Malpraktek Medis dalam Tinjauan Yuridis Sistem Hukum Indonesia

Abstract

AbstrakPenelitian ini untuk mengetahui bagaimana pengaturan dan ketentuan yuridis bila terjadi malpraktek medis sesuai sistem hukum Indonesia dilihat dari ketentuan hierarki peraturan perundang-undangan. Berdasarkan hasil penelitian dan pembahasan dihasilkan kesimpulan sampai saat ini Indonesia belum memiliki Undang-Undang khusus tentang malpraktek medis. Dari sistem hukum Indonesia tidak semua mengatur malpraktek medis. Yang mengaturnya, yaitu Hukum Perdata, Hukum Pidana dan Hukum Administrasi. Undang-Undang yang bersangkutan, antara lain : Undang-undang No. 29 Tahun 2004, Undang-undang No. 36 Tahun 2009, Undang-undang No. 44 Tahun 2009 yang mana dari beberapa ketentuan ini dapat memberikan dasar bagi pasien untuk mengajukan upaya hukum. Peraturan yang tidak masuk dalam hierarki sistem hukum Indonesia tetapi berkaitan dengan malpraktek medis antara lain: Peraturan Menteri Kesehatan No 269/Menkes/Per/III/2008 tentang Rekam Medis, Peraturan Menteri Kesehatan No 512/Menkes/Per/IV/2007 tentang Izin Praktik dan Pelaksanaan Praktik Kedokteran, Peraturan Menteri Kesehatan No : 585/Men.Kes/Per/IX/1989 Tentang Persetujuan Tindakan Medik. Secara yuridis kasus malpraktek medis di Indonesia dapat diselesaikan dengan bersandar pada beberapa dasar hukum yaitu: KUHP, KUHPerdata, Undang-undang No. 8 Tahun 1999, Undang-undang No. 29 Tahun 2004, Undang-undang No 36 Tahun 2009, Undang-undang Nomor 44 Tahun 2009, Peraturan Menteri Kesehatan No 585/Menkes/Per/IX/1989, Peraturan Menteri Kesehatan No 512/Menkes/Per/IV/2007, Peraturan Menteri Kesehatan No 269/Menkes/Per/III/2008.Kata Kunci: Malpraktek Medis, Tenaga Kesehatan, Penerima Jasa Kesehatan. AbstractThis study is to find out how the juridical arrangements and provisions in the event of medical malpractice according to the Indonesian legal system are seen from the hierarchical provisions of the legislation. Based on the results of research and discussion, it is concluded that until now Indonesia does not have a special law on medical malpractice. Not all of the Indonesian legal system regulates medical malpractice. Which regulates it, namely Civil Law, Criminal Law and Administrative Law. The laws concerned, among others: Law no. 29 of 2004, Law no. 36 of 2009, Law no. 44 of 2009 which of these provisions can provide a basis for patients to file legal remedies. Regulations that are not included in the hierarchy of the Indonesian legal system but are related to medical malpractice include: Minister of Health Regulation No. 269/Menkes/Per/III/2008 concerning Medical Records, Minister of Health Regulation No. 512/Menkes/Per/IV/2007 concerning Practice Permits and Implementation of Medical Practices, Regulation of the Minister of Health No: 585/Men.Kes/Per/IX/1989 concerning Approval of Medical Actions. Juridically, medical malpractice cases in Indonesia can be resolved by relying on several legal bases, namely: the Criminal Code, the Civil Code, Law no. 8 of 1999, Law no. 29 of 2004, Law No. 36 of 2009, Law No. 44 of 2009, Regulation of the Minister of Health No. 585/Menkes/Per/IX/1989, Regulation of the Minister of Health No. 512/Menkes/Per/IV/2007, Regulation of the Minister of Health Health No. 269/Menkes/Per/III/2008.Keywords: Medical Malpractice, Health Workers, Recipients of Health Services.
