Abstract

Akibat Hukum karena adanya kesalahan dan kelalaian dalam penyampaian data informasi debitur melalui SLIK yang menyebabkan hak-hak nasabah debitur mengalami kerugian. Sehingga memberikan bentuk Pertanggungjawaban Bank dan OJK dalam pelindungan hukum antara debitur dan kreditur. Penelitian ini juga bertujuan untuk mengetahui Bentuk Tanggung Jawab Pihak Kreditur Dan Otoritas Jasa Keuangan Atas Data Informasi Debitur Yang Tidak Valid Dalam Sistem Layanan Informasi Keuangan, serta untuk mengetahui dan menjelaskan konstruksi perlindungan hukum bagi pihak kreditur dan debitur ditinjau dalam Undang-Undang Perbankan dan Otoritas Jasa Keuangan. Tesis ini menggunakan metode penelitian hukum Yuridis Normatif, dengan menggunakan pendekatan Perundang-Undangan, Pendekatan Konseptual, dan Pendekatan Kasus. Hasil penelitian tesis ini menyimpulkan bahwa untuk menjamin kepastian hukum dan keamanan data debitur maka diperlukan berupa tanggung jawab bank, seperti adanya ganti kerugian berupa penyampaian dan koreksi laporan debitur ke OJK  mengenai pengkinian data laporan demi memulihkan nama baik nasabah debitur. sanksi oleh pihak OJK berupa: penurunan tingkat kesehatan, pembekuan kegiatan usaha, penilaian kemampuan dan kepatutan, dan sanksi administratif. dan terkait dengan bentuk perlindungan Hukum antara debitur dan kreditur. dimana kreditur dapat menjadikan SLIK  dan prinsip 5C sebagai langkah awal dalam menganalisis kualitas calon debiturnya dan keyakinan yang mendalam dalam guna mencegah terjadinya kredit macet dan/atau ketidaksanggupan debitur dalam memenuhi kewajibanya sebagaimana yang diperjanjikan. pada sisi debitur, OJK memberikan bentuk perlindungan melalui pengaduan nasabah dan sanksi yang tegas kepada pelaku jasa keuangan guna menjamin dan melindungi hak-hak kepentingan nasabah yang mempergunakan  jasa-jasa perbankan.  ABSTRACTArmansyah, D 102 18 065. The Legal Protection Of Creditors and Debtors in the System of Financial Information Service. Supervised by Sitti Fatimah Maddusila and sahrul.            Legal consequences due to errors and negligence in the submission of debtors information data through the system of financial information service which causes the rights of debtors to have losses, thus providing a form of bank and financial services authorization accountability in legal protection between the debtors and creditor. The objectives of this research are to find out and explain the construction of legal protection for creditors and debtors reviewed in the bangking act and the financial services authorization. The research used normative juridical law research method using the approach of legislative, conceptual and case. Based on the results of the research, it can be concluded that in order to guatantee legal certainty and security of debtor data, bank resposibilities are required, such as compensation in the form of submission and correction of debtor reports to the financial services authorization regarding updating report data in order to restore the debtor’s good name, sanctions imposed by the financial services authorization in the form of a decrease in the level of health, freezing of business activities, assessment of capability and appropriateness, and administrative sanctions related to the form of legal protection between debtor dan creditor, where creditor can use the system of financial information services and the 5C principle as a first step in analyzing the quality of prospective debtors and deep confidence in preventing non-performing loans and/or debtors’ inability to fulfill their obligations as promised. On the debtor side, financial services authorization provides a form of protection through customer complaints and strict sanctions to financial service players to guarantee and protect the rights of the customers who use banking services. Keywords: Legal Protection; the  System of Financial Informaton Services financial Services authorization;, Bank Responsibility.

Abstract

Analysis of legal materials is carried out by tracing or inventorying primary legal materials and secondary legal materials. The next step is to identify legal materials and develop legal arguments related to the legal issues discussed. and then conclude each legal issue.To guarantee the rights to land affected by liquefaction, Article 5 of Law Number 24 of 2007 concerning Disaster Management stipulates that the Government and regional governments are responsible for the implementation of disaster management. In the elucidation of the article, what is meant by the responsibilities of the Government and regional governments in the implementation of disaster management include natural disasters, non-natural disasters, and national disasters. In this article, it is explained that the government and local governments as the person in charge of disaster management are obliged to provide guarantees for land rights affected by liquefaction.The provisions regarding destroyed land on the status of ownership of this land have been regulated in Article 27 of the LoGA, that a plot of land can be categorized as destroyed land if the land has changed from its original form due to natural events such as liquefaction. the event of the land being destroyed, does not eliminate the government''s responsibility in providing legal certainty guarantees this is based on the land parcels that cannot be functioned, used, and utilized properly. as a form of implementation of the provisions governing matters that may result in the nullification and destruction of land rights.

Abstract

The environment is something that cannot be separated from human life. Because where someone lives, another environment is created and vice versa. The industry is a sectoral economy or activity that involves the processing of raw materials or the production of products, i.e., the use of skills and labor in the factory and the use of field tools to process the results on the ground and distribute them as the main work. Therefore, as an eye chain, the industry is also responsible for meeting land-related (economic) needs, i.e., agriculture, cultivation, and mining.
