Article 333 civil code stating the proficient adult, whether 21 years old or married and children are not considered capable.E-commerce transactions performed by one of the minors are considered valid as long as they do not harm both parties and the parties who are under the age understand the agreement that must be fulfilled and responsible for what has been agreed and meet the element 1320 civil code. Abstrak Keabsahan Syarat Sahnya Perjanjian Transaksi melalui e-commerce yang dilakukan oleh anak dibawah umur, menunjukkan perjanjian e-commerce dinyatakan sah dan dinyatakan lahir saat tercapainya suatu kesepakatan mengenai objek yang diperjanjikan, dan tidak terlepas dari apa yang telah secara dasar diamatkan oleh Pasal 1320 KUHPerdata dengan menggunakan media elektronik sebagai kontrak yang tidak terwujud secara tertulis.Hal ini menyangkut syarat subjektif suatu perjanjian. Pasal 333 KUHPerdata yang menyatakan cakap adalah orang dewasa, baik yang berumur 21 tahun ataupun yang telah menikah, dan anak-anak dianggap belum cakap.Transaksi e-commerce dilakukan oleh pihak yang salah satunya di bawah umur dianggap sah selama tidak merugikan kedua belah pihak, dan pihak yang di bawah usia tersebut paham mengenai perjanjian yang harus terpenuhi serta bertanggung jawab atas apa yang telah disepakati, dan memenuhi unsur 1320 KUHPerdata.
