Abstract

Abstract This study contains about the application of Undang-Undang Number 2 of 2012 concerning Procurement of Land for Development for Public Interest. Development for public interest in this case is the Paselloreng Dam which is located in Gilireng District, Wajo Regency, South Sulawesi. The Wajo Regency Government has collaborated with the Public Appraisal Service to determine the compensation price for land owned by the people. On the other side, some Paselloreng people were not satisfied with the compensation price for land that had been determined and filed a lawsuit against the local government. The results of this study indicate that the process of implementing compensation for land is in accordance with the applicable regulations and the price set by the government through Public Appraisal Services above the Sales Value of the Tax Object. The form of people rejection of the compensation value is to sue the executing committee for land acquisition because no agreement was found between the two parties after mediation by the government as the facilitator. The Sengkang District Court has rejected the applicant& claim in this case the Paselloreng people. However, the petitioner has filed an appeal to the Supreme Court and the lawsuit is still on going. Abstrak Penelitian ini memuat tentang penerapan Undang-Undang Nomor 2 tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum. Pembangunan untuk kepentingan umum dalam hal ini adalah Bendungan Paselloreng yang terletak di Kecamatan Gilireng, Kabupaten Wajo, Sulawesi Selatan. Pemerintah Kabupaten Wajo telah bekerja sama dengan Jasa Peniilai Publik untuk menetapkan harga ganti rugi atas tanah milik masyarakat. Di lain pihak, beberapa masyarakat Paselloreng merasa kurang puas dengan harga ganti rugi atas tanah yang telah ditetapkan dan melakukan gugatan terhadap pemerintah setempat. Hasil penelitian ini menunjukkan bahwa proses pelaksanaan ganti rugi atas tanah telah sesuai dengan aturan yang berlaku dan harga yang telah ditetapkan pemerintah melalui Jasa Penilai Publik diatas dari Nilai Jual Obyek Pajak. Bentuk penolakan masayarakat terhadap nilai ganti rugi tersebut ialah dengan menggugat panitia pelaksana pengadaan tanah karena tidak ditemukan kesepakatan antara kedua belah pihak setelah dilakukan mediasi oleh pemerintah selaku fasilitator. Pengadilan Negeri Sengkang telah menolak gugutan pemohon dalam hal ini masyarakat Paselloreng. Namun, pemohon telah ini proses gugutan masih berlangsung.

Abstract

Abstract The research aims to find out whether the covid-19 pandemic can be used as an excuse as a force majeure for not carrying out goods delivery agreements on transportation services and to find out how to settle compensation in the event of a force majeure on goods delivery agreements on transportation services for reasons of the covid-19 pandemic. This study uses an empirical method. The research location was carried out at PT. JNE Watampone Branch. Types and sources of data used are primary data and secondary data with data collection techniques, namely interview techniques and literature study. The data obtained will be processed and analyzed so that it is expected to obtain a clear picture, presented in a descriptive qualitative manner in order to provide a clear and directed understanding of the research results. The results of this study indicate that the Covid-19 pandemic can be used as an excuse as a force majeure for not executing agreements on goods transportation services and settlement of compensation in the event of a force majeure during the Covid-19 pandemic, the JNE or freight forwarding services do not bear losses. Research recommendations, namely PT. JNE can at least propose related to the Force Majeure clause in its contract agreement and it is better if the Covid-19 pandemic should be used as a gate to carry out the negotiation process in canceling or changing the contents of an agreement that has been made and agreed upon by the parties. Abstrak Penelitian bertujuan untuk mengetahui Apakah pandemi covid-19 dapat dijadikan alasan sebagai force majeure untuk tidak menjalankan perjanjian pengiriman barang pada jasa pengangkutan dan untuk mengetahui bagaimana penyelesaian ganti rugi jika terjadi force majeure pada perjanjian pengiriman barang pada jasa pengangkutan karena alasan pandemi covid-19. Penelitian ini menggunakan metode empiris. Lokasi penelitian dilaksanakan di PT. JNE Cabang Watampone. Jenis dan sumber data yang digunakan adalah data primer dan data sekunder dengan teknik pengumpulan data yaitu teknik wawancara dan studi kepustakaan. Data-data yang diperoleh akan diolah dan dianalisis sehinggadiharapkan memperoleh gambaran yang jelas, disajikan secara deskriptif kualitatif guna memberikan pemahaman yang jelas dan terarah dari hasil penelitian. Hasil penelitian ini menunjukkan bahwa pandemi Covid-19 bisa dijadikan alasan sebagai force majeure untuk tidak menjalankan perjanjian pada jasa pengangkutan barang dan penyelesaian ganti rugi jika terjadi force majeure di masa pandemi covid-19, pihak JNE atau jasa pengangkutan barang tidak menanggung kerugian. Rekomendasi penelitian yaitu PT. JNE sedikitnya dapat mengusulkan terkait klausul Force Majeure dalam kontrak perjanjiannya dan Sebaiknya pandemi Covid-19 harus dijadikan gerbang untuk melakukan proses negosiasi dalam membatalkan atau mengubah isi sebuah perjanjian yang sudah dibuat dan disepakati oleh para pihak.

Abstract

This study aims to determine the causes of inherited land disputes regarding the Decision of the Religious Court Number 1544/Pdt.G/2020/PA.Mks and knowing legal considerations in rendering decisions by the Makassar Religious Court Judge This study uses empirical research methods. The research location was carried out in the city of Makassar, especially in the Class 1A Makassar Religious Court. Data collection techniques, library research and field research Data analysis, namely data that has been obtained, both primary and secondary data, will then be processed and analyzed to produce conclusions. The results of research on the Decision of the Makassar Religious Court Number 1544/Pdt.G/2020/PA.Mks that is, there is control over the entire inheritance of the former husband of the heir without giving it to other heirs who are also entitled to obtain the inheritance. Judges considerations in giving a decision based on the law and verses of the Qur'an relating to inheritance cases. The research recommendation is that the Class 1A Makassar Religious Court in handling inheritance cases carries out procedures in accordance with applicable regulations.

Abstract

This study aims to determine the factors that cause a person to commit the crime of trafficking in persons, to determine the efforts made by law enforcement officials in this case, especially the Makassar Police to tackle the crime of trafficking in persons. This type of research is a descriptive empirical legal research. Using a qualitative legal research approach. The location of the legal research was carried out at the Polrestabes Makassar. Types and sources of legal research data include primary data and secondary data. Data collection techniques by interview and literature study. Based on the results of the research and discussion, it was concluded that the factors in the occurrence of the crime of trafficking in persons consisted of economic factors, socio-cultural environmental factors, individual factors, lack of public knowledge about the consequences of crime, and the lack of firmness in law enforcement officers in following up on criminal cases of trafficking in persons. Regarding efforts to tackle the criminal act of trafficking in persons, it consists of preventive and repressive measures. Namely by disseminating information to the public regarding the consequences of the crime of trafficking in persons and implementing Law Number 21 of 2007 concerning the eradication of the criminal act of trafficking in persons properly so as to provide a deterrent effect on the perpetrator and no longer repeat his actions.
