Abstract

An election is a democratic process, which is both costly and cumbersome for anyone who wishes to participate. Existing practices, precisely in Indonesia, show that both political parties as well as candidates often need to raise funds to finance their campaign and/or their programs, as well as to ensure the sustainability of their political parties. The Indonesian law states various financial resources in which a political party can raise. Nevertheless, it does not set the limitations and restrictions, particularly on ways to identify and monitor where funds come from. Hence, there has been a fear that political parties may use this loophole to conduct money laundering. It is argued that while the money laundry regime can be used to prevent conspicuous practices related to political financing, a legal framework has yet to be designed and implemented.

Abstract

Globalization has a dominant role in the trade of goods/services, people, technologies, and information. The globalization targets are cultural, economic, and political globalization. Unintentionally, problems arise in society, such as transnational rights issues (transnational crime) caused by globalization. The most common transnational crime is sexual exploitation, which occurs in both men and women. Therefore, regarding the handling of TIP in Indonesia, complementary and correlated regulations or legislation are needed to eradicate TIP. Considering that currently, there are regulations that overlap with each other. As happened in the criminal act of trafficking in persons and the law on the protection of Indonesian migrant workers, the two laws should synergize to prevent, handle, and eradicate TIP. Thus, law enforcers can also be maximal in carrying out their duties, especially in taking action against TIP perpetrators.

Abstract

The rise of narcotics smuggling crimes is a challenge for the Indonesian nation to deal with crimes that are transnational in nature and are extraordinary crimes. Law enforcement against the eradication of nakotika crimes so far has not been effective and has not caused a deterrent effect for perpetrators even though the death penalty has been formulated as an ultimum remedium in criminal law. This study aims to the extent of the effectiveness of law enforcement against narcotics crimes in Indonesia. The methods used in this study are normative research methods and qualitative data analysis. The result of the study is the need for situational law enforcement efforts in dealing with the criminal act of narcotics smuggling to strengthen every component of law enforcement both from the legal component, law enforcement officials, facilities and facilities, society, and culture.Keywords: Law Enforcement; Smuggling; Narcotic. AbstrakMaraknya tindak pidana penyelundupan narkotika menjadi tantangan bagi bangsa Indonesia untuk menangani kejahatan yang bersifat transnasional dan merupakan kejahatan luar biasa. Penegakan hukum terhadap pemberantasan tindak pidana narkotika selama ini ternyata masih belum efektif dan tidak menimbulkan efek jera bagi para pelaku sekalipun telah dirumuskan pidana mati sebagai ultimum remedium dalam hukum pidana. Penelitian ini bertujuan untuk sejauh mana efektivitas penegakan hukum terhadap tindak pidana narkotika di Indonesia. Metode yang digunakan dalam penelitian ini ialah metode penelitian normatif dan analisis data secara kualitatif. Hasil dari penelitian ialah diperlukannya upaya penegakan hukum situasional dalam menangani tindak pidana penyelundupan narkotika untuk memperkuat setiap komponen penegakan hukum baik dari komponen hukum, aparat penegak hukum, sarana dan fasilitas, masyarakat dan budaya.Kata Kunci: Penegakan Hukum; Penyelundupan; Narkotika.
