Abstract

إن المال من الضروريات التي لا تستقيم مصالح الإنسان إلا بها، ونظراً في واقع حياة الناس اليوم، في معاملاتهم المالية المعاصرة فيما بينهم، وطرقهم في الحصول والتكسب على المال، بعضهم لا يبالون أهي بطريقة صحيحة أم بطريقة محرمة، حتى أصبحت أموالهم كلها محرمة، أو مختلطة بين الحلال والحرام، فلذلك، يرى الباحث أنه في غاية الأهمية وحاجة ماسة في بيان أحكام الانتفاع بهذه الأموال وضوابطه خاصة إذا كانت جميع الأموال كلها محرمة في الفقه الإسلامي. وهذا البحث هو البحث المكتبي الوصفي التحليلي يعتمد على المذهب الشافعي لأن أغلب شعب بلدنا إندونيسيا ينتسبون إلى هذا المذهب. ومن أهم النتائج بعد البحث والاطلاع: أن المال الحرام لذاته لا يجوز بيعه مطلقا، وقد يجوز الانتفاع به في بعض الأعيان في شيء عند الشافعية، وأما المال المحرم لذاته الذي لا منفعة فيه مطلقا إلا في حالة الضرورة فيشرع لمالكه أن يتلفه. والمال الحرام لكسبه إن كان مالكه معروفا وتمكن من رد المال إليه أو إلى وكيله أو وارثه فيجب الرد إليه، وإن كان صاحب المال مجهولا ولم يتمكن من رده إليه فليتصدق به إلى الفقراء أو إلى مصالح المسلمين. ومن بيده هذا المال الحرام يجوز له أن ينفق على نفسه وأهله وعياله من ماله الحرام بقدر كفايتهم إن كان فقيرا محتاجا ولا يجد غيره من ماله الحلال. الكلمات الرئيسية: أحكام - المال الحرام؛ ضوابط؛ الشافعية؛ انتفاع المال الحرام

Abstract

Implementing a lifestyle in accordance with Shari’ah has a close correlation with the formation of a noble character and positive mindset in humans to avoid all forms of ugliness and deviation. The concept of the Islamic lifestyle also supports the preservation of human life, protects future generations, and maintains the integrity of humanity. This research uses qualitative methods with case studies to research natural object conditions, where the researcher is the key instrument, and is carried out through interviews and observations. The research informants were community groups with deviant sexual orientation in Bandung and medical experts in the world of psychology. The results showed a correlation between lifestyles that have an impact on sexual deviance, namely, the widespread spread of sexual deviance: LGBT, especially gays in Bandung since 2016, as a result of the consumption of haram food and drinks, as well as dressing and behaving in ways that violate the guidance of Islamic law. This study aimed to analyze the correlation between lifestyle and the phenomenon of sexual deviance: LGBT in Bandung, as well as the Islamic view of the correlation between the two.
