Abstract

This study aims to determine the factors that cause the disparity of decisions in narcotics abuse, as well as how to overcome it. The development of narcotics abuse and trafficking that has hit the world has also affected the country, its development is so rapid that it is very worrying. Indonesia's vast territory and consists of 17 thousand islands in addition to Indonesia's large population of around 250 million, for the narcotics market is an extraordinarily promising market. this is what attracts foreign narcotics mafia to invade Indonesia in various ways. the type of data is primary data and secondary data, primary data obtained through direct interviews with competent respondents. Secondary data is obtained through literature from various books, legal rules, documents, and other written data that are considered related to this research. The results showed that 1) Factors that cause disparity include subjective factors in making decisions as well as aggravating and mitigating factors; 2) Efforts to overcome the disparity in narcotics abuse decisions are to conduct personality development training, in order to be able to demonstrate professionalism and integrity to pay attention to the case at hand, so as to be able to make policies that provide a sense of justice for every community.

Abstract

This study aims to determine the factors that cause violence against children in Sibulue District, Bone Regency, and the efforts made to overcome violence against children in Sibulue District, Bone Regency. This research was conducted at the Sibulue sector police station. The types of data are primary data and secondary data. Primary data is obtained through direct interviews with respondents who are competent in handling the occurrence of violence against children in Sibulue District, Bone Regency, as well as perpetrators and families of victims of violence against children in Sibulue District, Bone Regency. Secondary data is obtained through literature from various books, legal rules, documents, and other written data related to this research. The results showed the factors causing violent crimes against children in Sibulue District, Bone Regency: the environment, film media, revenge, and the role of the victim/opportunity. Efforts made by the police, especially the Sibulue Sector Police, in tackling crimes of violence against children include preventive efforts (prevention), namely activities that are like directing the community to good things, for example, holding legal counseling, holding KAMTIBMAS lectures, holding lectures related to the role of children in society which include children's NGOs, holding police patrols for security, and other efforts deemed necessary to maintain community security. In addition, there are repressive efforts, namely efforts made after the occurrence of a crime in terms of case disclosure, investigation at the police level to the court level, and punishment carried out in correctional institutions.

Abstract

Restorative justice is an alternative approach to the criminal justice system that focuses on restoring relationships between offenders, victims and society rather than simply punishment. This research aims to explore the application of restorative justice in murder cases, assessing the extent to which the concept can be applied and its effectiveness in the Indonesian criminal law context. In this discussion, possible opportunities for the application of restorative justice are examined, such as the potential for victim recovery and offender reintegration into society. However, major challenges are also identified, including normative barriers in the law, resistance from law enforcement officials, and social and cultural constraints. This study uses a qualitative approach with juridical analysis of murder cases in Indonesia that consider aspects of restorative justice. The results showed that although restorative justice offers much potential to improve the justice system, its application in homicide cases requires significant legal reform, education and training of law enforcement officers, and a paradigm shift in society. In conclusion, while restorative justice has opportunities to be applied in homicide cases, the challenges present require a holistic approach to ensure effective implementation.

Abstract

Land disputes are one of the most common types of conflict in Indonesia, given that land has a very high economic, social and cultural value. As development and land use changes increase, disputes over ownership, boundaries, and land use rights are increasingly common. Mediation as an alternative to out-of-court dispute resolution has been recognised as a faster, cheaper and more efficient method of resolving often complex and sensitive land conflicts. This study analyses the various factors that influence the success of mediation in land dispute cases, including the role of the mediator, legal support, as well as the readiness of the parties involved. The results show that mediation can be an effective tool for resolving land disputes, especially when supported by competent mediators and a strong desire from the parties to reach an agreement. However, the research also identified a number of challenges, such as the power imbalance between the parties, the lack of understanding of the mediation process, as well as limitations in the implementation of mediation outcomes. Thus, while mediation offers great potential in land dispute resolution, further efforts are needed to overcome these obstacles in order for mediation to function optimally in the context of agrarian law in Indonesia.

Abstract

Between humans and their environment there is a dynamic relationship. Changes in the living environment will cause changes in the physical and psychological conditions of humans to adapt to new conditions. Changes in the human condition will in turn cause changes in the environment. Thus, it can be said that not only the environment can affect humans, but humans can also be the main and dominant factor influencing the environment, so that human awareness is needed for their own environment. This is done in order to obtain a good environment and in accordance with human needs, so that the dynamic relationship between humans and their environment will be maintained. The method of this community service is the counseling method in the form of direct presentation of lecture material to 5 respondents using leaflets and browser media. This community service as a whole is very effective, so that an increase in knowledge is obtained after counseling on the Criminal Act of Granting Business Permits by Officials Without Completed Environmental Permits.

Abstract

Writing this thesis aims to find out the factors that led to the occurrence of the Crime of Abuse which was carried out jointly by children against children in the Awangpone District, Bone Regency, as well as the efforts made by the Awangpone Sector Police in dealing with the Crime of Abuse which was carried out jointly by children against children in Awangpone District, Bone Regency. This research was conducted at the Awangpone Sector Police Office. The types of data are primary data and secondary data, primary data obtained through direct interviews with competent respondents, in this case Awangpone Sector Police Investigators, as well as perpetrators and victims of the Crime of Abuse committed jointly by children against children in Awangpone District Bone District. Secondary data was obtained through literature from various books, legal regulations, documents and other written data deemed related to this research. The results showed that the factors causing the occurrence of the crime of maltreatment committed jointly by children against children in Awangpone District, Bone Regency, namely, legal awareness factors, low education factors, environmental factors and economic factors influence each other between one factor and another. other. The efforts made by the Awangpone Sector Police in tackling the occurrence of the Crime of Abuse which was carried out jointly by children against children in Awangpone District, Bone Regency are: 1). Preventive Measures, 2). Repressive Measures.
