Abstract

Menurut KUHPerdata perikatan dengan ancaman denda dapat dikenakan oleh kreditur kepada debitur yang lalai tidak melakukan kewajibannya. Namun dalam perjanjian kerja antara advokat dan klien tentang penanganan perkara perdata Nomor 911/Pdt.G/2018/PA Mkd, pengenaan denda justru dilakukan oleh advokat (debitur) terhadap kliennya (kreditur). Pengenaan denda tersebut berlaku jika klien melakukan pencabutan perkara, padahal diketahui bahwa klien sudah melakukan pembayaran secara tunai kepada advokat. Analisis ini didasarkan pada asas dalam perjanjian, peraturan dalam KUHPerdata, dan Kode Etik Advokat Indonesia. Hasil analisis adalah bahwa berdasarkan asas konsensualisme, asas pacta sunt servanda, dan asas kebebasan berkontrak perjanjian kerja yang dibuat antara advokat dan klien tidak menyalahi asas tersebut dan seharusnya ditaati dan dilaksanakan oleh para pihak. Namun berdasarkan Pasal 1304, Pasal 1307, dan Pasal 1243 KUHPerdata, pengenaan denda oleh advokat kepada klien tidak dapat dilaksanakan karena tidak ada kerugian materiil yang diderita oleh advokat. Sedangkan berdasarkan Kode Etik Advokat, pengenaan denda tersebut sangat bertentangan dengan Pasal 3 dan Pasal 4 Kode Etik Advokat Indonesia.

Abstract

Law Number 16 of 2011 concerning Legal Aidmandates the government's obligation to provide legalaid funds to disadvantaged communities. To be able tochannel these funds, the Ministry of Law and HumanRights collaborates with Legal Aid Organizations (OBH)throughout Indonesia. There are more than 500 OBHspread throughout Indonesia. As many as 40 (forty)OBH are found in Central Java and 19 (nineteen) OBHare in the Special Region of Yogyakarta. The existingOBH is also required to make various efforts so thatlegal aid funds can be maximally absorbed. Thisresearch was conducted to find out how and thestrategies carried out by OBH in absorbing legal aidfunds by the Ministry of Law and Human Rights inCentral Java and the Special Region of Yogyakarta.From the research conducted, it was found that inabsorbing OBH legal aid funds in Central Java and DIYconducted 1. Recruitment and collaborating withexisting university alumni as well as, 2. Conductinglegal counseling in collaboration with CommunityService Agencies and students , especially for OBHunder the University 3. Cooperation or communication,both formally (based on the MoU) and non-formal (oralcommunication) between OBH and the JudicialInstitution. 4. Conduct legal socialization through massmedia, such as newspapers and radio, and 5. Make useof its own network of members to provide assistance tothe poor justice seekers.

Abstract

A marriage can only be done if the man was 19 years old and women were 16years old. And if there are people who will do the marriage but has not attained the ageof 21, then it must get permission from their parents. And if the marriage do not reach19 years for men and has not reached 16 years for women, it must apply for adispensation to marry Religious Court. The purpose of this law gives the limit for themen and women who will be the creation of marriage is for the benefit of the family andhousehold. But often occurs in people of a marriage that is done by people who have notreached the age of 19 years for men and has not reached 16 years for women. In 2011Yogyakarta Religious Court has issued a dispensation to marry as many as 58determination. That is, an average of 4 to 5 per month determination issued ReligiousCourt of Yogyakarta. Mating the number of dispensations issued the religious court in2011 that became interesting to do further research.This study would like to know what are the reasons for the applicant to applyfor a dispensation to marry in the Religious Court of Yogyakarta, the majority of theparty who filed the application for a dispensation to marry, and how the average age ofthe prospective bridegroom are applying for the marriage dispensation. The results of thisstudy is that a reason to apply for a dispensation to marry because marriage petitionwas rejected by the Office of Religious Affairs (KUA) local because of age who have notreached the minimum when the marriage should still be held because of the reasons thatis urgent in which the prospective bride is already in a state of pregnancy. Party the mostwidely applied for is of the prospective bridegroom, and the average age of the prospectivebridegroom are applying for a dispensation to marry is 17 years and 3 months.
