<![CDATA[Abstract: The Independent Commission of General Election referring to the Act Number 11, 2006 and Qanun Aceh Number 3, 2008 has an authority to make decision or rules regarding requirements of Quran test for the candidates of local parties in Aceh, for national parties and cannot be made new rules due to it against the Qanun. This test is one of the requirements for the candidates of Aceh Legislative Members and Regional Legislative Members in Aceh to be accepted as the permanent members in the list of the houses. Applying this rule for them is against the law. It is recommended that Qanun Number 3, 2008 regarding Local Political Parties in the General Election of the House of Representative Members of Aceh and District/Municipality must be changed because based on the rule, such Qanun violates the Acts, based on legal principle stating that lower laws must not be against higher laws. The substance of the ability test to recite Quran should be regulated clearly in Qanun Aceh for the candidates of the House of Representative of Aceh and the Regional/District House of Representative. Abstrak: KIP Aceh berdasarkan UU Nomor 11 Tahun 2006 dan Qanun Aceh Nomor 3 Tahun 2008 berwenang untuk membuat keputusan/peraturan tentang syarat uji baca Al Qurán bagi calon dari Partai Lokal di Aceh saja, tidak untuk Partai Nasional serta tidak boleh menambah aturan baru karena bertentangan dengan Qanun Aceh Nomor 3 Tahun 2008. Uji mampu baca Al Qurán merupakan salah satu syarat bagi Bakal Calon Anggota DPRA dan DPRK di Aceh untuk dapat ditetapkan dan dimasukkan ke dalam Daftar Calon Tetap (DCT) Anggota DPRA dan DPRK. Memberlakukan syarat uji baca Al Qurán bagi Bakal Calon dari Partai Nasional bertentangan dengan peraturan perundang – undangan. Disarankan agar Qanun Aceh Nomor 3 Tahun 2008 tentang Partai Politik Lokal Peserta Pemilihan Umum Anggota Dewan Perwakilan Rakyat Aceh dan Dewan Perwakilan Rakyat Kabupaten/Kota harus diubah karena berdasarkan hukum tertulis, Qanun tersebut bertentangan dengan Undang – Undang, sesuai dengan asas hukum bahwa peraturan dibawah tidak boleh bertentangan dengan peraturan diatasnya.
