Abstract

Prinsip-prinsip pemerintahan yang baik dalam pembentukan dan pelaksanaan kontraktual bidang konstruksi harus memahami mengenai maladminitrasi. Maladministrasi dapat terjadi pada berbagai tahapan kontrak, termasuk selama Tahap Pembentukan Kontrak dan Tahap Pelaksanaan Kontrak. Analisis yuridis normatif yang digunakan dalam penelitian meliputi teori hukum dan regulasi, jadi Pemahaman yang tepat dan kepatuhan terhadap prinsip-prinsip pemerintahan yang baik oleh kedua belah pihak dapat membantu mengurangi risiko maladministrasi dan memastikan pelaksanaan kontrak konstruksi yang efektif dan efisien.

Abstract

The principle of professionalism in construction contracts is a fundamental aspect to ensure the sustainability and safety of a construction project. Construction activities that involve numerous workers, equipment, and risks require comprehensive management. Risk management becomes a vital component in preventing work-related accidents and ensuring security, particularly during the pre-contract and project implementation stages. This study employs a normative legal research method with a focus on statutory analysis. This research aims to provide an in-depth and comprehensive analysis of the importance of applying the principle of professionalism in construction contracts, with a primary focus on up-front risk assessment and risk control. Through a systematic literature review, this research presents an overview of the unique characteristics of construction projects, risk identification, and mitigation strategies that can be implemented by stakeholders to ensure professionalism in construction project management. In conclusion, professionalism is essential for the success and long-term sustainability of construction projects. By implementing comprehensive risk management strategies, construction professionals can effectively identify, assess, and mitigate a diverse range of risks, upholding professionalism that is crucial for the industry's prosperity. Through the strategic application of risk management tools and techniques, these professionals can enhance project efficiency, minimize uncertainties, and balance potential threats and opportunities, ultimately delivering safe, high-quality, and financially viable construction projects.

Abstract

Indonesian law is not only dominated by the customary system, but also by the European legal system. Indonesia still adhered to the old Dutch “Burgelijk Wetboek” for several years after its independence, even though the Dutch had completely reformed their Burgelijk Wetboek with a more modern version. One of the significant changes that the Dutch implemented is the paradigm change in the regulation of good faith. Therefore, this research is conducted to determine the effect of paradigm changes in good faith under Dutch civil law on the design of legal arrangements in Indonesian civil law. The research method used is normative juridical which focuses on the problem analysis by approaching the principles and legal norms in the applicable laws and regulations, through statutory, comparative, and historical approaches. Good faith concepts in Indonesia and the Netherlands are basically contained in one specific article. The distinction between Indonesia and the Netherlands is the concept of good faith, which is only contained in the article and after the amendment of the new Civil Code in the Netherlands, it is contained in the heading of that article which stipulates that good faith must be applied.
