Abstract

ABSTRACT Sand mining without a permit is one of the mining business activities carried out without a people's mining permit (IPR) and a mining business permit (IUP). Many people in Kendal Regency use sand mining, both legally through permits and illegally to meet their economic needs. Law enforcement against unlicensed sand mining actors aims to determine the factors that cause sand mining activities without a permit and to find out the implementation of criminal law enforcement against unlicensed sand miners in order to enforce or function real legal norms and to find out the impact on surrounding environment. The research uses sociological juridical law research methods. Law enforcement in Kendal Regency based on Law No. 22 of 2011 concerning Mineral and Coal Mining authorizes enforcers in this case the police, prosecutors and courts with a maximum imprisonment of 3 (three) months and a maximum fine of Rp. 50,000,000.. Obstacles in law enforcement against the crime of illegal sand mining, namely geographical constraints, community economic problems, and low education problems

Abstract

The development of science and technology encourages the use of Information Technology, media and communication which has changed the behavior of society and human civilization globally and worldwide. The development of information and communication technology has also made world relations borderless and caused significant social, economic and cultural changes to take place so quickly. Information Technology today is like a coin that we can see from both sides because apart from contributing to the improvement of human welfare, progress and civilization, as well as being an effective tool for acts against the law, of course, it often brings negative impacts, this cannot be separated from both sides of the eye. the coins, but that does not mean that illegal acts will stick with technological developments. People often use computers as a tool to commit crimes, and the development of technology now that smartphones can also be used as tools and through social media applications and other applications can be used as an opportunity to commit crimes. This writing was carried out with a sociological juridical review by conducting research and supported by data, both laws and appropriate reference books. Abstract

Manusia dilahirkan dengan karakteristik, kepribadian, bakat, kemauan, dan minat yang berbeda-beda. Sebagai makhluk sosial, manusia saling membutuhkan dalam kehidupan sosial Lingkungan masyarakat adalah tempat orang mengembangkan diri dengan bekerja sama, bersosialisasi dan mencari nafkah untuk memenuhi kebutuhannya. Namun karena adanya perbedaan kepentingan dan keinginan antara satu orang dengan orang lain, seringkali timbul konflik sehingga menimbulkan konflik dalam masyarakat. Hal tersebut dapat menimbulkan lingkungan sosial yang tidak harmonis, tidak tertib, tidak damai dan tidak aman. Oleh karena itu, untuk mencegah hal-hal negatif tersebut terjadi, perlu adanya undang-undang yang mengatur hubungan dan mengembangkan sikap sadar hukum untuk menjalani kehidupan di antara orang-orang. Kesadaran hukum dapat dipahami sebagai kesadaran seseorang atau sekelompok orang tentang aturan atau hukum yang berlaku, kesadaran hukum diperlukan bagi suatu masyarakat. Hal ini dimaksudkan agar ketertiban, ketentraman, ketentraman dan keadilan dapat dicapai dengan mempersatukan manusia
