Abstract

Differences in parents' views on determining the minimum and maximum age limits for marriage for women in Lok Bahu Village.Parents have different views on determining the minimum age limit for marriage for women in terms of the level of education they have. The minimum age limit set by parents is 17-19 years and the maximum age is 28-30 years. The minimum age limit for marriage is regulated in Law Number 16 of 2019 concerning Marriage, which is to be 19 years old for both men and women. Based on this, the researchers formulated the problem of how the views of parents with low and high education on determining the minimum and maximum age limits for marriage for women in Lok Bahu Village and what factors influence parents in determining the minimum and maximum age limits for marriage for women in Lok Bahu. This study uses empirical legal research, namely research obtained from experience, discoveries, and observations made to obtain field data. The qualitative data analysis technique used in this study uses data analysis techniques according to Miles and Huberman including, collecting data, reducing data, presenting data and drawing conclusions from the data obtained. Thus, it is hoped that the community will prioritize the level of education first before marrying off their daughters.

Abstract

This article discusses online buying and selling, especially contracts. The author found several consumers who carried out the buying and selling. This research aims to find out the practice of paying at the beginning of a transaction in online buying and selling and how Fikih Muamalah reviews this practice. Type of normative, empirical research with qualitative descriptive analysis. The respondents of this research were 21 consumers who made payments in advance for online buying and selling in the Loa Janan Ilir sub-district. The data collection techniques used by the author are observation, interviews, and documentation. The data analysis technique used is data management from interviews, documentation, and literature using qualitative descriptive analysis patterns.The results of this research obtained: first, the practice of payment at the beginning of transactions in online buying and selling in the community in Loa Janan Ilir sub-district is carried out by buyers ordering goods in the online shop application and stating the specifications of the desired goods and making payment immediately in advance according to the stated price. In the visual depiction, it is to be noted that the total cost encompasses not only the item's price but also the shipping charges. Furthermore, it must be noted that the dispatch of the goods in question will be deferred for several days before their shipment. Second, people in Loa Janan Ilir often buy and sell online using greeting contracts. Where payment must be made immediately for something that is still pending. This is permitted by some scholars as long as it does not conflict with Sharia law‟ applicable. However, some scholars do not allow this buying and selling because it is considered detrimental to one party. The seller must state in detail the details of the goods being sold to avoid elements of fraud.

Abstract

Hak khiyar yang memberikan informasi spesifik terkait produk yang sejenis namun berbeda kualitas adalah khiyar ta’yin. Pada praktiknya dalam pemebelian produk flash sale di marketplace TikTok Shop, terdapat kolom komentar dan testimoni yang memuat berbagai pengalaman konsumen terkait produk yang telah mereka beli sebelumnya, dalam kolom komentar dan testimoni tersebut juga terdapat ulasan terkait informasi produk baik dari segi kualitas dan lain sebagainya, namun banyak konsumen yang menggunakan testimoni dan komentar sebagai referensi merasa tertipu dalam hal kualitas produk karena tidak sesuai dengan isi keterangan yang diberikan dalam ulasan testimoni dan komentar pada marketplace TikTok Shop. Dengan rumusan masalah yaitu pertama bagaimana implementasi khiyar ta'yin dalam transaksi pembelian produk flash sale secara online pada marketplace TikTok Shop menurut tinjauan fikih muamalah, kedua bagaimana pandangan mahasiswa Fakultas Syariah terhadap testimoni dan komentar user sebagai referensi dalam mencari informasi produk yang akan dibeli. Tujuan penelitian untuk mengetahui implementasi khiyar ta'yin dalam transaksi pembelian produk flash sale secara online pada marketplace TikTok Shop menurut tinjauan fikih muamalah, dan untuk mengetahui pandangan mahasiswa Fakultas Syariah terhadap testimoni dan komentar user sebagai referensi dalam mencari informasi produk yang akan dibeli oleh konsumen. Penelitian ini menggunakan jenis penelitian kualitatif dengan pendekatan normatif empiris, dengan sumber data primer yaitu hasil wawancara kepada 20 mahasiswa Fakultas Syariah UIN Sultan Aji Muhammad Idris Samarinda dan data sekunder terdiri dari kitab Fikih Muamalah, Kitab Bulughul Maram, dan Kitab tafsir Ibnu Katsir, jurnal, artikel ilmiah, serta karya ilmiah lainnya. Data tersebut diperoleh dari hasil observasi, wawancara, dan dokumentasi, kemudian data-data tersebut penulis analisis dengan metode deskriptif kualitatif. Hasil penelitian menunjukkan bahwa implementasi khiyar ta'yin pada transaksi pembelian produk flash sale pada marketplace TikTok Shop belum sepenuhnya sesuai dengan fikih muamalah kerena pedagang dan pembeli belum mengetahui tentang khiyar ta'yin sehingga bentuk pelaksanaan khiyar ta'yin yang dilakukan oleh penjual dan pembeli terjadi dengan sendirinya dengan etika bisnis untuk mencapai kemaslahatan yang berbentuk unsur kerelaan antara pedagang dan pembeli, dan dari hasil wawancara masih terdapat beberapa kasus konsumen yang merasa tertipu, maka berangkat dari hal tersebut deskripsi produk, testimoni dan komentar masih terdapat unsur gharar di dalamnya dan bisa menimbulkan mafsadah kepada konsumen lainnya.
