<![CDATA[Tulisan ini bertujuan untuk menganalisis lebih lanjut mengenai pengaruh Hukum Islam terhadap Hukum Nasional. Pada awalnya sistem hukum Indonesia menganut sistem Eropa Kontinental dari Belanda. Sehingga pada mulanya awal penerapan Hukum Islam berlaku karena berbagai tradisi yang berlaku di masyarakat Indonesia yang dominan masyarakat muslim. Indonesia memberlakukan Hukum Islam sebagai Hukum Nasional yaitu terlihat pada adanya undang-undang perkawinan, zakat dan hadirnya Kompilasi Hukum Islam. Permasalahan didalam tulisan ini yaitu mengkaji bagaimana posisi hukum islam didalam hukum nasional serta kontribusi hukum islam didalam hukum nasional. Metode penelitian yang digunakan didalam penelitian ini yaitu metode yuridis normatif melalui pendekatan perundang-undangan yang berlaku di suatu negara. Adapun hasil yang penulis dapatkan yaitu Hukum Islam hadir sebagai solusi untuk pemecahan permasalahan peradilan umat Islam di Indonesia seperti Undang-undang Perkawinan. Hukum Islam berperan menciptakan tata nilai yang mengatur sebagian besar masyarakat Islam Indonesia sebagai umat mayoritas, menjadi sumber material pembentukan hukum nasional untuk mengisi kekosongan hukum, menjadi salah satu alat hukum dalam menyelesaikan masalah bangsa untuk melindungi HAM, menjadi salah satu bahan dasar hukum hakim dalam menggali dan menemukan hukum demi menegakkan keadilan, memberi kontribusi dari segi jiwa hukum dalam pembentukan hukum nasional. Bukti dari pengakuan hukum nasional terhadap hukum islam yaitu adanya undang-undnag perkawinan serta peraturan haji dan sebagainya This paper aims to further analyze the influence of Islamic Law on National Law. Initially, the Indonesian legal system adopted the Continental European system from the Netherlands. So that in the beginning the application of Islamic law was valid because of various traditions prevailing in Indonesian society, which were dominant in the Muslim community. Indonesia enforces Islamic law as a national law, which is seen in the marriage law, zakat and the presence of the Islamic Law Compilation. The problem in this paper is to examine how the position of Islamic law in national law and the contribution of Islamic law in national law. The research method used in this study is the normative juridical method through the approach to legislation in force in a country. The results that the authors get are that Islamic Law is present as a solution to solving the problems of the judiciary of Muslims in Indonesia such as the Marriage Law. Islamic law plays a role in creating values that regulate most of the Indonesian Muslim community as the majority people, becomes a source of material for the formation of national law to fill legal voids, becomes one of the legal tools in solving the nation's problems to protect human rights, becomes one of the basic legal materials for judges in exploring and find the law for the sake of upholding justice, contributing in terms of the spirit of law in the formation of national law.
