Abstract

Abstract: The Concept of  the government has given a serious dialogue among Muslim thinkers and caused a variety of perceptions and not only in the theoretical, conceptual, but also entered the area of practical politics that they often bring discord and disunity among Muslims. In Islamic political thought, talking state and government by Islamic political theorists lead to two goals. First, to find the ideals of Islam on the country or establishing government (emphasizing the theoretical and formal aspects) is by trying answering the question "what kind of country is according to Islam?”. Second, to do the idealization of the Islamic perspective on the process of implementation of state or government (emphasizing practical aspects and substantial) is by trying answering the question "how are the contents of the state according to Islamic paradigm? If the first approach is based on the assumption, it means that Islam has a particular concept of state and government. The second approach is based on the assumption, it means that Islam does not carry a particular concept of the shape of a country or a government but only carry the basic principles in the form of ethical and moral values. The above explanation encourages scholars to continue to assess the Islamic political system that can regulate peoples lives and the state in accordance with the principles contains in the teachings of the quran -justice, consultation, equation – tradition (Sunnah), consensus and analogy. Because by nature, a man is a zoon politicon.Keywords: kekuasaan, politik Islam, Abstrak: Peraturan pemerintah telah memberikan dialog serius antara Cendikia Muslim dan menyebabkan berbagai persepsi dan tidak hanya di teoritis, konseptual, tetapi juga memasuki wilayah politik praktis yang sering membawa perselisihan dan perpecahan di kalangan umat Islam. Dalam pemikiran politik Islam, berbicara negara dan pemerintahan oleh ahli teori politik Islam menyebabkan dua Tujuan. Pertama, untuk menemukan cita-cita Islam pada negara atau mendirikan pemerintah (menekankan aspek teoritis dan formal) adalah dengan mencoba menjawab pertanyaan "apa negara ini menurut Islam?". Kedua, untuk melakukan idealisasi dari perspektif Islam pada proses pelaksanaan negara atau pemerintah (menekankan aspek praktis dan substansial) adalah dengan mencoba menjawab pertanyaan "bagaimana isi negara menurut paradigma Islam? Jika pendekatan pertama didasarkan pada asumsi, itu berarti bahwa Islam memiliki konsep tertentu negara dan pemerintahan. Pendekatan kedua didasarkan pada asumsi, itu berarti bahwa Islam tidak membawa konsep tertentu dari bentuk sebuah negara atau pemerintahan, tetapi hanya membawa prinsip-prinsip dasar dalam bentuk nilai-nilai etika dan moral. Penjelasan di atas mendorong para sarjana untuk terus mengkaji sistem politik Islam yang bisa mengatur kehidupan masyarakat dan negara sesuai dengan prinsip-prinsip mengandung dalam ajaran Alquran -justice, konsultasi, persamaan - tradisi (Sunnah), konsensus dan analogi. Abstract

AbstractModernism in Western society presupposes mind, flow, movement and efforts to revamp understanding, customs, and so long institutions to suit the new environment brought by advances in science and modern technology. This idea emerges in the Western with the aim of adjusting the teachings found in Catholicism and Protestantism with modern science. The flow of ideas and eventually lead to the emergence of secularism in Western societies. Islamic modernists are as people who commit a conscious effort to formulate the values and principles of Islam (Islamic values) in accordance with modern thinking or integrate the ideas and institutions into modern Islam. It is regarded as an attempt to make Islam flexible and people can play a role in the current flowing modernity tightly. This effort is to create latitude for Muslims and can get out of a claim, stagnant, not grounded and conservative.Meanwhile, Islamic traditionalism, sometimes called traditional Islam, is covering a broad sense. Traditional Islam is believed to be authentic. It contains the sanctity of tradition, eternity, truth is certain; perennial wisdom, and also the application of sustainable principles of eternal on diverse conditions of space and time. A traditionalist can be defined as a person who has committed the sharia is the source of all religious teachings and morality. Rashid Rida (1865-1935) is known as a traditionalist thinkers because of his ideas and his desire to establish a caliphate institutions. It lived during the Islamic world is facing the rise of Western imperialism and colonialism while traditional Islamic political order is disintegrating. After the defeat of the Ottoman dynasty in World War I and the advent of Kemalism in Turkey, the Turkish Grand National Assembly decided in 1924 to dissolve the caliphate. Ide ini muncul di Barat dengan tujuan menyesuaikan ajaran ditemukan di Katolik dan Protestan dengan ilmu pengetahuan modern. Aliran ide dan akhirnya menyebabkan munculnya sekularisme dalam masyarakat Barat.Modernis Islam adalah sebagai orang yang melakukan upaya sadar untuk merumuskan nilai-nilai dan prinsip-prinsip Islam (nilai-nilai Islam) sesuai dengan pemikiran modern atau mengintegrasikan ide-ide dan institusi dalam Islam modern. Hal ini dianggap sebagai upaya untuk membuat Islam fleksibel dan orang dapat berperan dalam arus yang mengalir modernitas erat. Upaya ini adalah untuk menciptakan lintang bagi umat Islam dan bisa keluar dari klaim, stagnan, tidak beralasan dan konservatif.Sementara itu, tradisionalisme Islam, kadang-kadang disebut Islam tradisional, meliputi arti luas. Islam tradisional diyakini otentik. Ini berisi kesucian tradisi, keabadian, kebenaran yang pasti; kebijaksanaan abadi, dan juga penerapan prinsip-prinsip berkelanjutan abadi pada kondisi yang beragam ruang dan waktu. Sebuah tradisionalis dapat didefinisikan sebagai orang yang telah melakukan syariah adalah sumber dari semua ajaran agama dan moralitas.Rasyid Ridha (1865-1935) dikenal sebagai pemikir tradisionalis karena ide-idenya dan keinginannya untuk mendirikan sebuah lembaga kekhalifahan. Ini hidup pada dunia Islam menghadapi munculnya imperialisme Barat dan kolonialisme sementara pesanan politik Islam tradisional hancur. Setelah kekalahan dari dinasti Ottoman dalam Perang Dunia I dan munculnya Kemalisme di Turki, Turki Grand Majelis Nasional memutuskan pada tahun 1924 untuk membubarkan kekhalifahan. Abstract

The first period of this faculty  (FASIH) leaded by Dr. H. Sumper Mulia Harahap, M.Ag. with 6 departments (4 the new depertements);  Ahwal Syakhsiyah, Hukum Ekonomi Syari’ah, Hukum Tata Negara (Siyasah), Perbandingan Mazhab, Ilmu Al-Qur’an dan Tafsir, serta Zakat dan Wakaf. This faculty wants to be a top faculty in the regional of Sumatera in the year of 2025 and also to gain the wants of many people to the improvement of this institute become university. Based on the available and the relevance of the efforst to develop the syari’ah field and knowlwedge of laws (syari’ah) in the region of South Tapanuli, the departments in the Fasil faculty will concentrate to both fields. This is because of two reasons; first, the presence of this faculty is the natural development to the field of laws nad the second, one serious problem is less people understand and interest in this field in the integrative and interconnective ways. This weakness can be solved by presenting of Fasih faculty in State Institute for Islamic Studies Paangsidimpuan. To this reason, this research tried to answer the general views of syari’ah knowledge and laws in South Tapanuli, and also in order to picture the hopefulness and perception of the societies to the Fasih faculty generally and specifically. This research has been done through qualitative research in the social studies and the specification about the chance and prosperity can be given as the contribution to the development of Syariah and Laws Faculty (Fasih). This research used the techniques suggested by Lexy J. Moleong by applying the theory from Bogdam, Wirk and Miller and also Lofland and Lofland. The data analyzed simultanously from collecting the data.The result of this research was that the basic problems of this field were management, lecturers or human resources, and the facilities. The management problems were the management of the institute which is done traditionally; whether it was to the private institution or even in the state institution. This made the educational institution didnot do optimally. Further, in this region there are many Islamic private schools which did not have good management in making programs about learning process. To the problems of teaching human sources (lecturers), there are still many of them still need to improve their competence to be a proffesional ones. From the perception of the societies to the Fasih, it can be concluded that in general many societies support the good planning can be implemented, and this faculty must be a top faculty to give the response to many problems of laws in the region of South Tapanuli.

Abstract

Ritual is an expression of the religious ceremony system that reflect the relationship between human and spiritual nature. For user or participants, the ritual has an important social function, namely to integrate individuals in the community and to become instruments tend to channel negative energy. In the context of Islam, elements in Panaek Bungkulan scent mystical and superstitious deem incompatible with Sharia rules need to be eliminated, but for the elements of the other during the ritual can still be communicated and do not damage the faith of course still be done. Penetration of religion in the perspective of Panaek Bungkulan does not necessarily all eliminate the ritual practices of Angkola Batak Padangsidimpuan society. Although people accept Islam as a faith, in addition to receiving the teachings of Islam as a faith, in addition to receiving the teachings of modern into building a house, they still do not lose local traditions as custom value in the middle of modern globalisation era. The relationship between Islam and local traditions has formed a new habitat called local Islamic traditions. Dialectic between Islam and culture puts religious and local ritual as a field of contestation; it is such as panaek bungkulan tradition. Abstract

This study examines Islamic concepts of 'Iddah (waiting period for a divorced wife) and how the Feminists view it. The aim is to comprehend the different perspectives and try to put the problem in the right position. This research is purely library research using a socio-philosophical approach. Data were obtained from literature, books, and available documents. Based on the results of the study, it can be concluded that in Islamic teachings 'iddah is intended to determine the status of the womb, whether pregnant or not, to avoid mixing the lineage of the expecting baby. This is different from the view of the feminists who think that the provision regarding 'iddah is a product of a patriarchal culture that marginalizes women as it only applies to women, and not to men. This feminist view is based on the spirit of equality before the law which demands equal rights and obligations. The view, however, needs to be reviewed as the provision of 'iddah does not necessarily mean ignoring the principle of equality between men and women. Men and women by nature are created with different physical and emotional characters according to their respective roles. Even if such a view is applied, new problems will arise and damage the order of human culture universally

Abstract

Penelitian ini membuktikan agama dan budaya lokal Batak Angkola bersinergi dalam kehidupan masyarakat muslim Padangsidimpuan. Hubungan kompromistis antara agama dan budaya menjadikan tradisi sebagai sarana pengembangan agama, sehingga banyak ajaran Islam ditemukan dalam tradisi Batak Angkola. Keterbukaan Agama dan budaya menciptakan pola integrasi yang bersifat harmonis dan dinamis. Integrasi hukum Islam terhadap budaya menyatu dalam kehidupan masyarakat Padangsidimpuan sesuai dengan falsafah “hombar adat dohot ibadat”. Falsafah ini sebagai bukti bahwa tradisi lokal Batak Angkola mengandung prinsif keislaman, seperti tradisi martolong. Pola integrasi Islam dengan budaya Batak Angkola merupakan konsekwensi dari metode akulturasi yang pada dasarnya lebih bersifat simbolik. Ada pun pola pemahaman terbatas pada akidah, akhlak, hukum dan ibadah yakni; fikih dan tarekat. Sumber utama penelitian ini adalah data dari tindakan masyarakat yang merupakan manifestasi agama dan budaya, kemudian ditambah dengan pendekatan antropologi.

Abstract

According to the theory of effectiveness, the findings found by researchers have not reached the benchmark for the effectiveness of protected forests as confirmed in Law 41 of 1999 Article 47 on Forest Protection. The problem that occurs is the problem that is the main supporter of achieving the effectiveness of forest protection. The effectiveness of law no. 41 of 1999 Article 47 concerning benchmarks for effectiveness in the supervision of protected forests in order to maintain their sustainability. where there are problems faced by the agency responsible for the preservation of protected forests. factors inhibiting the effectiveness of law no. 41 of 1999 concerning Forest Protection is a budget cut since COVID-19 which hinders Forest Protection, then lack of public awareness of forest preservation, and lack of legal firmness from law enforcement officers. Abstract

This study discusses the implementation of Law No. 22 of 2009 article 115 concerning the prohibition of racing with other motorized vehicles in the city of Padangsidimpuan. This research is motivated by the number of teenagers who are racing with motorcycles, especially on Jl. Gen. Besar A Haris Nasution in the city of Padangsidimpuan causing problems of security, order and public comfort on Jl. Gen. Besar A Haris Nasution This research is a field research using qualitative descriptive analysis method. Wild racing has become a teenager’s habit that is hard to leave. The data collection method in this study was by interview and documentation in accordance with the provisions contained in Government Regulation Number 22 of 2009 article 115 concerning the prohibition of racing with other motorized vehicles. Abstract

The background of this research problem is article 48 of law number 22 of 2009 concerning road traffic and transportation, there are rules regarding technical requirements and roadworthiness of motorized vehicles, but vehicles provided by rickshaw drivers produce noisy sounds and turn signals or indicator lights. direction so that it can interfere with other motorists, so that this is contrary to law number 22 of 2009 article 48 concerning road traffic and transportation.The formulation of the problem of this research is how to implement Law No. 22 of 2009 article 48 concerning roadworthiness tests for public vehicles (pedicabs) in Padangsidimpuan City and what factors are the obstacles in implementing Law No. 22 of 2009 article 48 regarding vehicle road feasibility tests. public rickshaws in the city of Padangsidimpuan.The purpose of this research is to find out the implementation of Law No. 22 of 2009 Article 48 regarding the roadworthiness test of public vehicles (becak) in Padangsidimpuan City, and also to find out what factors are obstacles in the implementation of Law No. 22 of 2009 Article 48 concerning road feasibility test for public vehicles (becak) in Padangsidimpuan City.This type of research is qualitative research. Qualitative research is a research procedure that produces descriptive data in the form of written or spoken words and highly observed behavior, while the approach used by the researcher is a sociological approach or socio-legal research method, namely "a research approach that examines people's legal perceptions and behavior. (humans and legal entities) that occur in the field.The results obtained from this researcher are that the implementation of law number 22 of 2009 article 48 concerning the feasibility test of public vehicles (pedicabs) in the city of Padangsidimpuan has not run effectively this can be seen from the increasing number of pedicab drivers, and even the Department of Transportation as The implementer of the law admits that he has never implemented the law or has never tested the feasibility of a motorized tricycle.

Abstract

The problems in this study are How to Use Drugs in Husband and Wife Sexual Relationships in Padangsidimpuan City and How to Review Islamic Law Regarding the Use of these Drugs. The purpose of this study was to determine the use and review of Islamic law on the use of drugs in sexual relations between husband and wife. This type of research is field research. The data sources of this research are primary and secondary legal data. Data collection techniques are observation, interview and documentation. Data processing and analysis techniques are collecting data and conducting data analysis processing, which is processed and analyzed. The results of this study indicate that the use of drugs in the fulfillment of sexual relations between married couples in the city of Padangsidimpuan is one of the efforts of a couple that provides benefits with the aim of maintaining household harmony and to avoid harm, namely quarrels that lead to divorce. The results of this study indicate that the use of drugs in the fulfillment of sexual relations between married couples in the city of Padangsidimpuan is one of the efforts of a couple that provides benefits with the aim of maintaining household harmony and to avoid harm, namely quarrels that lead to divorce. In the Maslahah Mursalah theory, the use of this drug falls into the category of maṣlaḥah hajiyat which is not directly related to the fulfillment of basic human needs, but indirectly aims to alleviate and facilitate the fulfillment of basic human needs, including preserving religion, soul, reason, descent, and property. However, if the use of this drug is excessive and does not pay attention to medical regulations, it will have an impact on the health of the user. In other words, this drug cannot bring benefits but can also cause harm.
