<![CDATA[Penelitian ini dilatarbelakangi oleh perlunya hak kekayaan intelektual Merek yang harus dilindungi dan harus didaftarkan. Isu hukum penelitian ini yaitu 1). Bagaimana bentuk perlindungan hukum kepada pemilik merek yang tidak terdaftar berdasarkan Undang-Undang No. 20 Tahun 2016 Tentang Merek dan Indikasi Geografis? 2. Bagaimana akibat hukum bagi Pemilik merek yang tidak terdaftar berdasarkan Undang-Undang No. 20 Tahun 2016 Tentang Merek dan Indikasi Geografis? Metode penelitian ini adalah penelitian yuridis normatif dengan pendekatan konseptual dan pendekatan perundang-undangan. Bahan hukum yang digunakan ialah bahan hukum primer, sekunder dan tersier, Analisis bahan hukum menggunakan analisis deskriptif kualitatif. Bentuk Perlindungan Hukum Kepada Pemilik Merek Yang Tidak Terdaftar Undang-Undang No. 20 Tahun 2016 Tentang Merek dan Indikasi Geografis ada 2 (dua) yaitu perlindungan hukum preventif dan perlindungan hukum represif. Perlindungan Preventif yaitu pelindungan sebelum terjadi tindak pidana atau pelanggaran hukum terhadap merek dan merek terkenal. Perlindungan hukum preventif Merek diatur dalam UU Merek dan Indikasi Geografis yakni dengan melakukan pendaftaran Merek.Sementara perlindungan hukum represif adalah perlindungan hukum terhadap merek manakala ada tindak pidana merek atau pelanggaran hak atas merek. Akibat Hukum Bagi Pemilik Merek Yang Tidak Terdaftar Berdasarkan Undang-Undang No. 20 Tahun 2016 Tentang Merek dan Indikasi Geografis yakni jika suatu Merek tidak didaftarkan yaitu Pemegang Merek tidak mempunyai landasan hak untuk menikmati hasil Merek tersebut. Law no. 20 of 2016 concerning Marks and Geographical Indications there are 2 (two) namely preventive legal protection and repressive legal protection. Preventive Protection is protection before a crime or law violation occurs against well-known marks and marks.
