Abstract

Immigration crime and criminal law are one of the interesting studies not only seen in terms of law enforcement but also criminal law politics and authority arrangements in immigration. For Indonesia, the problem of immigration is a challenging problem, not because it is only the location of Indonesia that is vast and has many access points for immigrants, but also the authority between institutions. Article 105 of Law Number 6 Year 2011 on Immigration, states that the Immigration Civil Servant Investigator is authorized as an Immigration criminal investigator conducted in accordance with the provisions. The results of this study are: (1) enforcement of immigration law conducted one of them with the investigation of perpetrators of violations of the Immigration Act. The process of investigating the perpetrators of violation of Immigration Law is based on the provisions of the Criminal Procedure Code as lex generalis and Immigration Law as lex specialis. In this research, law enforcement has been carried out in order to participate in trading fake immigration/passport travel documents by providing unauthorized data or incorrect information to the Immigration officer to obtain travel documents of the Republic of Indonesia for himself, (2) in implementing immigration law enforcement function there are still obstacles faced Immigration Civil Servant Investigator include low knowledge, lack of operational fund, lack of public participation in reporting the existence of foreigner in their environment, weakness of coordination with other law apparatus and obstacle from law factors.

Abstract

ABSTRACTIncreased traffic flow of people entering and leaving Indonesia, had causing various level of immigration crimes. Passport fraud as a crime committed by replacing, altering part or all of a passport, or using false information to receive a passport, has become a serious matter now. Currently, almost all the proof of counterfeit passport process is checked in the Immigration Forensic Laboratory at the Immigration Intelligence Directorate. The formulation of the problem studied in this paper is how the role and challenge of Immigration Forensic Laboratory in conducting examination of fake passport on behalf of Abbas Tauqeer. The research method used is normative and empirical legal research. Based on the results of the research can be seen that the Immigration Forensic Laboratory has an important role as the center of examination of fake immigration documents consisting of several technical stages. Forensic analysis of the case found damage to passport biodata pages, different types of letters on passport biography, photos and biodata replaced, passport chips damaged, and unreadable chips in Automatic Document Reader. Then, the challenges faced include the lack of human resources, facilities and infrastructure has not been representative, the absence of Standard Operational Procedure (SOP), and the lack of care of officers in the field.Keywords: Immigration Forensic Laboratory, Counterfeit Passport

Abstract

This study aims to analyze the function of immigration in the security aspect, namely as a guard at the entrance to the territory of Indonesia during a pandemic. This function is of course very important considering that currently the spread of the covid 19 virus is getting out of control, one of which is because there are still many foreigners entering Indonesian territory. The research method used is descriptive with a qualitative approach by studying secondary data in the form of books, documents, and event records. The results of the study show that the actualization of the role of the immigration function during the pandemic can be seen from the aspects of immigration regulation and practices carried out by immigration checkpoints throughout Indonesia. Meanwhile, immigration checkpoints have carried out their functions as state security guards by refusing the arrival of foreigners and closing several immigration checkpoints to limit immigration traffic. There is a significant difference in law enforcement during normal times and during the pandemic, namely concessions given to foreign nationals in the form of exemption from overstay fees and deportation cannot be carried out. Deportation cannot be carried out because in general the country of origin of the foreigner also applies strict restrictions, so that for the time being many foreigners who cannot return to their country of origin are forced to live in the Rudenim.
