<![CDATA[Tujuan penelitian menganalisis kedudukan hukum kesaksian Justice Collaborator dalam proses persidangan dan perlindungan Hukum Justice Collaborator dalam proses persidangan. Penelitian ini menggunakan data primer maupun sekunder yang diperoleh dan dikumpulkan, kemudian dianalisa secara kualitatif yang selanjutnya dibahas secara deskriptif dengan menguraikan permasalahan serta penyelesaian yang berkaitan dengan penelitian ini. Hasil penelitian ini menunjukkan bahwa: (1) Kedudukan hukum justice collaborator pada persidangan belum diatur secara jelas dan rinci. Dan masih terdapat perbedaan cara pandang antara para penegak hukum dalam menentukan Justice Collaborator (2) Perlindungan hukum terhadap justice collaborator, tidak dapat dituntut secara hukum, baik pidana maupun perdata atas kesaksian dan/atau laporan yang akan, sedang, atau telah diberikannya, kecuali kesaksian atau laporan tersebut diberikan tidak dengan iktikad baik. The research objective is to analyze the legal position of Justice Collaborator's testimony in the trial process and the legal protection of Justice Collaborator in the trial process. This research uses primary and secondary data that is obtained and collected, then analyzed qualitatively which is then discussed descriptively by outlining the problems and solutions related to this research. The results of this research show that: (1) The legal position of justice collaborators at trials has not been regulated clearly and in detail. And there are still differences in perspective between law enforcers in determining Justice Collaborators (2) Legal protection for justice collaborators cannot be prosecuted legally, either criminally or civilly for testimony and/or reports that they will, are giving, or have given, except for testimony or the report was not provided in good faith.]]>
