Abstract

AbstrakTulisan ini membahas proses pembatalan sertipikat hak milik atas tanah karena akta jual beli yang dijadikan sebagai dasar pendaftaran tanah terdapat cacat hukum pada putusan nomor 72/G/2018/PTUN.BDG. Pembatalan sertipikat di Indonesia, dimungkinkan dilakukan karena berdasarkan penjelasan umum PP 24/1997 tersirat bahwa sertipikat itu memiliki kekuatan alat bukti yang kuat tetapi tidak memiliki kekuatan alat bukti yang mutlak. Penjelasan umum dari ketentuan tersebut menyebutkan bahwa pihak yang tertulis di Sertipikat dapat digugat keabsahan kepemilikannya dalam jangka waktu sampai 5 tahun sertipikat tersebut terbit. Oleh karena itu sertipikat tidak memiliki kekuatan yang mutlak karena pihak yang tertulis di sertipikat tidak membuat pihak yang sesungguhnya yang merupakan pemilik sah akan kehilangan hak. Metode penilitian tulisan ini menggunakan bentuk penelitian yuridis-normatif dengan tipologi penelitian deskriptif, dan menggunakan data sekunder yang didukung dengan wawancara. Hasil dari penelitian ini yaitu proses pembatalan sertipikat berdasarkan putusan nomor 72/G/2018/PTUN.BDG belum dapat dilaksanakan karena menurut Badan Pertanahan Nasiolan Kota Depok, belum ada permohonan dari pihak penggugat sebagaimana diamanatkan pada Pasal 50 Ayat (1) PMNA 11/2016. Sehingga Menurut BPN Kota Depok walaupun telah diterima putusan pengadilan, tidak serta merta sertipikat menjadi otomatis batal melainkan harus dilakukan permohonan terlebih dahulu.Kata kunci: Pembatalan Sertipikat, Akta Jual Beli, Cacat Hukum.The Process of Cancellation of Certificate of Land Ownership Due To The Deed of Sale and Purchase is Legally Defected (Case Study of Decision Number 72/G/2018/PTUN.BDG)AbstractThis paper discusses process of cancellation of a certificate of land ownership due to the deed of sale and purchase which is used as the basis for land registration has legal defects in decision number 72/G/2018/PTUN.BDG. The cancellation of a certificate in Indonesia is possible because based on the general explanation of PP 24/1997 it is implied that the certificate has strong evidence but does not have absolute evidence. A general explanation of this provision states that the party written in the Certificate can be sued for the validity of its ownership within a period of up to 5 years the certificate is issued. Therefore the certificate does not have absolute power because the party written Abstracton the certificate does not make the real party who is the legitimate owner shall lose the right. This paper research method uses a form of juridical-normative research with descriptive research typology, and uses secondary data which is supported by interviews. The results of research in this thesis is the process of certificate cancellation is based on decision number 72 / G / 2018 / PTUN. BDG cannot be implemented because according to the BPN Depok City, there is no application from the plaintiff as mandated in Article 50 Paragraph (1) PMNA 11/2016. So according to the BPN Depok City even though a court decision has been received, it does not necessarily mean that the certificate will automatically be canceled, unless the application must be done in advance.Keywords: Cancellation of Certificate, Deed of Sale and Purchase, Legal Defect.
