Abstract

Sektor perbankan sebagai salah satu sektor keuangan mempunyai kedudukan strategis dalam perkembangan perekonomian Indonesia, sebab tingkat pertumbuhan dan pemerataan ekonomi ditentukan oleh peran perbankan. Menempati posisi yang begitu penting dalam sistem keuangan di Indonesia, menjadi sektor perbankan rentan dari kegiatan tindak pidana perbankan terutama kejahatan tindak pidana pencucian uang (money laundering). Kejahatan perbankan ini juga telah memanfaatkan kecanggihan teknologi informasi seperti sistem pembayaran yang bersifat elektronik (electronic found transfer), sehingga kejahatan ini dapat menembus batas yuridiksi suatu negara dan sudah masuk dalam kategori kejahatan berskala internasional yang telah mendapat sorotan di dunia internasional. Objek kajian yang dikaji berkaitan dengan kewajiban bagi penyedia jasa keuangan yang berbentuk bank untuk menerapkan prinsip mengenal nasabah guna mengetahui identitas dan meminta dokumen pendukung bagi pengguna jasa keuangan. Metode yang digunakan dalam penelitian ini adalah metode yuridis-empiris. Hasil penelitian menunjukkan penggunaan teknologi dalam bidang perbankan tidak terlepas dari tindak kejahatan yang meliputinya, baik dalam skala nasional maupun internasional. Sebagai bentuk pencegahan secara dini, maka pihak perbankan mengeluarkan kebijakan dalam bentuk system mengenal nasabah secara dini (know your costumer principles).

Abstract

Tujuan kegiatan Penyuluhan Taat Pajak ini adalah memberikan edukasi bagi masyarakat maupun Pelaku usaha UMKM di Distrik Biak Utara untuk menmberikan pengetahuan akan kesadaran masyarakat untuk dapat mentaati pajak dan bagaimana sanksi yang berlaku. Kegiatan ini diharapkan mampu meningkatkan kemandirian bagi masyarakat untuk dapat membuat kesadaran dalam taat pajak bagi masyarakat terkhusus para pelaku usaha di distrik biak utara, kabupaten biak, Provinsi Papua. Metode yang akan digunakan dalam kegiatan ini adalah metode partisipatif. Abstract

This research aims to determine the legal position of the government in contracts for the procurement of goods and services as well as the burden of responsibility for the government in implementing contracts for the procurement of goods and services. The type of research used is normative juridical, namely examining legal concepts related to contracts in general and commercial contracts in particular. In this case, the object of this research is related to the status and authority of the government in contracts for the procurement of goods and services. The research results reveal that sometimes the government is involved in civil relations in the same position as private parties as in contracts for the procurement of goods and services, without its specific position as an institution to protect the public interest. The imposition of government responsibility in implementing contracts for the procurement of goods and services can be viewed from two aspects in terms of the government's actions as one of the parties to the contract for the procurement of goods and services, namely actions that are inherent in government institutions and private (individual) government officials, so that they can be held accountable based on Article 1365 Civil Code. Therefore, the auction/tender committee and/or authorized officials in issuing decisions both in making contracts for the procurement of goods and services and in implementing these contracts must be based on basic values or principles of justice and rational responsibility.

Abstract

This research aims to analyze, explain and understand the application of science and technology to intellectual property rights in process patents and to analyze, explain and understand legal protection for process patents. The type of research used is empirical legal research because it is motivated by the idea that law cannot be separated from people's lives in the form of values and attitudes/behavior, but law can be studied from its empirical aspect, namely how the law is in reality in people's lives. The results of this research reveal that the application of IPTEKS and Intellectual Property Rights in the patent process means that Indonesian society as a society does not respect Intellectual Property Rights. The reality in society still shows that there are many violations of Patent Rights and it is suspected that they have reached a dangerous level and can damage the order of life in society in general, especially creativity to give birth to new discoveries. Meanwhile, legal protection for process patents developed by indigenous Papuans according to the Patent Law is granted on the basis of an application. And until December 2021, through the Trade and Small and Medium Industry IPR Consultation Clinic, the Papua Province Industry and Trade Service, several inventions regarding traditional medicines have been registered at the Patent Office in Jakarta.
