Abstract

Moeslim ulamas of Indonesia have so many works which talk about any social aspect including the concept of family. One of moeslim ulamas of Indonesia who was very active to contibute the idea in the written form was Syeikh Nawawī bin Umar. This paper will be focused on ‘Uqūd Al-Lijjain book. It is one of Sheikh Nawawi's work which describes about family management that regulate how to keep the harmonization of family. This book tends to the superiority of man. It is because this book has been written in more than one hundred years ago, where Syeikh Nawawi lived in patriarchy environment. Then, the results of this paper are；first, the education background and social life of Syeikh Nawawi which basically in islamic boarding school. Second, ‘Uqūd Al-Lijjain is a book which provides family management including the laws and relation ethics between husband and wife according to Imam Syafii madzhab. Third, ‘Uqūd Al-Lijjain answers the management conflict in a family, that is between a husband and wife should understand the right and obigation of each.

Abstract

Sayyidati Aisyah is as a wife, a hadits narration, educator, a religion instructor, and a smart student in various fields. Without abandoning her motherly, she was also able to communicate and interact with society. And the effect of her capability to interact with society had made her successful in education field. This research is about Sayyidati Aisyah?s role in interacting with society and her success in conducting multi roles in her time. This article is library research, in which the researcher collected data from literatures with academic standard. In analyzing the data, the researcher used descriptive analytical method, comparison with socio-historical approach and content analysis. The research result shows that Sayyidati Aisyah RA is Allah servant who is loyal, a Prophet wife; a religion instructor, a hadits narration, Muslim educator had an important role, and contributes greatly to the struggle and development of Islam. The success of the Islamic education process is marked by the realization of the educational goal, namely the existence of perfect human beings (kaffah), this is supported by the fulfillment of 5 elements; educator, students, material/curriculum, method, and environment. Educators and students, in interacting, have to carry out their role and function based on their status and position, the material of interaction, implementing the method in accordance with individual or other group in the interaction, understanding the environment condition.

Abstract

AbstractThis research is study of library research that raised Social Learning Theory applied in family, in order to be able to form socially sensitive individuals toward Indonesian peace. In this paper there are three questions: First, what are the basic concepts in Social Learning Theory? Second, how is the application of social learning theory in the family context? Third, how is the application of Social Learning Theory in the family able to create peace in Indonesia? So the result of this research is: First, Social learning theory is the theory of learning and the formation of personality behaviorally, and emphasized the importance of the social environment. Such individuals, in this theory, are regarded to have self-efficacy that makes socially competent. Second, in the family system, social learning theory is applied to form the quality of individuals who have self efficacy that can’t be seen as a mere personal effort. But as part of a social institution that can only be achieved by working together through an interconnected effort. Third, Social learning theory can form individual personality in response to social stimulus, which will impact on the good formation character of the nation's generation that is sensitive to social. AbstrakPenelitian ini adalah kajian library research yang mengangkat Social Learning Theory diterapkan dalam keluarga, agar mampu membentuk individu yang peka terhadap social menuju perdamian Indonesia. Dan dalam paper ini terdapat tiga pertanyaan: Pertama,apa saja konsep-konsep dasar dalam Social Learning Theory. Kedua, Bagaimana penerapan social learning theory ini dalam konteks keluarga?. Ketiga, bagaimana penerapan Social learning Theory dalam keluarga mampu menciptakan perdamaian di Indonesia?.Maka hasil dari penelitian ini adalah Pertama, Social learning theory adalah teori tentang pembelajaran dan pembentukan kepribadian secara behavioral.Ia menekankan pentingnya lingkungan social. Individu yang demikian, dalam teori ini, dipandang memiliki efikasi diri (self-efficacy) yang membuatnya cakap secara sosial. Kedua, Dalam sistem keluarga, social learning theory diterapkan membentuk kualitas individu yang memiliki efikasi diri yang tidak mungkin dilihat sebagai upaya personal belaka. Tapi Sebagai bagian dari sebuah lembaga social yang hanya bisa dicapai dengan bekerja sama melalui usaha yang saling berhubungan. Ketiga, Social learning theory dapat membentuk kepribadian individu sebagai respons atas stimulus sosial, yang akan berimbas pada bagusnya pembetukan karakter generasi bangsa yang peka terhadap social.

Abstract

Dalam perundang-undangan perkawinan di Indonesia, perceraian dinyatakan sah jika dilakukan di depan hakim Pengadilan Agama. Karena ketidaktahuan tentang  hukum, proses dan biaya yang tinggi, beberapa kasus membuktikan perceraian hanya dilakukan oleh suami isteri tanpa melakukan proses perceraian di Pengadilan Agama.  Sehingga secara hukum formal, status pernikahan mereka masih sah, walaupun pada kenyataannya mereka sudah bercerai. Hal ini berpengaruh juga kepada masa Iddah yang harus dijalani oleh sang mantan isteri dan kapan sang mantan isteri bisa menikah lagi dengan laki-laki lain. Secara kenyataan, setelah terucapnya sighot cerai, maka secara otomatis sang mantan istri melaksnakan kewajiban Iddahnya. Tetapi secara hukum formal, Iddah baru akan dijalani setelah jatuhnya putusan cerai oleh hakim Pengadilan Agama. Kondisi semacam ini bias berakibat pada adanya ketidakpastian hukum pada umat Islam di Indonesia.

Abstract

This research is a study which used a qualitative approach with the type field research, which is related to the Gredoan tradition as the event of looking for a life partnerin using community located on Macan Putih Village, Kabat district in banyuwangi. In thispaper will explain how is the custom to find a mate in Banyuwangi society that has lastedsince long ago. Gredoan is the relations between customary law and Islamic law whichseeks to integrate between the customary laws with Islamic law in matters of marriage. theContributions of research are: First, there is public space in the form of practice the ta'arufprocess towards marriage in Banyuwangi Using society which known as gredoan custom.Second, that Islamic law turns out to have spaces to accommodate the customs as the jointsof Islamic law. gredoan Tradition as an al-?urf in using community of banyuwangi inta'aruf process towards marriage, it obtains legitimacy by the maq??id al-syar??ah which isbased on the rules is al-âdat al-Muhakkamah.

Abstract

Demanding knowledge is not just a transfer of knowledge for the benefit of the world, not just intelligence without thinking about spirituality and morals. So that learning must cover all aspects, from intelligence to moral intelligence for everyday life. The affective domain is very important, where today many people understand religion but have not yet practiced it, because affective values ??and religious values ??have not yet become a reflection of their daily attitudes. This study reveals the formation of students' affective domains in fiqh learning which is integrated with the Ahkam Tafsir at Al Urwatul  Wutsqo Bulurejo DIwek Jombang which is manifested in the formation of attitudes and awareness of students to apply Islamic law in daily life.
