<![CDATA[AbstrakPancasila adalah dasar Negara yang disahkan PPKI tanggal 18 Agustus 1945 sebagai satu kesatuan dengan UUD 1945, wajib dijadikan dasar penyelenggaraan negara dalam seluruh aspek kehidupan. Pancasila sebagai sumber dari segala sumber hukum sebagaimana diatur dalam Pasal 2 UU 12/2011, wajib di jadikan sebagai rujukan penyusunan seluruh peraturan perundang-undangan, termasuk UU Pemilu maupun UU Pilkada. Pilkada langsung adalah wujud nyata dari pembentukan demokratisasi di daerah.Pemilihan Kepala Daerah secara langsung harus dimasukkan dalam kerangka besar untuk mewujudkan pemerintahan lokal yang demokratis.Tujuan diadakannya pilkada langsung adalah untuk membentuk pemerintahan yang kuat berdasarkan pilihan dan legitimasi dari rakyat.Pilkada langsung adalah wujud nyata dari pembentukan demokratisasi di daerah.Partisipasi warga dalam pemilhan diharapkan tinggi sehinggga hasil pemilihan mempunyai legitimasi kuat. Namun demikian partisipasi warga masyarakat dalam memilih harus tetap berada pada koridor kebebasan politik dan kebebasan sipilnya, tanpa takut akan intimidasi, tetap mempunyai rasa aman. Karena sistem politik demokratis ciri khasnya terletak pada tatanan demokratis yang melandasi penguasa sehingga elemen-elemen demokrasi tidak saja menjadi norma bernegara tetapi secara empirik bekerja sesuai dengan koridor demokrasi.
