Abstract

Penelitian ini dilakukan untuk mengetahui: Bentuk-bentuk wanprestasi pelaku usaha dan faktor-faktor yang menjadi penyebab pelaku usaha wanprestasi atas perjanjian jual-beli barang yang dilakukan melalui media sosial Instagram. Jenis penelitian adalah penelitian normatif-empiris. Jenis data yang digunakan adalah data primer dan data sekunder. Teknik pengumpulan data yang dilakukan adalah; dokumentasi, penyebaran angket dan wawancara dengan responden yang terdampak atas wanprestasi pelaku usaha di Instagram dan Pelaku usaha yang beroperasi di Instagram. Berdasarkan hasil penelitian skripsi ini dapat disimpulkan bahwa: Bentuk-bentuk wanprestasi pelaku usaha di Instagram antara lain; Keterlambatan saat pengiriman barang, barang yang tidak sesuai dengan gambar di iklan, barang yang rusak saat diterima pembeli dan barang yang tidak layak digunakan namun tetap dijual ke pembeli, juga terdapat onlineshop fiktif yang digunakan untuk menipu pembeli. Juga disimpulkan bahwa faktor-Faktor wanprestasi pelaku usaha di Instagram antara lain; Overmacht, Force majeure, Itikad buruk pelaku usaha dan kelalaian pelaku usaha yang umumnya disebabkan pihak ketiga yang bertugas mengirimkan barang, juga terdapat pelaku tindak pidana penipuan yang dengan sengaja menjaring korban di Instagram menggunakan onlineshop fiktif. This research was conducted to determine: Forms of default by business actors and the factors that cause business actors to default on goods sale and purchase agreements made via the social media Instagram. The type of research is normative-empirical research. The types of data used are primary data and secondary data. The data collection techniques used are; documentation, distribution of questionnaires and interviews with respondents affected by default by business actors on Instagram and business actors operating on Instagram. Based on the results of this thesis research, it can be concluded that: Forms of business actor default on Instagram include; Delays in delivery of goods, goods that do not match the picture in the advertisement, goods that are damaged when received by the buyer and goods that are not suitable for use but are still sold to the buyer, there are also fictitious online shops that are used to deceive buyers. It was also concluded that the factors for business actors' default on Instagram include; Overmacht, Force majeure, bad faith by business actors and negligence by business actors which are generally caused by third parties tasked with delivering goods, there are also perpetrators of criminal acts of fraud who deliberately attract victims on Instagram using fictitious online shops.Keywords: Business Actor, Default, Instagram, Purchase, , Socio-Juridical.
