Abstract

Penelitian ini berfokus pada hukum puasa Ramadhan bagi ibu hamil dalam dua persepktif (Ulama kontemporer dan kesehatan). Skripsi ini menjelaskan permasalahan: 1). Bagaimana hukum puasa Ramadhan bagi ibu hamil menurut ulama kontemporer? 2). Bagaimana pengaruh dan manfaat puasa bagi ibu hamil dalam bidang kesehatan? Tujuan penelitian ini ingin mengetahui hukum puasa ibu hamil dalam pandangan ulama kontemporer serta mengetahui pengaruh dan manfaat puasa bagi ibu hamil dalam bidang kesehatan. Metode yang digunakan adalah kepustakaan, pengumpulan data melalui hasil bacaan atau literature mengenai object yang diteliti melalui sumber data primer yang diperoleh dari kitab suci al-Qur’an dan hadist nabi serta kitab fiqih ulama-ulama kontemporer, lalu data sekunder yaitu literature kesehatan yang membahas ibu hamil. Analisis data dilakukan dengan cara induktif, mencari jawaban memalui literature, mengkaji pendapat ulama kontemporer dan sumber hukum islam dan kesehatan lalu menyimpulkannya secara deduktif. Hasil penelitian menunjukkan bahwa adanya perbedaan diantara ulama-ulama kontemporer dalam penetapan hukum puasa bagi ibu hamil yakni beberapa ulama menunjukkan wajibnya membayar fidyah tanpa qada’, pendapat lain mengatakan wajib fidyah dan qada’. Sedangkan menurut kesehatan, keseimbangan asupan nutrisi atau gizi pada ibu hamil cukup menjadi hal penting untuk mengetahui aman tidaknya seorang ibu hamil berpuasa. Berdasarkan penelitian tersebut yakni pengaruh puasa pada ibu hamil maka diharapkan adanya penelitian lanjutan dilapangan untuk menyempurnakan dan memperkuat penelitian kepustakaan yang dilakukan peneliti.

Abstract

The main problem in this research is how the marriage of pregnant women with men who are not pregnant in Uraso Village, Kec. Mapdeceng, Kab. North Luwu According to Imam Malik and Shafi'i. The main problems that will be described from the sub-problems are: 1) What are the views of the people of Uroso Village, Kec. Mapdeceng, Kab. North Luwu regarding the marriage of a pregnant woman with a man who did not impregnate her? 2) What is the opinion of Imam Malik and Syafi'i on the marriage of a pregnant woman with a man who did not impregnate her in Uroso Village, Kec. Mapdeceng, Kab. North Luwu?. The type of research used is qualitative research or field research which describes the phenomena that occur in society and aims to produce descriptive data in the form of data, images and behavior of the people observed using a syar'i normative approach sourced from the arguments of the Qur'an, the hadith of the Prophet as well as the ijtihad of the Ulama and the sociological approach. The data sources in this research are sourced from primary data and secondary data. The results of this study indicate that: 1) Regarding the views from interviews with several community and religious leaders, they have different opinions regarding this phenomenon. 2) The scholars agree on the permissibility of marrying adulterers for those who commit adultery. Thus, the marriage of a pregnant woman with a man who impregnates her or commits adultery is legal and they may have intercourse as husband and wife. Meanwhile, the views of Imam Malik and Shafi'i regarding the marriage of a pregnant woman with a man who did not impregnate her have different opinions. Imam Malik is of the opinion that the marriage is invalid. This is because women who have sexual intercourse with adultery have exactly the same legal status as women who have sexual intercourse with syubhat. The woman must purify herself at the same time as the 'iddah of the woman whose husband divorced her, except when had (punishment) is required. Meanwhile, Imam Shafi'i allowed the marriage of a pregnant woman to a man who did not impregnate her.

Abstract

Ulama agreed that women who are Muslim (Muslimah) are forbidden to marry between men who are not from the same religion as her. However, in reality interfaith marriages still continue to occur in society. The main problem in this study is how to analyze interfaith marriage in Makassar City, Biringkanaya District. The purpose of this study is to determine interfaith marriage in the city of Makassar, Biringkanaya District and to know and understand the relevance of the application of interfaith marriage with the concept of Law No. 1 of 1974 and know and understand the validity of interfaith marriage according to Islamic Law. Researchers use qualitative methods, this research is field research, which is a direct review of the location studied to obtain data, then the data is used as the main data or primary data. While the nature of this research is descriptive, that is, it describes regularly the problem under study in accordance with the data obtained then analyzed. The results of this study show that authentically interfaith marriage according to the concept of Law No. 1 of 1974 concerning marriage states that a valid marriage is a marriage carried out according to their respective religions and beliefs. Law No. 1 of 1974 does not expressly prohibit interfaith marriage, resulting in a legal vacuum. According to Islamic Law on interfaith marriage in Indonesia explains that the legal basis for interfaith marriage is not permissible because it involves differences in faith.
