Abstract

This book is written by Professor Graham Greenleaf, an expert in the field of privacy law from Faculty of Law, University of New South Wales, Sydney, Australia. This book compiles his research and advocacy in Asias privacy development since 1970, as well as his writings on Asian Privacy Development in Privacy Laws & Business International Report. This book is the result of his long collaboration with many privacy law experts from many States in Asia and has been published in numerous books and journals. The book is written because the author believes that privacy in its many forms is worth protecting as one of the rights protected under human rights laws. The author also believes that personal data has a high economic value, which leads to the book also examining the business aspects of the data privacy laws and the extent to which corporations take part in data privacy protection. DOI: https://doi.org/10.22304/pjih.v2n2.a11

Abstract

Within the last five years it is noted that the people of Indonesia has become more aware of their privacy on personal data since their personal data is being collected, distributed and disseminated without their prior consent both  by the government  and businesses and their co-ventures . These businesses tend to commit violations by using and disseminating customers’ data without the consent of their respective customers. This article focuses on Indonesian legal framework on the Privacy on personal data. It is argued that although there is existing laws in the privacy on personal data, however, those legal framework still developed in very sectoral nature. It is submitted that the most suitable regulatory concept for Indonesia is a combination regulatory concept, or hybrid concept., which protect Indonesian’s and foreigner parties’ interests privacy on personal data.  To investigate existing laws in personal data protection, this research examines both national as well as international and regional legal framework in personal data protection. Comparison between Indonesia and the practice of other ASEAN states is also conducted to determine the most suitable approaches in addressing the protection of personal data.

Abstract

ABSTRAKVirus COVID-19 sedang menjadi perhatian utama dunia hingga saat ini. Terkait pencegahan penyebarannya, Pemerintah Indonesia melakukan beberapa upaya, salah satunya dengan menerapkan digital contact tracing menggunakan aplikasi pelacakan. Pada pelaksanaannya, aplikasi pelacakan (contact tracing) mengumpulkan data pribadi seseorang (seperti nama lengkap, NIK, nomor telepon pribadi dan e-mail pribadi), yang sangat berpotensi akan terjadinya pelanggaran data pribadi. Selain menggunakan aplikasi pelacakan, metode digital contact tracing juga kerap dilakukan oleh pihak swasta dengan penginputan data pengunjung pada public places. Melalui tulisan dengan metode yuridis normatif ini, penulis akan membahas ketentuan hukum perihal data pribadi yang akan dihubungkan dengan penerapan digital contact tracing. Penulis juga akan melakukan kajian serupa pada negara Singapura, sebagai negara pertama yang menerapkan digital contact tracing melalui aplikasi pelacakan dan sebagai negara tetangga Indonesia.  Penulisan ini terlebih dahulu akan melihat apakah penerapan digital contact tracing di Indonesia dengan aplikasi pelacakan yang ada, telah sesuai dengan prinsip-prinsip perlindungan data pribadi. Berdasarkan hasil penelitian, penerapan digital contact tracing di Indonesia dengan aplikasi pelacakan melanggar beberapa prinsip terkait data pribadi. Peraturan data pribadi di Indonesia sendiri secara khusus masih sebatas peraturan menteri. Berbeda dengan Singapura, telah menjamin perlindungan data pribadi masyarakatnya melalui Personal Data Protection Act dan Public Sector Governance Act 2018, dan mengenai tanggung jawab pada data pribadi, di Indonesia masih sebatas sanksi administratif, sementara di Singapura, sampai pada pertanggungjawaban pidana.Kata Kunci: Data Privasi; Aplikasi Contact Tracing; Digital Contact Tracing; COVID-19
