Abstract

This research is aimed at answering a big question on the dynamic of Islamic legal studies in Islamic boarding school (pesantren) through focusing on the study of fiqh in Mahad Aly. The research questions were formulated into two points. First, how far the liberal elements has coloured the Islamic legal studies in Mahad Aly. Second, why the liberal ideas emerge inpesantren milieu that is well-known as an orthodoxy defender in Islamic law and has strong commitment to the doctrine of salaf as-??li?.The collection of data in this research was conducted through the studies on the written documents, observation, interviews, and simple questionnaire for check and recheck purpose. The analysis basically was undertaken by descriptive technique in qualitative method. The findings of the research showed that the Islamic legal studies in Mahad Aly Situbondo is strongly nuanced by liberal elements either in the level of epistemology of the study that they developed or in the level of praxis of the studies. There are some reasons why the study on Islamic Law at the Mahad Alyis very strongly coloured with liberal elements, i.e.: 1) the turning stream of intellectual urbanisation-dissemination emerged within the Mahad Aly; 2) The dissatisfaction among the community of Mahad Aly on the epistemology of fiqh of NU; 3) inspiration brought about by the figure of liberalism thinkers both classic and modern, local and global; 4) the existence of historical reference on liberal ideas of NU; 5) the factor of open mindedness of teachers (pengasuh); and 6) the factor of networking of Mahad Aly with NGOs, study centers, and other liberal epistemic community.

Abstract

The purpose of this research is how to implement the Balanced Scorecard (BSC) at UIN Walisongo in an effort towards world class university (WCU). The research design is policy research using explorative descriptive analysis techniques. The results show that in perspective (1) changes in research organizations: international collaborative research and international publications need to be improved, (2) human resource policies, increasing the number of professors and doctors and staff education, based on educational qualifications are still limited (3) academic programs, international accredited study programs need to be started, (4) Internal Governance, as an anti-corruption campus that applies the best Integrity zone in PTKI and (5) Funds, develops and explores funding sources from domestic and foreign partners to strengthen the internationalization program towards WCU.Tujuan penelitian adalah bagaimana implementasi BSC pada UIN Walisongo dalam upaya menuju  world class university (WCU). Desain penelitian adalah penelitian kebijakan dengan menggunakan teknik analisis deskriptif eksploratif. Hasil penelitian menunjukkan bahwa dalam perspektif (1) perubahan organisasi: penelitian,  masih terbatasnya  penelitian kolaboratif internasional dan publikasi internasional, (2) kebijakan sumber daya manusia, meningkatkan jumlah profesor dan doktor dan pendidikan staf, berdasarkan kualifikasi pendidikan masih terbatas (3) program akademik, program studi terakreditasi internasional perlu dimulai, (4) Tata Kelola Internal, sebagai kampus anti-korupsi yang menerapkan zona Integritas terbaik di PTKI dan (5) Dana, mengembangkan dan mengeksplorasi sumber pendanaan dari mitra domestik dan asing untuk memperkuat program internasionalisasi menuju WCU.

Abstract

This paper describes fiqh mu’āmalah content in Friday sermons at the Great Mosque of Kauman Semarang to understand the dialectics between the mosque as a ritual space and the market as an economic space. This paper's data are in the form of 51 sermons delivered in 2015 from January 1 to December 31, 2015, and interviews with the foundation, ta’mīr, and the preachers. This paper shows that Friday sermons' characteristics at the mosque are reflected in their preachers' diversity, both in terms of educational background, scientific fields, organizational affiliations, and professions. This paper finds that fiqh mu’āmalah's content has not become the point of attention of the preachers. This finding is proven by the absence of a sermon theme on fiqh mu’āmalah (mu’āmalah madiyah). The topic that appeared in Friday's sermon was related to Islamic economics's ethical principles and business-related to mu’āmalah adabiyah. The minimal content of fiqh mu’āmalah or economic fiqh in the Friday sermon of the mosque reflects the low intensity of the mosque's dialectics as a ritual space with the market as an economic space. The Friday sermon at this mosque still does not pay more attention to the jamā’ah of Johar market seller as the essential segment.

Abstract

This study aims to analyze the influence and response of the Jakarta Islamic Index (JII) volatility to changes in macroeconomic variables. VECM was used to examine the long-and short-term effects, while IRF was used to analyze the JII response. Data were obtained from BPS, BI, and Yahoo Finance monthly from 2015-2020 using global macroeconomic fiscal variables, including inflation, BI and Exchange Rates, Industrial Production Index, World Oil Price, Malaysia Hijrah Shariah Index, and DJIM Malaysia Titan 25 Index. The results show that JII is influenced by inflation variables, BI rate, IPI, OP, MHS, and DJIM in the long term but not the exchange rate. Furthermore, it is influenced by BI rate, IPI, OP, MHS, and DJIM in the short term, while the exchange rate and inflation have no significant effect. Macroeconomic variable shock influence JII by 52,27% while the rest is influenced by other variables outside the model. This research implies that the JII index is very sensit ive to economic changes.

Abstract

The positivation of Sharia (Islamic law) is an important topic that remains interesting to raise when discussing the institutionalization of Sharia in Indonesia. This topic is also a significant theme in the discussions of Islamic law in other parts of the Islamic world. How to make Islamic law as legal rules that apply nationally is one of the primary agenda. The objective is clear, that is so that Islamic law is neither merely an ideal law found in the collective awareness in the community’s belief system nor an "archive" discussed to satisfy the needs of intellectual exercise in academic institutions. It should become the law that applies positively. The establishment of Law Number 1 of 1974 concerning Marriage, Law Number 7 of 1989 concerning Religious Courts, and Presidential Instruction Number 1 of 1991 concerning the compilation of Islamic laws became important milestones in the history of Islamic law in Indonesia. Since the beginning of the reform era, the implementation of Islamic Sharia entered a new phase, as marked by the flourishing of Sharia regional regulations in various regions. The emergence of the Sharia regional regulations is certainly through serious political struggles, given that the real law is a product of the political process. The regional regulations, at the same time, has been through a massive ideological struggle, because the plurality of religions and ideologies in Indonesia will be powerful energy for the emergence of pros and cons of the emergence of this regional regulation. This article will explain the political and ideological struggle around the Sharia regional regulation. Abstrak: Positivisasi syariah (hukum Islam) merupakan topik penting yang tetap menarik untuk diangkat, apalagi ketika membahas pelembagaan Syariah di Indonesia. Topik ini juga menjadi tema penting dalam diskusi hukum Islam di belahan dunia Islam lainnya. Khususnya tentang bagaimana menjadikan hukum Islam sebagai aturan hukum yang berlaku secara nasional. Tujuannya jelas, yaitu agar hukum Islam bukan sekadar hukum ideal yang ditemukan dalam kesadaran kolektif dalam sistem kepercayaan masyarakat, juga bukan "arsip" yang dibahas untuk memenuhi kebutuhan pelatihan intelektual di lembaga akademik. Seharusnya syariah menjadi hukum yang berlaku positif. Pembentukan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama, dan Instruksi Presiden Nomor 1 Tahun 1991 tentang Kompilasi Hukum Islam menjadi tonggak penting dalam sejarah positivisasi hukum Islam di Indonesia. Sejak awal era reformasi, penerapan syariat Islam memasuki babak baru, yang ditandai dengan maraknya perda syariat di berbagai daerah. Munculnya Perda Syariah tentunya melalui perjuangan politik yang serius, mengingat hukum yang sesungguhnya adalah produk dari proses politik. Perda tersebut pada saat yang sama telah melalui perjuangan ideologis yang masif, karena kemajemukan agama dan ideologi di Indonesia akan menjadi energi yang kuat bagi munculnya pro dan kontra dari kemunculan perda ini. Oleh karena itu, artikel ini akan menjelaskan pergulatan politik dan ideologi seputar Perda Syariah. Kata Kunci: Positivisasi Syariah, Peradilan Agama, Politik dan Ideologi, Peraturan Daerah

Abstract

Purpose – This study aims to determine muzakki's behavior which is reviewed based on the theory of planned behavior, including attitudes towards behavior, subjective norms, and perceived behavioral control.Method – This research used a qualitative research method, while the analytical approach used phenomenological analysis. This study utilized observation and interviews for collecting data. Informants were given a great space to tell their own experiences freely. The number of samples in the study was six informants, i.e., two people who work as civil servants, two people as entrepreneurs, and two people as farmers.Result – Based on the phenomenon and its meaning regarding the behavior of muzakki in paying zakat, it can be concluded that 1) The attitude of the informants tends to comply with the obligation to issue zakat as a form of religious, social, economic, and psychological obedience 2) Informants have subjective beliefs regarding the behavior of paying zakat which is formed from normative beliefs, namely references that come from external and internal parties. 3) Perceptions of behavioral control of the informants. Implication – This study can assist people and organizations in understanding the behavioral aspect of muzakki.Originality – The originality of this research lies in the object under study, test analysis, and research location.
