Abstract

This labor problem is quite complex especially in terms of implementing work agreements. Work agreements made between employers and workers prone to conflict, especially if there are problems with Termination of Employment, wages and conflicts of interest. The arrangement of the work agreement itself is contained in Article 56 up to Article 66 of Act Number 13 of 2003 concerning Employment but for the author the provision is still imperfect considering the format of the work agreement itself is not clearly regulated even though this provision is very important to protect workers' rights. Based on this, the author raised the contents of this study around the issue of work agreements and supervision of the implementation of work agreements, especially Unspecified Time Work Agreements and Specific Time Work Agreements. According to Article 1 number 14 of Act Number 13 of 2003 concerning Manpower ("Manpower Law"), the definition of a work agreement is an agreement between workers/laborers with employers or employers that contains the work conditions, rights and obligations of the parties. An Unspecified Time Work Agreement stipulated in Article 60 of Act Number 13 of 2003 concerning Manpower is a work agreement that can require a period of employment of no longer than 3 (three) months. In the probationary period referred to in paragraph (1), employers are prohibited from paying wages below the applicable minimum wage. Whereas legal protection in work agreements with automotive sector companies in Indonesia as stipulated in Law Number 13 of 2003 concerning Manpower aims to ensure a harmonious working relationship between workers/laborers and employers without any pressure from strong parties to weak parties.

Abstract

Pemutusan Hubungan Kerja yang terjadi di Perusahaan Ekspedisi PT. Jalur Nugraha Ekakurir/JNE Perkara Perselisihan Hubungan Industrial yang gugatannya diajukan dua Karyawan tetap yang bernama Jamaludin dan Nanda Setiawan masalah ini berawal dari barang pengiriman elektronik dan sperpat hilang karena dititipkan, penggugat menggugat ke Mahkamah Agung sebagai karyawan tetap tidak mendapatkan haknya sebagai karyawan. Namun tergugat membuat alasan penggugat juga diduga melakukan tindak pencuriankarung dan perbuatan para penggugat tersebut diberikan sanksi Pemutusan hubungan kerja dengan alasan mendesak sesuai dengan Pasal 36 Peraturan Perusahaan. Pasal 170 Undang-undang No.13 tahun 2003 tentang Ketenagakerjaan menegaskan Pemutusan hubungan kerja yang dilakukan tidak memenuhi ketentuan Pasal 151 ayat (3) dan Pasal 168, kecuali Pasal 158 ayat (1), Pasal 160 ayat (3), Pasal 162, dan Pasal 169 batal demi hukum dan pengusaha wajib mempekerjakan pekerja/buruh yang bersangkutan serta membayar seluruh upah dan hak yang seharusnya diterima. Menyatakan Pembentukan UU Nomor 11 Tahun 2021 tentang Cipta Kerja tidak mempunyai ketentuan hukum yang mengikat secara bersyarat sepanjang tidak dimaknai tidak dilakukan perbaikan dalam waktu 2 tahun sejak putusan ini diucapkan. Penelitian ini menggunakan pendekatan yuridis normative dan yuridis empiris. Pengumpulan data dilakukan dengan studi pustaka dan studi lapangan. Analisis data dilakukan secara kualitatif. Dalam penulisan akan membahas dari sudut pandang Hukum Tenaga Kerja dan Undang-Undang Cipta Kerja.

Abstract

Legal protection for song copyrights is needed in order to create a better climate and atmosphere for the growth and development of music in Indonesia. The problem is how is the form of legal protection for song copyright holders for unlawful acts committed by corporations? What are the considerations of legal reasons and legal philosophical considerations by the Panel of Judges regarding Tort Towards Song Copyright by Corporations in the Court Ruling of the Central Jakarta District Court Number 19/Pdt.Sus-HakCipta/2020/PN.Niaga.Jkt.Pst. and Court Ruling of the Surabaya District Court Number 4/Pdt.Sus-HKI/HakCipta/2020/PN.Niaga.Sby.? Normative juridical research methods. In conclusion, legal protection for Tort toward song copyright by corporations. If there is a song copyright dispute, the settlement can be carried out through alternative dispute resolution, arbitration, a court where the court is a commercial court. The decision on the lawsuit must be pronounced no later than 90 (ninety) days after the lawsuit is registered. Therefore, the task of the judge to try cannot be separated from legal discovery activities. In the court decision verdict number 4/Pdt.Sus-HKI/HakCipta/2020/PN.Niaga.Sby. November 12, 2020, which rejected the Plaintiff's lawsuit in its entirety, is inappropriate because the Panel of Judges should carry out legal discovery activities by looking at Government Regulation Number 20 of 2017 Concerning Import or Export Control of Goods Allegedly Consisting of or Originating from Intellectual Property Rights Violations.

Abstract

This study aims to determine the validity of the Decree of the Board of Directors of PLN Number 1486.K/Dir/2011, dated December 27, 2011, concerning the Ordering of Electricity Usage (P2TL), both according to positive law and based on the dogmatics of legal science. Normative legal research focuses on solving legal problems through unique mechanisms, examining the law as a system of rules. This research does not conduct field research and is understood as a science of rules, focusing on dogmatics and legal systems. Existing research data is collected through literature studies, including literature materials in the form of primary materials or sources. The result of the case between Pioneer Chemical and PT PLN (Persero) Distribution of Greater Jakarta and Tangerang Area Cengkareng revolves around the Decree of the Board of Directors of PT PLN (Persero) No. 1486.K/Dir/2011, which states that the calculation of supplementary bills and the proposal for P2TL settlement are based on administrative and/or laboratory examinations. The Panel of Judges decided that the calculation of supplementary bills did not need to be guided by laboratory results, and the Defendant had the authority to conduct P2TL as outlined in the Decree. The decree met the criteria of legitimacy, interpretation, sanction, and jurisdiction in the legal system approach. Pioneer Chemical, as the plaintiff, was unable to submit evidence of unlawful acts committed by PT PLN (Persero) Distribution of Greater Jakarta and Tangerang Area Cengkareng.
