Abstract

The major implication from Constitutional Court Decision No. 14/PUU-XI/2013 is that the Constitution promotes fundamental changes to the design of the general election regarding both process and substance. Therefore, in order to uphold the Constitution, efforts are required to reconstruct the design of the general election, particularly so that elections are conducted in accordance with Decision No. 14/PUU-XI/2013 as a representation of the spirit and the will of the 1945 Constitution. Essentially, the current norm regarding the implementation of general elections following the election of members of the representative institution is not consistent with the stipulations in Article 22E Paragraph (1) and Paragraph (2) and Article 1 Paragraph (2) of the 1945 Constitution. Constitutional Court Decision No. 14/PUU-XI/2013 aims to realign the implementation of the elections with the intentions of the 1945 Constitution. Through implementation of the original intent method and systematic interpretation, the Constitutional Court offered its interpretation that the framers of the amended Constitution intended that general elections have five ballot boxes, with the first for the People’s Representative Council (Dewan Perwakilan Rakyat, DPR), the second for the Regional Representative Council (Dewan Perwakilan Daerah, DPD), the third for the president and vice president, the fourth for the Regional People’s Representative Council (Dewan Perwakilan Rakyat Daerah, DPRD) at the provincial level and the fifth for the DPRD at the regency level. Thus, it can be concluded that the presidential elections should be conducted simultaneously with elections of members of the representative bodies. Through this decision, the Constitutional Court revoked the prevailing norm, such that Presidential Elections and Elections of members of representative bodies were no longer valid because they violated the 1945 Constitution. The Constitutional Court introduced a new legal condition that obligated General Elections to be held simultaneously.

Abstract

Human rights protection granted to refugees in Indonesia has not received serious attention, in particular for those who are included in the cross-border refugees. This issue is a question of how the Constitution mandates a protection to them, whether it is an obligation of the government of Indonesia or it is volunteerism alone. The provisians are addressed in Article 28A, Article 28B paragraph (2), Article 28D paragraph (4), Article 28E paragraph (1), Article 28G paragraph (2), and Article 28H paragraph (1), and Article 28J paragraph (1), Broadly speaking, the Indonesian constitution calls for better protection of refugees to internally displaced persons and refugees across borders. This is reflected in several articles in the 1945 Constitution that mention the word “everyone” in the subject which meant regardless of citizenship status or population. This is certainly in line with the values of human rights that have been recognized along with the universality of human rights that are applicable. Therefors the will of the constitution on refugees needs to be implemented in legislation in Indonesia, which describes in details the human rights protection to internally displaced persons and refugees state that the will of the constitution in the protection of human rights to refugees be implemented correctly.

Abstract

Constitutional economics is the main out line of the state indetermining the policy direction in the preparation, implementation and protection of the country’s economy and citizens. Thought contained in the constitutionin economics will be a guide in the country’s economic development and economic policy formation. Importance of economics in the constitution, would be a zone defense in them iddle of the development of the more advanced economies of the developed and developing countries in preparation for the implementation of the ASEAN Economic Community (AEC) by 2015 MEA conceptis formed by a single market in Southeast Asia. MEA it self aim stoin crease competition and improve the quality of ASEAN citizens to be able tobe competitive with people outside ASEAN. In addition to the MEA expected to attractin ward investment in ASEAN so as to provide increased economic and social welfare of ASEAN. With the MEA provides an easier alternative path way in which a country is able to sell the products of both goods and services easily.

Abstract

Keberlakuan yurisprudensi sebagai salah satu sumber hukum yang diakui di Indonesia selalu menarik untuk dilakukan penelitian. Indonesia yang terpengaruh dengan sistem hukum civil law pada dasarnya tidak mengikatkan diri pada yurisprudensi. Namun apabila ada putusan yang dianggap kontradiksi dengan putusan sebelumnya menjadi perdebatan mengenai bagaimana keberlakuan yurisprudensi yang telah ada. Mahkamah Konstitusi sebagai salah satu pelaku kekuasaan kehakiman memiliki kewenangan melakukan pengujian undang-undang terhadap Undang-Undang Dasar Negara Republik Indonesia tahun 1945. Dalam kewenangannya tersebut, terkadang Mahkamah Konstitusi dibenturkan dengan putusan terdahulu yang telah menjadi landmark namun tidak diikuti. Dengan kata lain, terdapat kontradiksi antara putusan yang terdahulu dengan putusan yang ada saat ini. Dalam penelitian ini akan dilihat bagaimana keberlakuan yurisprudensi pada pengujian undang-undang dalam putusan Mahkamah Konstitusi. Metode analisis yang digunakan adalah studi pustaka dengan menggunakan pendekatan studi kasus. Kesimpulan yang didapat dalam penelitian ini adalah bahwa yurisprudensi adalah sumber hukum yang dapat menjadi rujukan dalam memutus suatu perkara pengujian undang-undang namun tidak mengikat hakim untuk menyimpanginya berdasarkan alasan yang logis sesuai dengan pinsip the judiciary independence dan judiciary accountability serta konsepsi the living constitution.The enforceability of jurisprudence as one of the recognized legal sources in Indonesia is a compelling research topic. Indonesia that uses the civil law on law system does not bind to jurisprudence. Nevertheless, if there is a decision that is contradictory to the previous one, that will be a debate over how the enforceability of the existed jurisprudence. The Constitutional Court as one of the judicial authority has the authority to examine the law against the Constitution 1945 of the State of the Republic of Indonesia. In its authority, the Constitutional Court is bumped by a previous decision which has become a landmark but was not followed. In other words, there is a contradiction between the previous decision and the present decision. This research will see how the enforceability of jurisprudence on the judicial review in the decision of the Constitutional Court. The analysis method used is literature study using case study approach. The conclusion available in this study is that jurisprudence is a source of law that can be a reference in a union of judicial review cases but not bound by judges to deviate based on logical reasons in the judiciary independence and judiciary accountability as well as the conception of the living constitution.

Abstract

Subjectum litis in The Legislative and Regional Head Election Disputes in Indonesia has been determined in a limited manner in The legislation and The regulation of the Constitutional Court. However along with the election, there is expansion and constriction of subjectum litis. The purpose of this study was to investigate the determinant factors that cause flexibility of subjectum litis in legislative and regional head election dispute. In addition, no previous studies that examine factors associated with the causes flexibility of subjectum litis in the legislative and the regional headselestion.The method used in this research is using qualitative methods with normative juridical approach by collecting data and information of the legislative and head regional election dispute advance in literature. The results obtained in this study that the shift in legislative elections expanded not only to political parties and individuals DPD that can be subjectum litis but also those of individual candidates of political parties can be subjectum litis in the legislative election disputes. The factor that caused it is the choice of electoral system is still used to 2014 electoral system. Meanwhile, the Regional Head election disputes in general as subjectum litis are that couple candidates for Governor and Vice Governor, Regent and Vice Regent and the Mayor and Deputy Mayor. But in its development, the narrowing of the only candidates who met the threshold difference of votes that can act as an applicant. Besides narrowing, there is also an extension where Consitutional court accommodate domestic election observers were registered and accredited by the KPU / KIP can act as subjectum litis and as the applicant would be candidates in the General Election of 2010. Factors that cause the narrowing and expansion in the elections of regional heads are the will of lawmakers and the limited authority of the Consitutional court as well as the presence of a single candidate who is not predictable by lawmakers in drafting electoral laws regional head. Whereas in 2010, the expansion of subjectum litis because the Court did extensive interpretation caused by serious violations of the right to be elected (rights to be a candidate). Suggestions for lawmakers tobe more thoroughly formulate norms by looking at the existing state of society so it can bring justice and legal certainty both for the expectant couple and society.

Abstract

Komisi Pemberantasan Korupsi dibentuk berdasarkan amanat reformasi 1998 yang menginginkan adanya penyelenggaraan negara yang bersih dari korupsi, kolusi dan nepotisme. Sejak dibentuk dengan Undang-Undang Nomor 31 Tahun 1999 jo. Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Korupsi dan Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi, telah banyak kasus korupsi yang terselesaikan baik dalam skala sedang maupun skala besar. Namun, dengan berjalannya waktu sejak pembentukannya perlu peninjauan ulang pengaturan KPK mengingat semakin banyaknya pengujian undang-undang di Mahkamah Konstitusi terkait dengan kedudukan dan kewenangan KPK. Terlebih, sebagai peserta penandatangan dan peratifikasi UNCAC, sudah seharusnya mengakomodir kedua intrumen tersebut. Dalam penelitian ini akan dibahas mengenai bagaimana politik hukum penguatan kewenangan KPK dalam sistem ketatanegaraan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kasus dan perbandingan. Hasil penelitian yang didapatkan adalah perlunya revisi UU tipikor dengan menyesuaikan pada putusan pengujian undang-undang di MK dan ketentuan yang ada dalam UNCAC, seperti perampasan aset, perekrutan penyidik mandiri, dan memasukkan KPK sebagai organ konstitusi.The Corruption Eradication Commission was formed based on the 1998’s reformation that implement good governance that clean from corruption, collusion, and nepotism. Since it was formed by Law Number 31 of 1999 jo. Law Number 20 of 2001 on the Corruption Eradication Commission, there are many case have been solved in a medium and large scale. However, as time goes by, the Law needs to be reviewed because there are many judicial review towards Constitutional Court about the position and authority of the Corruption Eradication Commission. Moreover, Indonesia should make the Law that accommodate both of the instrument (position and authority) as a member that signed and ratified UNCAC. This research will discuss about how the legal politics of strengthens KPK’s authority in the constitutional system. This research used normative juridical method with comparative and case approach. The result shows that there’s a need to revise Law on the Corruption Eradication Commission in accordance to Constitutional Court’s Decision and UNCAC, like seizure of assets, recruitment of independent investigators, and the Corruption Eradication Commission as a constitution organ.
