ABSTRACTE-Litigation is a trial that is conducted electronically by minimizing the Parties to meet face to face and come to the Court office, in order to realize the principle of being simple, fast and low cost. As regulated in Perma No.1 / 2019. In practice the entire trial is only submitted via uploading data using registered e-mail. In the case of a Judge's decision, the delivery is also only by sending the result of the decision or decision through the e-Court application. In Article 13 Paragraph (2) of the Law on Judicial Powers, the legality of the Judge's decision is stipulated that it must be read out in a session open to the public. In this way, the procedures for electronic court proceedings and conventional trials are very different. Thus, there are challenges for the success of the e-Litigation system in terms of legal substance, the electronic trial regulated in the Supreme Court Regulation of the Republic of Indonesia no longer uses the Civil Procedure Code, Law Number 48 of 2009 concerning Judicial Power and a hierarchical HIR. above the Perma RI.Key Words : Electronic justice, validity of the judge's decision, e-LitigationABSTRAKE-Litigasi adalah persidangan yang dilakukan secara elektronik dengan cara meminimalisir Para Pihak untuk bertatap muka dan datang ke kantor Pengadilan, guna mewujudkan asas sederhana, cepat dan biaya ringan. Yang diatur dalam Perma Nomor 1 tahun 2019. Pada prakteknya keseluruhan persidangan hanya disampaikan melalui upload data dengan menggunakan e-mail terdaftar. Dalam hal putusan Hakim, penyampaiannya juga hanya dengan mengirim hasil putusan atau penetapan melalui aplikasi e-Court. Dalam Pasal 13 Ayat (2) Undang-Undang Kekuasaan Kehakiman, diatur syarat sahnya putusan Hakim adalah harus dibacakan dalam sidang terbuka untuk umum. Dengan begitu tata cara persidangan elektronik dan persidangan konvensional sangatlah berbeda. Demikian, terdapat tantangan bagi keberhasilan sistem e-Litigasi ditinjau dari aspek substansi hukum, sidang elektronik yang diatur dalam Peraturan Mahkamah Agung RI tidak lagi menggunakan Kitab Undang-Undang Hukum Acara Perdata, Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman dan HIR yang hirarki di atas Perma RI tersebut.Kata Kunci : Persidangan elektronik, keabsahan putusan Hakim, e-Litigasi
