the research that the author did, it was found that, several functions carried out by the Head of Government Affairs in Tanah Datar Regency Number 4 of 2008 regarding Nagari had not run effectively because there were several functions that were less effective, namely the function of providing services to the community in the field of land / land. agrarian affairs in accordance with applicable laws and regulations and in the function of assisting tasks in the field of collecting land and building taxes.

Abstract

The purpose of this study is to explain the principles for forming laws and regulations and explain the contents of the TPKS Law from the view of Siyasah Dusturiyah in the formation of the TPKS Law. The type of research used in this research is normative juridical research. The approach taken uses regulatory analysis based on primary legal material by examining theories, concepts, legal principles, and laws and regulations related to the process of forming the TPKS Law, which originate from the 1945 Constitution. This research shows that the principles the principle of forming statutory regulations used in the formation of the TPKS Law are not by the four principles of Formation of statutory regulations, namely: seen from the principle of conformity between types, hierarchies, and content material, it is not appropriate and is considered contrary to Article 29 of the 1945 Constitution. In the view of Siyasah Dusturiyah, in this case, it explains that the rules that are made should aim for benefit, but in the content material of Article 4 paragraph (2) letters d and h, when viewed from the principles of forming legislation, in terms of siyasah dusturiyah, several principles are not according to them, namely: first: the principle of conformity between types, hierarchies, and content material, second: the principle can be implemented, third: the principle of clarity of formulation and fourth: the principle of efficiency and effectiveness

Abstract

The main problem in this thesis is the regulation of hate speech in Law Number 7 of 2017, because when the agenda for a democratic party or also known as elections is approaching, the behavior of hate speech has greatly increased. Certain groups of candidates may clash with other supporting groups, so that Article 28E paragraph (3) of the 1945 Constitution of the Republic of Indonesia, "everyone has the right to freedom of association, assembly and expression of opinions", is very vulnerable to dealing with the right to freedom of opinion and expression. The purpose of this study is to find out more about the regulation of hate speech in Law Number 7 of 2017 concerning general elections and siyasa dusturiyyah reviews. To answer the object of the study, the authors used library research using a normative juridical approach with statutory and conceptual approaches. In this case, it includes primary legal materials, namely from laws and regulations, especially Law Number 7 of 2017 concerning Elections and secondary legal materials from legal and Islamic books and journals. In the research that the authors conducted, it can be concluded that, until now, hate speech in elections in Indonesia has not been clearly interpreted, even in Law Number 7 of 2017 concerning General Elections (Elections) it is not explained in detail regarding how to define, victims, perpetrators, sanctions imposed as well as benchmarks or limitations that can be categorized as hate speech in elections. Law Number 7 of 2017 concerning Elections in fiqh siyasa dusturiyyah, the source of its formation is siyasah wad'iyah because it is produced by mere human thought products which in the drafting process do not pay attention to norms and ethics. Hate speech in Islam is a prohibited act because it can cause harm, especially to the soul, and in it has an element of humiliation, namely lowering one's self-esteem/soul, which should be maintained or guarded for every human being from any group as per the concept of the formulation of the basis of the state (fiqh siyasa dusturiyyah). and the principle is to prioritize guarantees of human rights and realize justice.

Abstract

Putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 merupakan puncak tertinggi pengakuan atas kepercayaan lokal di luar 6 agama resmi dan seharusnya menjadi jaminan kepastian hukum keberadaan kepercayaan lokal dalam bingkai Kebinekaan. Namun fakta hukum yang terjadi tidak demikian karena penganut kepercayaan lokal Sabulungan di Kabupaten Pulauan Mentawai belum mendapatkan jaminan kepastian hukum sebagaimana dikehendaki oleh putusan MK tersebut yaitu terkendala dalam pemenuhan hak keperdataan hanya karena tidak menganut satu dari enam agama resmi di Indonesia. Untuk mengungkap fakta hukum tersebut, peneliti menggunakan penelitian hukum yuridis empiris dan dari hasil penelitian terungkap bahwa Dinas Dukcapil dari 23 jenis layanan yang ada dapat teridentifikasi 8 jenis layanan yang yang berhubungan dengan masyarakat penghayat kepercayaan arat Sabulungan. Kemudian 2 dari tiga Lembaga Keuangan juga telah memberikan perlindungan hak keperdataan kepada penghayat Sabulungan untuk menggunakan fasilitas perbankan. Sementara salah satu bank lainnya belum memberikan pemenuhan hak keperdataan bagi penganut Sabulungan karena sistem pada bank tersebut tidak support.
