Haryono No. 169 Malang e-mail: isnaininurfadilah5@gmail.com Abstrak Adanya dugaan pelanggaran etik yang mengarah kepada Mahkamah Konstitusi belum mampu terjawab dengan adanya Majelis Kehormatan Mahkamah Konstitusi. Hal ini terlihat pada kerancuan konsep yang ditawarkan oleh Undang-Undang Nomor 7 Tahun 2020. Kerancuan tersebut kemudian dikuatkan dengan minimnya kepercayaan masyarakat atas independensi kelembagaan Majelis Kehormatan Mahkamah Konstitusi itu sendiri. Berdasarkan uraian permasalahan tersebut, terdapat 2 (dua) rumusan masalah pada skripsi ini: (1) Bagaimana eksistensi Majelis Kehormatan Mahkamah Konstitusi dalam menegakkan kode etik Hakim Konstitusi pada periode 2003-2023? (2) Apa gagasan ideal independensi Majelis Kehormatan Mahkamah Konstitusi dalam menegakkan integritas Mahkamah Konstitusi? Metode penelitian yang penulis gunakan adalah jenis penelitian normatif dengan pendekatan peraturan perundang-undangan, perbandingan, pendekatan konsep. Dari hasil penelitian dengan menggunakan metode di atas, penulis memperoleh jawaban bahwa pada perkembangan lembaga Majelis Kehormatan Mahkamah Konstitusi (MKMK) mengalami perubahan yang cukup signifikan dalam berbagai aspek. Permasalahan yang tengah menjadi sorotan bagi kelembagaan MKMK perlu menjadi urgensi dan perlunya pengkonsepan baru untuk mendapatkan kesepahaman bagi Mahkamah Konstitusi maupun lembaga lain yang terkait. Pada konsep yang ditawarkan penulis untuk memperbaiki independensi lembaga MKMK dilakukan dengan 4 (empat) pilar independensi yang di dalamnya mencakup substantive, personal, internal, dan collective independence, yang pada keempat pilar tersebut diubah sesuai dengan kebutuhan yang diperlukan oleh Mahkamah Konstitusi untuk mengembalikan kepercayaan publik atas Mahkamah Konstitusi yang berintegritas. Kata Kunci: independensi, majelis kehormatan Mahkamah Konstitusi, integritas Abstract The allegation of ethical violations in the Constitutional Court remains unanswered by the presence of the Constitutional Court Honorary Board. This is obvious in the ambiguity of the concept offered under Law Number 7 of 2020, and such ambiguity is confirmed by the low trust of the people in the independence of the board concerned. Departing from this issue, this research investigates two problems as follows: (1) the existence of the Constitutional Court Honorary Board to foster the code of conduct of the Constitutional Court’s judges 2003-2-23; (2) the ideal independence of the board concerned to foster the integrity of the Constitutional Court. This research employed a normative method and statutory, comparative, and conceptual approaches. The research results reveal that the board has gone through significant changes in several aspects. This issue should be the basis for the urgency and the new concept to allow for equal perspective between the Constitutional Court and other related institutions. It is, therefore, essential to consider the four pillars, including substantive, personal, internal, and collective independence to fix the current independence in the board. These four pillars are subject to change according to the needs of the Constitutional Court to bring back public trust in the context of the Constitutional Court with its integrity.
