<![CDATA[ABSTRAKPenelitian ini bertujuan untuk mengetahui pemikiran Hak Asasi Manusia Ownership yang saat ini umum digunakan dalam pemaknaan hak atas tubuh khususnya pada kasus aborsi sehingga dapat diketahui nilai keadilan bagi korban aborsi.. Pandangan Hak Asasi Manusia ownership menekankan bahwa tubuh seseorang adalah miliknya sendiri sehingga tubuh dapat diperlakukan sesuai keinginan si pemilik tubuh tersebut. Untuk mencapai tujuan digunakan metode dengan jenis penelitian normative, sifat penelitian preskiptif, dengan pendekatan kasus berdasarkan ratio decidendi. Penelitian ini menggunakan teknik analisa bahan hukum deduktif. Dari hasil penelitian, pemikiran Hak Asasi manusia ownership masih mendominasi terutama pada hakim yang menjatuhan vonis aborsi, Hal ini tampak pada vonis yang ringan dalam kasus aborsi. Untuk mencapai keadilan bagi korban aborsi, maka perlu reorientasi pemikiran dari ownership ke possession. Pandangan Hak Asasi Manusia Possession memaknai tubuh adalah titipan dari Sang Pencipta sehingga perlu dijaga. Reorientasi pemikiran Hak Asasi Manusia maka tujuan dari pemidanaan dapat tercapai dan keadilan bagi korban aborsi dapat terpenuhi. To achieve the goals, the method used is a type of normative research, the character of research is prescriptive research, with a case approach based on ratio decidendi. This research use deductive legal material analysis techniques. From the results of the study, the thinking of human rights ownership still dominates, especially for judges who have dropped verdicts on abortion. This can be seen in a mild verdict in an abortion case. To achieve justice for victims of abortion, it is necessary to reorient concept from ownership human rights thinking to possession. In possession Human Rights concept, the body's is entrusted from God so it needs to be safeguarded. With the reorientation of human rights concept, the goal of punishment can be achieved and justice for victims of abortion can be fulfilled.
