Abstract

The need for housing is increasing rapidly, especially in urban communities due to the large population. This is put to good use by developers who are entrepreneurs in the housing sector, to take maximum advantage. Even though consumer rights have been clearly regulated in the UUPK and of course, consumers and business actors will rely on these transactions based on sale and purchase agreements that occur between consumers/buyers and business actors (developers/housing developers) and one of the elements contained in the agreement is good faith. The type of research used in this study is normative legal research or also known as research for the purposes of legal practice. For ordinary people, the type of house sale and purchase agreement can be complicated and intimidating. Even though they contain very important things that you as a homeowner should know.

Abstract

This study aims to evaluate and analyze the legal repercussions of the waqf pledge deed executed prior to the official waqf pledge deed (PPAIW), as well as the legal protection of waqf beneficiaries (nadzir) on the requests of the heirs of the waqf donor (wakif). The research offered is normative legal research. This research utilizes the standard legal process as its methodology. This study adopts a qualitative methodology for data analysis. These are the results of this research: (1) The Waqf Pledge Deed is legal under Islamic law and domestic law (Positive law). In accordance with Islamic law, waqf must meet the pillars and requirements of waqf, which include the existence of waqif, nadzir, waqf property, the intention of using the object as waqf, and waqf pledge from wakif to nadzir. Waqf must meet the following requirements to be valid under national law (positive law): existence of wakif, nadzir, waqf property, waqf pledge, and naming of waqf items. Consequently, the Waqf Pledge Deed is legal under both Islamic law and American law. (2) The execution of the Waqf Pledge Deed, which is followed by the registration of waqf land for the purpose of issuing a waqf land certificate, affords Nadzir legal protection and legal certainty in the administration of waqf land. The existence of a Waqf Pledge Deed performed in accordance with its conditions, followed by the registration of waqf land at the local Land Office for the issuance of a Waqf Land Certificate, offers Nadzir, who receives and manages waqf land, legal protection and legal guarantee.

Abstract

Today's globalized society is emerging due to advances in information and transportation technology related to complex public affairs, including the issue of online land registration at PPAT offices, an area that is emerging in parallel with the modernization process in all countries. As social and environmental changes affect the development of land management, including the government's intention to serve the community, the traditionally manual field of land management has shifted to a technology-based administrative bureaucracy. In this study, the authors used qualitative research methods and normative research types. As for the results of this study, online service applications in land registries still cannot effectively support PPAT in the execution of specific tasks related to transfer of land rights in land registration data maintenance, as online applications do not change the process, online time and cost PPAT is easier to practice effectively and efficiently, it takes longer because there are many hurdles like repetition, NIB exam and drawing are not online, so registration documents, even if they are online, have to be checked at the state office.
