Abstract

Health law definitely states that food and beverages can only be distributed in public upon issuance of adistribution permit. Hence, prior to being permitted the food and beverages are not allowed to bedistributed in public. On the other hand, in line with the development of society, the rapid distribution ofprocessed food (food and beverages), especially those produced as home industries, with or withoutpackaging, has caused much concerns due to violation of the distribution permit and contamination of theproducts with its associated health risks in the short, medium, and long term. The present researchproposed three basic questions. Firstly, how did the implementation of a distribution permit of food andbeverages promote food safety in Semarang. Secondly, what factors if any, discourage the implementationof a distribution permit of food and beverages to promote the food safety. Normative and empirical legalresearch method has been employed for this research, using both primary and secondary data. Theprimary data were collected in the field; whereas the secondary data came from primary, secondary, andtertiary legal establishments, respectively. Results of this study showed that implementation of adistribution permit of food and beverages produced by home industries are in general the responsibilityof the Office of Health in the City or Regency, with the issuance of Induction Certificates and HomeIndustry Products Certificates. These certificates are officially legal permits as a guarantee that the foodand beverages produced by home industries are safe; and as a protection against food additives thatcould be detrimental to health. The implementation is basically a persuasive action under the assumptionof human dignity rather than tough and normative legal procedures. Obstacles to the implementationincluded factors such as economic condition, inadequate knowledge of both consumers and producers,as well as the weak legal measures on food safety. A number of factors were found to affect the foodsafety in Indonesia, i.e. food system, culture, food chain, environment, nutrition and epidemiology. It wassuggested that education for consumers to raise awareness of food safety was of prime importance.Consumers should be made aware and fully understand the food safety system and its associated healthrisks due to insecure food safety.Keywords : distribution permit of food and beverages, food safety, food system.

Penelitian ini mengkaji permasalahan efektivitas implementasi izin edar produk PIRT sebagai perwujudan sistemkeamanan pangan terpadu yang masih perlu untuk dikembangkan dalam bentuk model, guna lebihmenyempurnakan kebijakan tersebut menuju pada tingkat optimalisasi dan efektivitas yang diharapkan, yangantara lain tercermin dari indikator terwujudnya peningkatan standar keamanan pangan menurut Undang-undangNo. 18 Tahun 2012 tentang Pangan. Berdasarkan hasil penelitian sebelumnya menunjukkan, bahwa secara umumSKPT dalam pelaksanaannya mengalami kelemahan sinergis antar jaringan yang dibentuk, dan secara nyatacenderung berpengaruh pada tingkat efektivitasnya. Metode penelitian yang dipergunakan adalah penelitian yuridissosiologis, guna melihat fakta empirik yang terjadi di masyarakat dengan melakukan observasi dalam bentukkomunikasi interaktif secara mendalam dengan para stakeholder terkait serta para produsen dan konsumen PIRT,melalui pendekatan penerapan rancangan model pengembangan SKPT yang telah dirumuskan. Dari hasilpenelitian lanjutan ini, setidak-tidaknya dapat lebih memberikan solusi alternatif dalam rangka membangun sinergiyang terintegrasi guna meningkatkan efektivitas dan optimalisasi pelaksanaan ketentuan izin edar produk panganindustri rumah tangga (PIRT). Dengan demikian, dari keseluruhan rangkaian kegiatan penelitian ini, diharapkandapat menumbuhkan tingkat kesadaran bersama akan pentingnya keamanan pangan, guna lebih meningkatkankualitas perlindungan konsumen pangan dari banyaknya peredaran produk pangan industri rumah tangga yangtidak berizin edar.Kata Kunci : Izin edar, PIRT, SKPT, Stakeholder

Abstract

This study further examines the previous research that has formulated an integrated food safety system development model in realizing the optimal implementation of PIRT product distribution licenses. With the socio-legal research approach method, it does not only examine normative matters, but also data collection in the field through comprehensive observation and interviews with related parties and is analyzed qualitatively. What is more emphasized from the results of this study is focused on aspects of the embodiment of consumer food consumer protection in the home industry through strengthening synergistic and integrated food security systems. BasedonLawNumber18Year2012concerningfood,alegalchannelis opened for consumers to claim compensation when they suffer losses due to consuming food that causes harm to it, along with the circulation of food that does not meet health requirements namely, safe, quality, and nutritious so that can cause harm to consumers.

Abstract

This study examines further from previous studies that have discussed the regulation and form of food consumer protection through the realization of an optimal integrated food safety system. With the sociological juridical approach method, it not only examines normative matters, but empirical data collection is also carried out in the field through observation and comprehensive interviews with related parties as well as qualitatively analysed. The thing that is more emphasized from the results of this research is focused on the aspects of the realization of the protection of home industry food consumers through strengthening the food safety system more broadly and reaching all levels of society. The results of this study in principle put more emphasis on efforts to increase the strengthening of working relationships balanced with proportional clarity of the main tasks and functions of the stakeholder agencies, so that the final target leads to a more effective, strong and reliable consumer protection.

Penelitian ini mengkaji permasalahan efektivitas implementasi izin edar produk PIRT sebagai perwujudan sistem keamanan pangan berkelanjutan yang masih perlu untuk dikembangkan, guna lebih menyempurnakan kebijakan tersebut menuju pada tingkat optimalisasi dan efektivitas yang diharapkan, yang antara lain tercermin dari indikator terwujudnya peningkatan standar keamanan pangan menurut Undang-undang No. 18 Tahun 2012 tentang Pangan. Berdasarkan hasil penelitian sebelumnya menunjukkan, bahwa secara umum SKPT dalam pelaksanaannya mengalami kelemahan sinergis antar jaringan yang dibentuk, dan secara nyata cenderung berpengaruh pada tingkat efektivitasnya. Metode penelitian yang dipergunakan adalah penelitian yuridis sosiologis, guna melihat fakta empirik yang terjadi di masyarakat dengan melakukan observasi dalam bentuk komunikasi interaktif secara mendalam dengan para stakeholder terkait serta para produsen dan konsumen PIRT, melalui pendekatan penerapan rancangan model pengembangan SKPT yang telah dirumuskan. Dari hasil penelitian lanjutan ini,  setidak-tidaknya dapat lebih memberikan solusi alternatif dalam rangka membangun sinergi yang terintegrasi guna meningkatkan efektivitas dan optimalisasi pelaksanaan ketentuan izin edar produk pangan industri rumah tangga (PIRT). Dengan demikian,  dari keseluruhan rangkaian kegiatan penelitian ini, diharapkan dapat menumbuhkan tingkat kesadaran bersama akan pentingnya keamanan pangan, guna lebih meningkatkan kualitas perlindungan konsumen pangan dari banyaknya peredaran produk pangan industri rumah tangga yang tidak berizin edar. Kata Kunci : Izin edar,  PIRT,  SKPT,  Stakeholder ABSTRACTThis study examines the problems of effective implementation of the distribution permits of products PIRT as the embodiment of the system of integrated food safety still need to be developed, in order to further refine the policy towards the level of optimization and effectiveness is expected, among other things reflected in the indicators of the realization of improved standards of food safety according to Law No. 18 Year 2012 on Food. Based on the results of previous studies have shown, that in general SKPT experienced weakness in its implementation synergy between networks are formed, and significantly tend to influence the level of effectiveness. The research method used is the juridical sociological research, in order to see the empirical facts that occurred in the community by making observations in the form of in-depth interactive communication with the relevant stakeholders as well as the producers and consumers PIRT, through the adoption of the draft approach SKPT development model has been formulated. From the results of this further research, at least can be provided alternative solutions in order to build an integrated synergy to enhance the effectiveness and optimization of the implementation of the provisions of the marketing authorization of food products of domestic industry (PIRT). Thus, on the whole range of research activities, is expected to raise the level of mutual awareness of the importance of food safety, in order to further improve the quality of consumer protection circulation of food from many food products industry household unauthorized distribution.
