Abstract

AbstractIntegration of Islamic law and customary law of inheritance that run in the Bugis community in District Palakka Bone takes place in the form of assimilation, syncretic, acculturative, and legitimacy. Integration in a syncretic form can be seen in the division of inheritance society that make Islamic law and customary law as a reference. Integration in the form acculturative can be seen at the time of the division of property, there is executed before the death, and there is also carried out after the death of the testator. The integration in the form of legitimacy can be seen from the case of the division of inheritance community continue to provide part of property to the son of the heir who had died earlier than the heir known as substitute heirs. Integration of Islamic law and customary law apply to the division of the community estate Bugis Bone in District Palakka namely because: a. between Islamic law and customary law have interacted for a long time, complementary in addressing the legal needs of the community, b. Islamic law and customary law used as a reference and a major cornerstone in the division of the community estate, c. Islamic law and customary law into the legal awareness of the public to follow both of these rules. d. between Islamic law and customary law have a common vision and goal to bring peace to people's lives.

Abstract

AbstractKnowledge society in the village of Wollangi sub-district of Barebbo about Islamic inheritance law is generally fixed on big gains the beneficiary children of men and women, namely in relation to one. The heirs of the boys gain a larger part than girls. Their knowledge such as this have been embedded in the community with the phrase majjujung makkunraie mallempa oroane. However, knowledge about things that should not be done in the Division of inheritance such as a ban on taking other people's rights, the prohibition of piling up treasures (estate only possessed by one of the heirs), not yet fully understood by the community. The attitude of the people in the village of Wollangi sub-district of Barebbo against the Islamic inheritance laws have mostly positive reaction especially from among the older generation. As for the youth generation less paying attention towards the Islamic inheritance laws which are considered complicated because they rarely get the Islamic inheritance laws about socialization. Awareness of Community law in the village of Wollangi sub-district of Barebbo to actualize the Islamic inheritance laws are quite adequate. But because of their knowledge and their understanding of Islamic inheritance law is still minimal cause them hampered in Islamic inheritance law is actualized.

Abstract

The property of the deceased person becomes an inheritance for his heirs. The purpose of this paper is to analyze the implementation of the inheritance distribution of the Bugis Bone community, Tanete Riattang District by looking at the reasons that the community has for distributing inheritance in Tanete Riattang District. This research is a field study with an empirical normative approach. Data were collected through observation and interviews, then analyzed by qualitative description. The results showed that the Bugis Bone community, Tanete Riattang District, used an Islamic inheritance system in the distribution process. In addition, the application of customs in the inheritance of the Bugis Bone community is also carried out, for example, those that do not include heirs. The heirs conduct deliberation and are given the inheritance to be a form of affection.
