Abstract

Tujuan penelitian menganalisis efektivitas penerapan sanksi pidana terhadap pelanggaran atas ketentuan kepesertaan program jaminan sosial ketenagakerjaan berdasarkan peraturan perundang-undangan di kabupaten soppeng. Penelitian ini menggunakan data primer dan data sekunder. Data primer diperoleh langsung dari 30 responden pekerja. Sedangkan data sekunder dari studi pustaka. Data dianalisis secara kualitatif dan disajikan secara deskriptif. Hasil penelitian menunjukan bahwa: (1) penerapan sanksi pidana terhadap pelanggaran atas ketentuan kepesertaan program jaminan sosial ketenagakerjaan berdasarkan peraturan perundang-undangan di kabupaten soppeng belum efektif sehingga menyebabkan 64,48% pekerja belum mendapatkan perlindungan program jaminan sosial ketenagakerjaan. (2) faktor-faktor yang mempengaruhi efektivitas penerapan sanksi pidana terhadap pelanggaran atas ketentuan kepesertaan program jaminan sosial ketenagakerjaan berdasarkan peraturan perundang-undangan di kabupaten soppeng adalah budaya hukum, dan struktur hukum. The research objective is to analyze the effectiveness of the application of criminal sanctions against violations of the provisions for participation in the employee social security program based on the laws and regulations in the Soppeng Regency. This study uses primary data and secondary data. Primary data were obtained directly from 30 worker respondents. While secondary data from the literature study. Data were analyzed qualitatively and presented descriptively. The results of the study show that: (1) the application of criminal sanctions for violations of the provisions for participation in the employee social security program based on the laws and regulations in Soppeng Regency has not been effective, causing 64.48% of workers to have not received the protection of the employment social security program. (2) the factors that influence the effectiveness of the application of criminal sanctions against violations of the provisions for participation in the employee social security program based on the laws and regulations in Soppeng Regency are legal culture and legal structure.
