Abstract

Abstract: In recent years, various acts of violence in the form of intolerance have turned out to be massive social phenomena under the pretext of being an excuse to legitimize acts of violence committed. In fact, from a national point of view, Indonesia has stipulated freedom of religion as stated in the Constitution, namely Article 28 of the 1945 Constitution. Apart from that, also in Banjarmasin City Regional Regulation No. 4 of 2005 is one of the sharia-based regional regulations. However, over time, this regional regulation experienced many violations in terms of violating its rules and discriminatory attitudes towards non-Muslim groups regarding freedom of religion and people's welfare. This study's normative juridical research method is a legal, conceptual, and case approach. The study results show that the regional regulation is contrary to the constitution because of the flawed material content coupled with cases that lead to discriminatory attitudes and intolerance when non-halal food stalls are also the target of raids during Ramadan. The existence of Al-Qur'an verses that discuss the concept of religious moderation can be a means of answering this problem. Keywords: Intolerance, Local Regulations, Religious Moderation Abstract: Beberapa tahun terakhir, berbagai tindakan kekerasan berupa intoleransi menjadi fenomena sosial masif dengan dalih menjadi alasan untuk melegitimasi tindakan kekerasan yang dilakukan. Padahal, jika dilihat dari sisi negara, Indonesia telah menetapkan kebebasan beragama sebagaimana tertuang di dalam UUD, yaitu Pasal 28 UUD 1945. Selain itu, juga di dalam Perda Kota Banjarmasin No. 4 Tahun 2005 merupakan salah satu Perda berbasis syariah. Namun, seiring berjalannya waktu, Perda ini justru mengalami banyak pelanggaran dalam hal melanggar aturan sendiri dan sikap diskriminatif terhadap kelompok nonmuslim dalam hal kebebasan beragama dan kesejahteraan rakyat. Metode penelitian yuridis normatif yang digunakan dalam penelitian ini adalah pendekatan hukum, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa Perda tersebut dianggap bertentangan dengan konstitusi karena kandungan materi yang cacat ditambah kasus-kasus yang menyebabkan sikap diskriminatif dan intoleransi ketika warung makanan nonhalal juga menjadi sasaran razia selama Ramadan. Adanya ayat Al-Qur'an yang membahas konsep moderasi agama dapat menjadi sarana dalam menjawab permasalahan ini. Keywords: Intoleransi, Moderasi Beragama, Peraturan Daerah

Abstract

This research is motivated by the birth of Law No. 3 of 2006 on the amendment of Law No. 7 of 1989 on religious courts that have added authority to the religious courts in the field of sharia economics. Researchers want to know what are the ways to resolve economic disputes Sharia default in non-litigation both regulated punishable poitif, Islamic law and customary law. This research is a type of literature study or in the world of law is called juridical-normative legal research. This study shows that alternative dispute resolution with non-litigation model has several types and parts, including positive law such as Alternative Dispute Resolution, arbitration, and settlement of Sharia economic disputes through consumer institutions. Among them is the religion of peace and Justice.

Abstract

The background of economic development in Indonesia includes sectors related to business activities carried out by business people who will always hold back the flow of developing consumptive needs by requiring guarantees to fulfiil the credit facilities provided. This paper discusses the problem in the form of collateral execution if the debtor defaults, both by law and Islamic law. This study used the library research method and used a normative appoarch with a juridical approach. Based on the results of this paper, it can be concluded that the implementation of the execution of fiduciary guarantees based on the fiduciary guarantees act, has a new perspective in its implementation and has similarities with rahn according to Islamic law which can be combined with rahn tasjily in material guarantees

Abstract

The Sharia economy grows in line with the demands of the Muslim community, which wants an economy that competes with the capitalist economy. Of course this struggle is not as easy as turning your palms. Political, sociological, huokum struggles also colored the emergence of regulations that banks Shariah in Indonesia. With the system of non-Islamic states, it must be difficult for the sharia banking to conduct transactions in accordance with the law of fiction that is written in the Islamic books. The product of the sharial banking that is "forced" to resemble the conventional banking product must have an influence on the concept of the theory of akad in the classical fiction. This DSN-MUI fatwa will become a positive law when adopted in regulations approved by law, as adopted as a judge's opinion in its decision, or adopted by the Bank of Indonesia Regulations, OJK Regulations and others. The DSN-MUI Fatwa plays a major role in the development of the Shariah economy

Abstract

In the management of zakat, it is very necessary to have a clear legal umbrella in the form of regulations on zakat which are the basis for zakat management. Along with the times, the existing regulations are sometimes considered no longer accommodate the problem of zakat management in the field. Therefore, the latest regulations on zakat management are needed. This paper aims to try to discuss various legal reforms regarding zakat, especially in the zakat law. This study uses a juridical-normative approach, which is an approach based on legislation, theories, and concepts related to the legal scope of regulations in the field of zakat. The results of the study show that there are various regulations regarding zakat, ranging from Ministerial Regulations, Presidential Regulations, Government Regulations to Laws. And the new law on zakat management was born when the age of independence of the Unitary State of the Republic of Indonesia was quite old, namely 54 years. This is marked by the birth of Law no. 38 of 1999 concerning Management of Zakat. In its development, Law Number 38 of 1999 was revised to achieve optimization of zakat management in Indonesia. The result of the revision was the establishment of Law Number 23 of 2011 concerning Zakat Management. This was followed by the issuance of Government Regulation of the Republic of Indonesia Number 14 of 2014 concerning the Implementation of Law Number 23 of 2011 concerning Management of Zakat. Dalam pengelolaan zakat sangat diperlukan adanya suatu payung hukum yang jelas berupa peraturan tentang zakat yang menjadi landasan dalam pengelolaan zakat. Seiring dengan perkembangan zaman, peraturan yang ada terkadang dianggap tidak lagi mengakomodir persoalan pengelolaan zakat di lapangan, Oleh karena itu dibutuhkan peraturan-peraturan terbaru tentang pengelolaan zakat. Tulisan ini bertujuan untuk mencoba membahas mengenai berbagai pembaruan hukum mengenai zakat khususnya dalam undang-undang zakat. Penelitian ini menggunakan pendekatan yuridis-normatif, yaitu pendekatan yang didasarkan pada peraturan perundang-undangan, teori-teori, dan konsep-konsep berhubungan dengan cakupan hukum mengenai regulasi-regulasi pada bidang zakat. Hasil penelitian menunjukkan bahwa terdapat berbagai peraturan tentang zakat, mulai dari Peraturan Menteri, Peraturan Presiden, Peraturan Pemerintah hingga Undang-undang. Dan Undang-undang tentang pengelolaan zakat baru lahir di saat usia kemerdekaan Negara Kesatuan Republik Indonesia tergolong cukup tua yaitu 54 tahun. Hal tersebut ditandai dengan lahirnya Undang-Undang No. 38 Tahun 1999 tentang Pengelolaan Zakat. Pada perkembangannya Undang-undang Nomor 38 Tahun 1999 direvisi untuk mencapai optimalisasi pengelolaan zakat di Indonesia. Hasil dari revisi tersebut adalah dengan dibentuknya Undang-undang Nomor 23 Tahun 2011 Tentang Pengelolaan Zakat. Disusul dengan terbitnya Peraturan Pemerintah Republik Indonesia Nomor 14 Tahun 2014 tentang Pelaksanaan Undang undang Nomor 23 Tahun 2011 tentang Pengelolaan Zakat.
