Abstract

Crucial issues related to the protection and supervision of Indonesian migrant workers (PMI) working abroad. In the context of the Indonesian economy, PMI has an important role in generating economic contributions to the country and providing economic benefits for their families in Indonesia. Constitutional foundations, such as Article 27 paragraph (2) and Article 28D paragraph (2) of the 1945 Constitution, as well as the Indonesian Migrant Manpower Law No. 18 of 2017, have provided a clear legal framework on the obligations of local governments in regulating, fostering, implementing, and protecting the rights of migrant workers. However, there are still obstacles and violations that often occur in sending workers abroad, such as unsettled wage payments and contract problems. This study aims to analyze local government supervision of labor supply companies in Cirebon Regency and identify common violations in sending workers abroad along with the necessary solutions. The research findings highlight the importance of increased supervision, stricter law enforcement, and cross-border collaboration to protect and improve migrant workers' working conditions, and make it the basis for recommending further measures for the welfare of Indonesian migrant workers.

Abstract

The purpose of this study is to examine how law enforcement is applied in Indonesia's sociological context. The results of the investigation indicate that community involvement is necessary for the application of law enforcement in the sociological sphere. It is believed that the community's participation and involvement in law enforcement can be used as a controlling factor when making decisions about the appropriateness of punishment for lawbreakers. The community can play a major role in reducing the number of legal infractions and deviations from unlawful acts that have become sociological phenomena by actively participating in the monitoring, supervision, and evaluation of the law enforcement practices in this nation.

Abstract

Halal food and beverage products are important, and business actors must protect consumers following the mandate of the Consumer Protection Law and the Halal Product Assurance Law. The government has issued a free halal certification policy until October 17, 2024. MSME actors must have it, one of which is for MSME actors in food and beverage products. Suppose they do not have a halal certificate until that date. In that case, MSME actors will be sanctioned by Government Regulation Number 39 of 2021 concerning implementing the Halal Product Assurance Sector. The author uses an empirical juridical research method by identifying the law, seeing the effectiveness of law enforcement in the community, and reviewing the legal consequences of its implementation, especially in the Pekiringan Village area, the economic center of Cirebon City. From the results of this study, the author obtained data that more MSME actors in food and beverage products in Pekiringan Village do not have halal certificates in distributing their products. Therefore, there will be legal consequences in the form of sanctions for MSME actors if they do not have a halal certificate until the date determined by the current regulations.

Abstract

Interfaith marriage raises legal issues that require special attention, even though they are considered sacred in religious communities in Indonesia. The study aims to determine how Indonesia's positive laws and religion view marriage between people of different religions. Normative juridical and descriptive-analytical were used to conduct this research. After being obtained from library materials and secondary data, the data is analyzed qualitatively to obtain deductive conclusions. The study found that Law No. 1 of 1974 on Marriage stipulates marriage rules in Indonesia. It states that each spouse's religious beliefs determine whether the marriage is valid or not. Furthermore, Law Number 16 of 2019, which amends Law Number 1 of 1974, sets the age limit at which a person can marry. However couples with different religious backgrounds often face problems. Religions have different views on marriage. These concepts affect the legal status of marriage. The law affects the status and position of children, marital status, and administration of residence. Therefore, a deep understanding of positive religious and legal perspectives is necessary to resolve these legal issues in a fair and balanced manner.
