<![CDATA[Tujuan penelitian menganalisis alasan yang menjadi dasar hukum bagi pihak ketiga untuk mengajukan perlawanan serta pertimbangan hakim Pengadilan Negeri Jeneponto sesuai atas putusan No.08/pdt/G/2017/PN.Jo. Metode penelitian memggunakan tipe penelitian Hukum Empiris. Hasil penelitian ini menyimpulkan bahwa pertimbangan hukum majelis hakim dalam Putusan Putusan Pengadilan Negeri Jeneponto Nomor:08/Pdt.G/2017/Pn.Jnp merupakan kasus perdata yang menagani kasus perbuatan melawan hukum antara 2 pihak, yakni SAHARIA selaku pihak Pelawan, melawan SAING DG.NGERO, selaku pihak Terlawan. Kemudian yang menjadi Pertimbangan hukum Hakim Pengadilan Negeri Jeneponto dalam putusan No.08/Pdt.G/2017/Pn.Jo adalah Majelis Hakim menolak gugatan Penggugat karena gugatannya tidak memenuhi syarat formil, yaitu gugatan ditujukan kepada orang yang telah meninggal dunia. Seharusnya surat gugatan tersebut ditujukan kepada ahli waris. Sehingga Majelis Hakim menganggap gugatan tersebut cacat formil. The research objective was to analyze the reasons that became the legal basis for a third party to file a challenge and the consideration of the Jeneponto District Court judges according to the decision No. 08 / pdt / G / 2017 / PN.Jo. The research method uses the type of empirical law research. The results of this study concluded that the legal considerations of the panel of judges in the Jeneponto District Court Decision Number: 08 / Pdt.G / 2017 / Pn.Jnp were civil cases handling cases of illegal acts between 2 parties, namely SAHARIA as the Pelawan party, against SAING DG. .NGERO, as the Opponent. Then what became the legal consideration for the Jeneponto District Court Judge in the decision No. 08 / Pdt.G / 2017 / Pn.Jo was that the Panel of Judges rejected the Plaintiff's claim because the lawsuit did not meet the formal requirements, namely the lawsuit was addressed to a person who had passed away. The lawsuit should be addressed to the heirs. So that the Panel of Judges considered the lawsuit to be formal flaw.]]>
