Abstract

Manusia bukan barang yang dapat diperjualbelikan dalam bentuk apapun, manusia memiliki harkat dan martabat yang harus dijaga sehingga negara mengatut secara tegas bahwa manusia dilarang untuk diperbudak atau diperjualbelikan. Walaupun sudah diatur di dalam Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang tidak dapat memberantas tindak pidana perdagangan orang dan terus kian terjadi sampai saat ini yang mana salah satu sistem awalnya yaitu melalui proses atau hatap rekrutmen atau perekrutan. Sehingga tujuan penelitian ini adalah untuk mengetahui seperti apa pertanggungjawaban pidana yang dikenakan bagi pelaku rekrutmen tindak pidana perdagangan orang. Metode penelitian yang dipergunakan yaitu metode penelitian yuridis normatif, yaitu menganalisis kasus yang ada dengan peraturan perundang-undangan yang berlaku. Pertanggungjawaban Pidana terhadap pelaku rekrutmen tindak pidana perdagangan orang telah di atur dalam Pasal 2 ayat (1) Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Mengenai penerapan hakim dalam memberikan putusan terhadap pelaku di pengadilan, melihat bukti-bukti yang meringankan serta memberatkan bagi pelaku.

Abstract

The Understanding in the prevention of DomesticViolence can not only be done in the community in general, butalso for inmates/convicts who are serving sentences inCorrectional Institutions. Legal counseling in the form ofempowering inmates is intended so that when they are free andreunited with their families and communities, they can play asignificant role in preventing domestic violence. In counselingin the form of empowering inmates, the participants, in this casethe inmates/inmates who previously did not fully know aboutdomestic violence, understood it more and more so that it isexpected to be a provision in welcoming a new life when theyreunite with their families. This activity was carried out using anonline method via zoom where the participants, namelyinmates/prisoners were in the Pondok Bambu Rutan while thespeakers were lecturers from Bhayangkara University who wereon campus.

Abstract

Reporting on campaign funds is an order regulated inLaw No. 7 of 2017. Campaign funds come from political parties,candidates for Regency/Municipal Regional People'sRepresentative Assembly members, including contributions thatare legal under the law. There is no regulation for reportingcampaign fund contributions obtained from other parties. The2014 and 2019 elections have KPU regulations governing them.Specifically for the 2024 elections, implementing regulationshave not yet been formed. In the absence of regulation, this actionis not consistent with the previous election and will give rise tothe potential for election violations. The partner of this serviceactivity is bekasi election monitoring body. Participants inservice activity were faced with the problem of whether it wasnecessary to report campaign funds contributions from otherparties and what the legal basis was. This service activity offersa solution that the KPU should still make implementingregulations regarding reporting of campaign fund donationsobtained from other parties. The argument is that the electionsconstitutional conventions for the 2014 and 2019 electionsregulate these provisions and the consequences of Article 334paragraph 2 of Law No. 7 of 2017.

Abstract

The understanding of obtaining legal aid is not yetfully understood by citizens in general, including inmates asprisoners who are currently undergoing a case examinationprocess as subjects who are in conflict with the law. This legaleducation aims to ensure that inmates, especially detainees ontrial, can understand the function of legal aid and their rights toobtain legal aid. In this counseling, the inmates are participants,in this case the inmates/inmates who previously did not fullyunderstand their function and rights to legal aid, can understandit clearly. It is hoped that participants will immediately exercisetheir right to obtain legal assistance when facing investigationsinto criminal cases against each of them. This activity wascarried out using the face-to-face offline method at the PondokBambu Detention Center. The resource person is a lecturer fromBhayangkara University, Greater Jakarta, conducting outreachby visiting the PondokBambu Detention Center.

Abstract

The decision of the Honorary Council of the Constitutional Court stated that the Constitutional Court judges who examined case Number 90/PUU-XXI/2023 were proven to have violated the right to refuse. The right to refuse is part of the independent and impartial principle of the Constitutional Court. There has been a conflict of interest between the norms being tested and the Constitutional Court judges. Conflicts of interest are constitutional and moral violations. What are the juridical consequences of Constitutional Court Decision Number 90/PUU-XXI/2023 which violates the constitution and morals from the perspective of natural law philosophy? This research uses a normative juridical research method with a conceptual approach, a statutory approachs and a case approach. The results of the discussion have found that in the MKMK decision that the judge consciously and deliberately ignored constitutional principles regarding the right to refuse in Law Number 48 of 2009 concerning Judicial Power. Overruling the right to refuse is tantamount to overruling constitutional principles. Judges place constitutional values in practice as semantic values. Apart from that, there was a moral violation which was assessed by the lack of awareness not to review case Number 90/PUU-XXI/2023 due to a conflict of interest. Awareness comes from conscience and is closely related to integrity, independence and impartiality. The integrity of judges as enforcers and guardians of the constitution is at stake. Moral and legal principles in the constitution are two things that go hand in hand in natural law philosophy.
