Abstract

Pelayanan publik merupakan ujung tombak bagi pemerintah dalam melaksanakan kekuasaannya, pun juga pelayanan publik merupakan suatu cerminan terhadap baik atau buruknya pemerintahan. Penyelenggaraan pelayanan publik di Indonesia tidak dapat dipisahkan dari ketentuan-ketentuan hukum administrasi pemerintahan, salah satunya mengenai perizinan. Dalam upaya pem-bangunan terhadap sistem pelayanan publik, instrumen hukum perizinan ini merupakan salah satu aspek yang dibenahi oleh pemerintah melalui UU Cipta Kerja, yakni dengan melakukan penyederhanaan. Penelitian ini bertujuan untuk mengkaji perubahan instrumen hukum perizinan dalam UU Cipta Kerja, dan mengkaji bagaimana instrumen hukum perizinan dapat berperan dalam pembangunan sistem pelayanan publik. Penelitian ini didasarkan pada metode penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian mengetengahkan bahwa arti penting sistem pelayanan publik melalui instrumen hukum perizinan nampaknya mulai dibangun oleh pemerintah seiring dengan disahkannya Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang. Sebab salah satu semangat lahirnya UU Cipta Kerja adalah dalam rangka memberikan kemudahan perizinan, yakni harmonisasi terhadap regulasi yang tumpang tindih dan memangkas prosedur perizinan yang rumit. Dalam konsep negara kesejahteraan, salah satu fungsi negara adalah sebagai social services state atau an agency of services (negara sebagai alat pelayanan). Artinya bahwa fungsi negara kesejahteraan tersebut harus dibangun melalui suatu sistem yang dapat mencerminkan nilai-nilai kebermanfaatan. Berdasarkan hal tersebutlah maka reformasi terhadap segala kebijakan mengenai pe-layanan publik merupakan suatu keniscayaan untuk dilakukan, salah satunya adalah mengenai instrumen hukum perizinan.

Abstract

According to Roscoe Pound, law is viewed as a tool for social engineering. However, the situation in Indonesia reveals that the law has not effectively fulfilled its role as a tool for social engineering and development, as envisioned by Mochtar Kusumaatmadja. This is evident in various law enforcement cases in Indonesia, where the process tends to be sluggish and only gains attention after it becomes viral in the mass media. This study aims to explore the underlying factors behind the influence of mass media on law enforcement in Indonesia and investigate whether both the media and the law can function as tools for social engineering simultaneously. The article adopts a normative legal research methodology, utilizing statutory, conceptual, and case-based approaches. The research findings demonstrate that while the mass media has a positive impact, there are still areas for improvement within the Indonesian legal system, particularly concerning the suboptimal performance of law enforcement officials and state authorities. Despite the potential for mutual support between the media and the law, the current scenario highlights the need for the media to serve as an information disseminator, supervisor, social control, and shaper of public opinion, while the coercive nature of the law can exert pressure on law enforcers and government officials to fulfill their duties and responsibilities.

Abstract

Laws serve as normative prescriptions to guide human behavior in social life, ensuring the proper functioning of a society. However, the adoption of the omnibus law concept in Indonesia does not guarantee immediate perfection. To address this, an additional instrument, known as a consolidated text, is necessary to create systematic and easily understandable legal products for the public. This study aims to explore the application of consolidated texts in other countries and examine how they can be implemented in Indonesia's law formation process, particularly in relation to the omnibus law concept. The research employs normative research methods, incorporating statutory, conceptual, and comparative approaches. The findings reveal that Indonesia's adoption of the omnibus law concept would be ideal if accompanied by consolidated texts. Several countries, including the United Kingdom, Australia, and New Zealand, have already embraced consolidation methods in the development of their laws and regulations. Through the consolidation approach, all revised laws and regulations can be consolidated into a single text, complemented by additional regulations such as court decisions that provide further explanations regarding modified or unchanged articles or paragraphs.
