Abstract

This study aims to determine the implementation of qawā`id fiqhiyyah in Islamic economics. This research is library research with qualitative method. The approach used in this study is a descriptive normative approach. The results of the study show that the role of fiqh rules in legal practice in general and in sharia economic issues in particular is very clear as contemporary problems appear that seem endless. The existence of fiqh rules in sharia economics is actually very helpful in concluding the law of a problem. Almost all of the fiqh rules that have been formulated by the scholars can be implemented in sharia economic problems.

Abstract

This research aims to know and understand the concept of syirkah in Islamic law and its application to PT. Barokah Biqalbin Salim Akhwat Sewing House (RJA) Makassar. This research is a field research which is a qualitative research using normative juridical approach and sociological approach. The results of the research show the following: first, the implementation of the syirkah contract applied to PT. Barokah Biqalbin Salim Akhwat Sewing House (RJA) Makassar is included in the syirkah al-Muḍārabah category where investors provide capital in the form of money with different nominal values to the manager, on the other hand the manager also has capital in the business. The implementation of the contract does not conflict with the meaning, intent and purpose of the syirkah contract nor does it conflict with the terms and pillars of syirkah. second, the jurists agree that the permissibility of syirkah al-Muḍārabah is based on consensus based on the verses of the Qur'an and hadith. Application of syirkah al-Muḍārabah at PT. Barokah Biqalbin Salim Akhwat Sewing House (RJA) Makassar is in accordance with the Shari'a which is strengthened by the fatwas of contemporary scholars. The mistakes that occur in the contract are that the manager often experiences delays in reporting sales results, but this is just a technical error and has no impact at all on business losses. For that PT. Barokah Biqalbin Salim Akhwat Sewing House (RJA) Makassar needs to continue to evaluate in order to achieve maximum cooperation so that there will be more jobs for Muslims in need.

Abstract

Alatengae is a village located in the Bantimurung sub-district, Maros district. Alatengae in Indonesian means towards goodness. The purpose of Real Work Lecture (KKN) III STIBA Makassar in Alatengae Village is to realize community service programs which are one of the pillars of the Tri Dharma of Higher Education. The method of implementing community service (PkM) begins with a field survey armed with an independent instrument. The results of the KKN trip show how important this program is, where students (i) and the community have experienced tremendous benefits after the implementation of this activity. Social activities, trainings and teaching were carried out well and smoothly.

Abstract

استهدف هذا البحث إلى بيان ومعرفة دور القواعد الفقهية في بناء وتطوير الفقه الإسلامي في ممر العصور. هذا البحث هو بحث مكتبي واعتمد على منهج وصفي وتحليلي للوصول إلى النتائج. وكانت نتيجة البحث تبين أن للقواعد الفقهية والفتوى دورًا هامًّا في بناء الفقه الإسلامي وتطيره وتطوره حيث إن الفتوى قد أصحت منهجًا من مناهج استنباط الحكم الشرعي والقواعد الفقهية تُعتبر أهم أداة التي تساعد العالم والمجتهد والمفتي في عملية استنباط الأحكام الشرعية.
