Abstract

Masyarakat Ekonomi Asean (MEA) berlaku tanggal 31 Desember 2015. Haltersebut di Indonesia memberi implikasi positif yang harus dimanfaatkan danimplikasi negatif yang harus diantisipasi. Permasalahan kesiapan Indonesia dalammenghadapi Arus bebas barang dan tenaga kerja terampil. Penelitian inimerupakan penelitian hukum normatif, dengan pendekatan perundang-undangan.Hasil penelitian menunjukkan bahwa Pemerintah telah menetapkan pedomanuntuk peningkatan daya saing nasional dan persiapan pelaksanaan MEA dalam 14(empat belas) strategi. Strateginya antara lain penerapan Standar NasionalIndonesia dan peningkatan kompetensi tenaga kerja. Penambahan lingkup SNIWajib dalam Industri Kulit mengacu pada Rencana Induk Pembangunan IndustriNasional Tahun 2015-2035 serta pertimbangan keselamatan, keamanan,kesehatan, atau pelestarian fungsi lingkungan hidup. Peningkatan kompetensitenaga kerja dilakukan melalui pelatihan berbasis kompetensi dan pendidikanvokasi industri berbasis kompetensi yang diselenggarakan dengan mengacuSKKNI Industri Kulit. Dengan optimalisasi kebijakan SNI dan SKNNI,diharapkan Indonesia memiliki kesiapan lebih baik dalam menghadapi MEA.

Abstract

AbstractAfter the amendment to the 1945 Constitution of the Republic of Indonesia, the Election of President and Vice President was not conducted by the People's Consultative Assembly but voted directly by the people. Amendment to the provision for the election of President and Vice President have invited debate, partly because they are deemed incompatible with Pancasila. This study examines the appropriateness of the presidential and vice-presidential election based on Pancasila. The research method uses normative juridical, using secondary data obtained through literature study and qualitative analysis. The result and discussion of this research are that the implementation of the election of President and Vice President based is in accordance with Pancasila, especially with the fourth principle.Keywords: Democracy, Direct Election, and Pancasila AbstrakSetelah amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Pemilihan Presiden dan Wakil Presiden tidak dilakukan oleh Majelis Permusyawaratan Rakyat tetapi dilaksanakan langsung oleh rakyat. Amandemen terhadap ketentuan untuk pemilihan Presiden dan Wakil Presiden telah mengundang perdebatan, sebagian karena mereka dianggap tidak sesuai dengan Pancasila. Studi ini mengkaji kelayakan ketentuan pemilihan presiden dan wakil presiden berdasarkan Pancasila. Metode penelitian menggunakan metode yuridis normatif, menggunakan data sekunder yang diperoleh melalui studi literatur dan dianalisis secara kualitatif. Hasil dan pembahasan penelitian ini adalah bahwa pelaksanaan pemilihan Presiden dan Wakil Presiden berdasarkan Pancasila sudah sesuai dengan Pancasila, terutama dengan prinsip keempatKata Kunci: Demokrasi, Pemilihan Langsung, Presiden dan Wakil Presiden, Pancasila. АннотацияПосле внесения поправки в Конституцию Республики Индонезия 1945 года выборы президента и вице-президента не проводились Народной Консультативной Ассамблеей, а проводились непосредственно всенародными выборами в Индонезии. Поправки к положениям о выборах президента и вице-президента вызвали дебаты, отчасти потому, что они считаются несовместимыми с Панчасилой. В этом исследовании рассматривается соответствие принятия положений о президентских и вице-президентских выборах на основе Панчасилы. Метод исследования – нормативно-юридический, используя вторичные данные, полученные в результате изучения литературы и проанализируемые качественным методом. Результаты и обсуждение этого исследования заключаются в том, что осуществление выборов президента и вице-президента на основе Панчасилы соответствует Панчасиле, особенно четвёртому принципу.Ключевые слова: Демократия, Прямые Выборы, Президент и Вице-Президент, Панчасила.

Abstract

Accreditation  requirements  in  Procurement  of  Civil Servants  in  2017  raise  a  controversy  because according  to  the  Ombudsman  of  the  Republic of  Indonesia these  conditions  are  discriminatory.  This study  examines  the  suitability  of  accreditation  requirements  in  the  Procurement  of  Civil  Servants  in 2017  with  the  applicable  laws  and  regulations.  This  research  is  a  normative  study  using  the  legal approach.  The  results  show  that  the  conditions  for accreditation  are  merely  additional  requirements and  needed  to  guarantee  the  legality  of  the  education  attainment  of  an  applicant.  Accreditation requirements  for  different  general  formation  paths in  each department  have yet  to  be  in accordance with the principle of equality as mentioned in one of the Good Governance General Principles.

Abstract

Procurement of Civil Servants (PNS) which is not in accordance with the legislations and the general principles of good governance have the potential to become State Administration disputes. One of the examples is a civil servant procurement dispute in Dompu District in 2014 where the Judges decided to reject the plaintiffs claim by considering the Contrario Actus Principle. This research was a normative research by using a statute and case approach. The legal materials used in this research were primary and secondary legal materials. Moreover, the data analysis method used was descriptive qualitative. The results showed that in the Civil Servant Procurement Dispute in Dompu District in 2014, the Judges of Mataram Administrative Court judged that the Dompu District Head, in terms of authority and procedure, did not violate the laws and the general principles of good governance. Moreover, in terms of substance, the Judges considered that the Dompu District Heads decision was in accordance with the Contrario Actus Principle. By looking at the decidende ratio and Law Number 30 of 2014 concerning Government Administration, the limits on the implementation of the Contrario Actus principle in the procurement of Civil Servants are; 1) The withdrawn KTUN is a bound KTUN, 2) The withdrawn KTUN has a defective authority, 3) The withdrawn KTUN has a defective procedure, and/or 4) The withdrawn KTUN has a defective substance which is caused by fraud, coercion, bribe, or error.Pengadaan Pegawai Negeri Sipil (PNS) yang tidak sesuai dengan peraturan perundang-undangan dan Asas-Asas Umum Pemerintahan Yang Baik berpotensi menjadi sengketa Tata Usaha Negara. Salah satu contohnya adalah sengketa pengadaan PNS di Kabupaten Dompu Tahun 2014 dimana Majelis Hakim memutuskan menolak gugatan penggugat dengan pertimbangan Asas Contrario Actus. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan undang-undang dan pendekatan kasus. Bahan hukum yang digunakan adalah bahan hukum dan bahan hukum sekunder. Metode analisis data yang digunakan adalah deskriptif kualitatif. Hasil penelitian menunjukkan bahwa dalam sengketa Tata Usaha Negara pengadaan PNS Kabupaten Dompu Tahun 2014, Majelis Hakim PTUN Mataram menilai secara kewenangan dan prosedur Bupati Dompu selaku tergugat tidak melanggar peraturan-perundang-undangan dan Asas-Asas Umum Pemerintahan Yang Baik. Sementara secara substansi, Majelis Hakim menilai keputusan Bupati Dompu sudah sesuai dengan Asas Contrario Actus. Dengan melihat ratio decidende dan ketentuan Undang-Undang Nomor No. 30 Tahun 2014 Tentang Administrasi Pemerintahan maka batasan penggunaan asas Contrario Actus dalam pengadaan PNS adalah 1) KTUN yang dicabut merupakan KTUN yang bersifat terikat, 2) KTUN yang dicabut terdapat cacat wewenang, 3) KTUN yang dicabut terdapat cacat prosedur, dan/atau 4) KTUN yang dicabut terdapat cacat

Abstract

This research aims to review and analyze the provisions on the deletion of registration and identification of motorized vehicles data for the owners of motorized vehicles who do not re-register at least 2 (two) years after the validity period of the motorized vehicle number is expired in the perspective of Human Rights and provide prescriptions on the provisions referred to. This research is normative research by using statute approach. The results of the study found that motorized vehicle ownership is a Human Rights which is included in the category of derogable rights. The deletion of motorized vehicle data is a limitation of Human Rights and is regulated in Act Number 22/2009 about Traffic and Road Transport. However, the aforementioned limitation has the potential to be incompatible with the purpose of the limitation as stipulated in the Constitution of the Republic of Indonesia. Reviewing the provisions of Article 74 paragraph (3) of Act No. 22/2009 and implementation of the national program of changed motorized vehicle ownership, needs to be prioritized, so that the objectives of the motorized vehicle registration provisions can be achieved and will ultimately increase revenue from motorized vehicle tax. Penghapusan Registrasi dan Identifikasi Kendaraan Bermotor dalam Perspektif Hak Asasi Manusia Penelitian ini bertujuan mengkaji dan menganalisis ketentuan penghapusan registrasi dan identifikasi kendaraan bermotor bagi pemilik kendaraan bermotor yang tidak melakukan registrasi ulang sekurang-kurangnya 2 (dua) tahun setelah habis masa berlaku Surat Tanda Nomor Kendaraan Bermotor dalam perspektif Hak Asasi Manusia dan memberikan preskripsi atas ketentuan dimaksud. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan undang-undang. Hasil penelitian menemukan bahwa kepemilikan kendaraan bermotor merupakan Hak Asasi Manusia yang termasuk dalam kategori derogable rights. Penghapusan data kendaraan bermotor diatur dalam Undang-Undang Nomor 22 Tahun 2009 dan telah sesuai dengan ketentuan pembatasan Hak Asasi Manusia ditetapkan dalam suatu Undang-Undang, namun pembatasan dimaksud berpotensi tidak sesuai dengan tujuan pembatasan yaitu Ketertiban Umum. Peninjauan ulang ketentuan Pasal 74 ayat (3) Undang-Undang Nomor 22 Tahun 2009 dan penyelenggaraan program balik nama kendaraan bermotor secara nasional perlu diprioritaskan agar tujuan ketentuan registrasi kendaraan bermotor dapat tercapai dan pada akhirnya akan meningkatkan pendapatan dari pajak kendaraan bermotor.

Abstract

This study aims to examine and analyze the rights of persons with mental disabilities in the procurement of Civil Servants. This research is a normative research using the statute approach. The results of the study found that the disabilities types in Act Number 5/2014 concerning State Civil Apparatus include persons with physical disabilities, deaf and blind people, which are different from the disability types set out in Act Number 8/2016. The difference in disability types is due to Act Number 5/2014 issued at the time Act Number 4/1997 concerning Disabled Persons is still in effect, and this implies that the mental disability rights to apply for Civil Servants are not yet accommodated.

Abstract

Creating an organization or company, both in terms of form and purpose, is made based on a vision to fulfill human interests. In its implementation, the mission is managed by human resources. In addition, human resources are a central factor in an organization or company. So that the need for effective and efficient human resource management to achieve the company's goals optimally. This research is a case study using primary data collected from interviews and observations. In addition, it also uses supporting data, namely secondary data obtained from the results of previous studies and literature studies. This research aims to study and identify human resource development systems in the automotive industry by linking IOI's role in preparing competent human resources in the automotive industry in Indonesia. The results of the study show that the development and improvement of HR competencies in the automotive industry can be carried out by: (1) Competency-based education and training systems; (2) Organizing training with a 3 in1 system; (3) Reskilling and Upskilling; and (4) participating in the PIDI 4.0 ecosystem. In addition, there is a need for good coordination and cooperation between IOI organizations and stakeholders such as academics, business, government, and society in order to be able to create competent human resources to advance the national automotive industry.

Abstract

Garbage is something that will always grow along with the rate of population growth. If waste is not managed properly, it will become a problem that often leads to disputes. Dispute resolution regarding waste management is currently regulated in Law Number 18 of 2008 concerning Waste Management, but the norms governing it are still unclear. This research is a type of normative research that is carried out using a statutory approach. The results of the research show that Law Number 18 of 2008 concerning Waste Management does not clearly define Waste Management as one of the parties to a dispute in waste management. This is contrary to the Principle of Clarity of Formula contained in Law Number 12 of 2011 concerning Formation of Legislation as last amended by Law Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning Formation of Legislation invitation. The unclear definition of Waste Management can ultimately result in legal certainty in waste disputes.

Abstract

This study has the aim of analyzing the cancellation of the graduation status of Civil Servant procurement applicants whose educational qualifications are not in accordance with those that have been established and only known in the future. This research uses normative legal research methodology with a statute approach. The results of the study found that Government Regulation Number 11 of 2017 concerning Management of Civil Servants as amended by Government Regulation Number 17 of 2020 only regulates the dismissal of Candidates for Civil Servants and does not explicitly regulate the cancellation of graduation. The provisions in Government Regulation Number 11 of 2017 mutatis mutandis apply to the cancellation of the graduation status of applicants who have educational qualifications that do not match, with the limitation that applicants have provided incorrect information regarding their educational qualifications. The principle of contrario actus stipulates that the Staffing Officer is the official authorized to revoke/cancel a decision due to a substance defect in the form of a factual discrepancy regarding educational qualifications caused by the applicant. However, the cancellation of the applicant's graduation cannot be done if the incompatibility of educational qualifications is caused by the inaccuracy of the Civil Service Procurement Committee. This is because there is the principle of mistakes made by State Administrative Officials in issuing decisions that cannot result in losses for justice seekers/society.

Abstract

The purpose of this study was to determine the direct and indirect effect of leadership style and work motivation variables on employee performance with job satisfaction as an intervening variable at Plaza Toyota Citereup Branch. The independent variables in this study are leadership style (X1) and work motivation (X2), the intervening variable is job satisfaction, and the dependent variable is employee performance. The population used was 42 respondents using the saturated sample method. The data analysis techniques used in this research are instrument feasibility test, path requirements test, path analysis, coefficient of determination, T test and Sobel test. The application used is SPSS version 24. The results of the T test prove that the independent variable affects the intervening variable and the dependent variable, this is evidenced by the value of t count > table. The results of the Sobel test prove that the variables of leadership style and work motivation affect employee performance through job satisfaction, as evidenced by the p-value <0.05.
