Abstract

Sale and Purchase is an agreement in which the binding party submits an object and the other party pays the agreed price, as regulated in Article 1457 of the Civil Code. Buying and selling transactions are often disputed in court. As in the case of disputes over the sale of land rights whose certificates of ownership have not been improved, the names of objects in this study. This research is descriptive, with a normative juridical approach with the support of an empirical juridical approach. The data used are secondary data as main data and primary data as supporting data collected through library research and field studies with interview techniques. Results Based on research and discussion that the settlement of disputes over the sale of land rights for land whose ownership has not been renamed is carried out through a court session. The plaintiff filed a lawsuit against the defendant (the seller) and the co-defendant (Office of ATR/BPN Padang City) for the land he had purchased, but the whereabouts of the defendant had not been changed. The plaintiff's claim was granted by the judge. Furthermore, the judge participated in the Defendant's ATR/BPN Office to transfer the name of the Certificate of Ownership to Land with No. 2475/Kelurahan Kuranji which is still registered in the name of the Seller (the Defendant) to the name of the Plaintiff without seeking approval from the defendant because of the verstek decision by the judge and also helping the defendant (Office of ATRBPN Padang City) to pay court fees.

Abstract

Advances in information technology make it easy for the public to be able to find all the information needed quickly. One of these telecommunications service providers is Plasa Telkom Indonesia. The use of this internet service does not always run smoothly as expected. Sometimes there are several factors that then interfere with the access to this internet service. Among them, the increasing number of users causes network disturbances, optical cable breaks, and other technical problems. This of course can harm consumers in the use of these services. Meanwhile, as a business actor, Plasa Telkom Indonesia must be responsible for providing good service to consumers. The specification of this research is descriptive by using normative empirical juridical method. The source of data in this study is secondary data. Secondary data were obtained through document studies and field research. The data collected were analyzed qualitatively and presented in a qualitative descriptive form. The results of the study show that the legal protection given to IndiHome consumers by Plasa Telkom as a business actor is preventive and repressive. This preventive protection is in the form of socialization and the use of standard clauses regarding subscription terms. Meanwhile, repressive protection is by conducting deliberation, providing compensation/compensation in accordance with the agreement of the parties and the compensation given by Plasa Telkom is usually not in the form of money, but in the form of benefits/services. Plasa Telkom's form of accountability to consumers is to implement a Service Level Guarantee, but in practice the Service Level Guarantee is not always given properly by Plasa Telkom.

Abstract

Abstract: This study aims to determine the implementation of covert purchases by investigators from the Ditresnarkoba Regional Police of West Sumatra in order to collect evidence on narcotics crimes and the effectiveness of the implementation of covert purchases by investigators from the Ditresnarkoba Regional Police of West Sumatra in uncovering narcotics crimes. The approach used is a normative juridical approach as the main approach, supported by an empirical juridical approach. The data used are secondary data as the main data and primary data as supporting data collected by library research and field studies using interview techniques. An informant or a member of the police, or other official who is seconded to the police, acts as a buyer in an illicit transaction of buying and selling narcotics and psychotropics, with the intention that when this happens, the seller or intermediary or people related to the supply of narcotics and psychotropics can arrested along with the evidence at the crime scene. The hidden purchase of narcotics by investigators has been running effectively, because it has a high success rate, which makes it easier for investigators to make arrests and dismantle and unravel networks of narcotics abuse and its distribution down to the dealer level. Abstrak: Penelitian ini bertujuan untuk mengetahui pelaksanaan pembelian terselubung oleh penyidik Ditresnarkoba Kepolisian Daerah Sumatera Barat guna pengumpulan barang bukti pada tindak pidana narkotika dan efektivitas pelaksanaan pembelian terselubung oleh penyidik Ditresnarkoba Kepolisian Daerah Sumatera Barat dalam mengungkap tindak pidana narkotika. Pendekatan yang digunakan adalah pendekatan yuridis normatif sebagai pendekatan utama, didukung pendekatan yuridis empiris. Data yang digunakan adalah data sekunder sebagai data utama dan data primer sebagai data pendukung yang dikumpulkan dengan studi kepustakaan dan studi lapangan dengan teknik wawancara. Seorang informan atau anggota polisi, atau pejabat lain yang diperbantukan kepada polisi bertindak sebagai pembeli dalam suatu transaksi gelap jual beli narkotika dan psikotropika, dengan maksud pada saat terjadi hal tersebut, si penjual atau perantara atau orang- orang yang berkaitan dengan suplai narkotika dan psikotropika dapat ditangkap beserta barang bukti yang ada pada tempat kejadian perkara. Pembelian terselubung narkotika oleh penyidik sudah berjalan efektif, karena memilik tingkat keberhasilan yang tinggi, dimana mempermudah penyidik untuk melakukan penangkapan dan membongkar serta mengurai jaringan penyalahgunaan narkotika dan peredarannya sampai ke tingkat bandarnya.
