Abstract

Abstract: This paper addresses the issue of how the implementation of the 30% quota of the women legislative candidates in the electoral district 4 in Gresik in 2014 general election according to Undang-Undang No. 8 tahun 2012 and the political (siyasah) jurisprudence. The data are collected through interview and a study of the texts related to the problem. They are then analyzed using the political (siyasah) jurisprudence approach and accomplished by inductive framework. The study concludes that the implementation of the 30% quota of the women legislative candidates in the electoral district 4 in Gresik has been in conformity with UU No. 8 tahun 2012 and Peraturan KPU No 7 tahun 2013. It is recorded that the women legislative candidates, in the list of the fixed candidates, are 34.61% or 36 people of the 104 candidates in the electoral district 4. However, the final result shows that the 34.61% of the women legislative candidates have not met the 30% quota. In fact, there are only 2 people (20%) of the 10 council members who represent the electoral district 4 in Gresik. In Islam, there is none of the discussion of the application of the 30% quota of the women legislative representation in parliament. Within the perspective of the political (siyasah) jurisprudence, the 30% quota of the women’s representation in parliament are not contrary to the principles of Islam as long as they have the capacity and capability as a leader. Abstract

Abstract: This article is a field research on “implementation of child’s rights who conducts crime according to Undang-Undang No. 3 Tahun 1997 in Pengadilan Negeri of Sidoarjo on the Islamic criminal law perspective”. This study aims to answer the questions about the implementation of the child’s rights who commits offense under Undang-Undang No. 3, tahun 1997 in Pengadilan Negeri of Sidoarjo and the view of the Islamic criminal law on the child’s rights who commits crime. To answer the two main questions, the author uses descriptive analysis method. The research shows that the implementation of the child’s rights who commits offense under Undang-Undang No. 3 tahun 1997 in Pengadilan Negeri of Sidoarjo during the process of examination in court are; entitling to an explanation of the procedure of the trial and the case, obtainning a legal counseling during the trial and a right to choose his own legal counsellor, communicating to his legal supervisor, getting an adequate facility in the trial, gaining protection against adverse actions, obtaining a right to express and defend his own opinion, getting a treatment as set out in the criminal code. In Islamic law, the judicial process of child who commits criminal acts is entitled to defense himself whether conducted by the child himself or his own legal counsellor and he also has right to ask a compensation for a wrong decision.Keywords: Child’s rights, crime, Undang-Undang, Islamic law.

Abstract

Abstract: This article highlights about adultery as one of the strong reasons of divorce. The reason is however quite difficult to be legally proved. As mentioned in the Qur’an, verification of adultery is by presenting the four male witnesses. And it has been mentioned in the Qur’an chapter al-Nisa’, verse 15, 16, 25 and in chapter al-Nur, verse 2, 4, 13 that the four male witnesses should be Muslim. In addition, Another way to prove adultery is li’an as written in the Qur’an, chapter al-Nur, verse 6-9 that a husband who accuses his wife committing adultery while he does not have adequate evidence other than he himself, so he can prove it with a li’an oath.  It is also clearly stipulated in article 88 of Undang-Undang No.7 tahun 1989. While the proofs of adultery under the civil law of Religious Court other than the testimony of the four male witnesses are also by letter, oath, recognition, and conjecture.Keywords: Verification, adultery, the Qur’an, the civil law

Abstract

Abstract: This article discusses about the concept of justice in the perspective of the philosophy of Islamic law. Philosophically, there are two formulations of justice: first, the view that what is meant by justice is a harmony between the use of right and obligation are in line with the implementation of the proposition of “the balance of law” or “the dose of right and obligation”; second, the view of the lawyers who formulate that justice is a harmony between legal certainty and proportionality of law. Justice, in Islamic law, is derived from the Most Just. It is because Allah SWT is the upholder of justice, then He must be believed not to apply unjust to His servants. The concept of justice, based on al-Shatibi’s maqasid al-shari’ah theory, is determined by the benefits which are divided into three, namely daruriyyat (necessities), hajiyyat (needs), and tahsiniyyat (luxuries). This indicates that Islam is concerned with the issue of justice. The conception of justice will continue to evolve in line with the social development. Construction of law and justice in Islam cannot be separated from morality and transcendental beliefs since these aspects are intertwined.Keywords: Justice, philosophy, law, Islam.

Abstract

Abstract: This article discusses M. Natsir’s and Abdurrahman Wahid’s thought about the relationship between Islam and state. Both of M. Natsir and Abdurrahman Wahid agree that the most realistic system to be applied in Indonesia is a democratic system. They also agree that there is no a rigid political system in Islam as it has existed today. In addition, Islam provides the basic principles of the nation and state namely deliberation, justice, equality, freedom, and togetherness. The fundamental difference between M. Natsir’s  and Gus Dur’s thought in viewing the relationship between Islam and state is  about the two things: first, their respond to secularism, which tries to separate between religion and state; and second, their political thought in addressing democracy and the Pancasila ideology as the fundamental principles of Indonesia.Keywords: Islam, state, M. Abstract

Abstract: This article focuses on presenting problem of religious minority right in Indonesia. Based on its constitution, Indonesia has equal protection for all citizens. There are some basic religion right clearly protected and presented in constitutional and criminal law. Unfortunately, violation of minority rights still continues in Indonesian life. According to research data, there are a big gap perception between government and the people. Government choose to float the norms of religious minority right protection in abstract level and most of religious minority group asked more detail and concrete norm.Keywords: Religious minority protection, human rights, religious minority.

Abstract

Abstract: This article discusses the KH. Abdul Muchith Muzadi’s point of view on Nahdlatul Ulama and the national political of NU. NU as a religious organizations based on the theory of Ahl wal Jamaah, having tenets include: tawassut (moderate), tawazun, tasamuh, and commanding the good and forbidding the evil; which has always been the political basis of nationality NU in Indonesian politics. In KH. Abdul Muchith Muzadi’s idea, nationality politics is defined as our responsibility in maintaining the integrity of the Unitary Republic of Indonesia (NKRI) is universally from groups separastisme that lead to disunity, disintegration and destruction, in the commitments, namely Pancasila. So, national politics of NU in the perspective of KH Muchith Muzadi is the appreciation of the national consensus and the embodiment of devotion NU in upholding the Unitary Republic of Indonesia (NKRI) as something that was final. Keywords: Politics, nationality, NU, and Abdul Muchith Muzadi

Abstract

Abstract: This article focuses on the Islamic political jurisprudence perspective against the decision of the Constitutional Court (MK) No. 4/PUU-VII/2009 on the nomination of an ex of a prisoner as a legislator. MK’s decision allows the ex of a prisoner to become a legislator, DPD, and local leader with certain conditions. The basic of the consideration is that the Constitutional Court has the authority to examine, hear, and decide the decision No. 4/PUU-VII/2009. In addition, the applicant also has no legal status in this respect (legal standing) and consideration of the principal arguments of the applicant’s request. MK’s decision No. 4/PUU-VII/2009 has juridical implication on article 12 letter g and article 50 paragraph (1) letter g of Law No. 10/2008 and article 58 letter f of Law No. 12/2008 as well as the political implications on the opportunities for the ex of a prisoner to hold a public office. Based on the Islamic political jurisprudence perspective, MK’s decision No. 4/PUU-VII/2009, which permitted the ex of a prisoner as a legislator, DPD and local leader with certain conditions, is in line with the concept of constitutional politics that includes the rights of the people. It is because the ex of a prisoner is also a member of the community whose rights should be protected if he or she repents.Keywords: Nominations, prisoner, members of the legislature.

Abstract

Abstract: This article describes the conception of Majelis Umat according to Abdul Qadim Zallum and conception of the DPR under the Constitution of 1945. In Abdul Qadim Zallum’s thought, the conception of Majelis Umat and the DPR basically is a representative of the people in each form of the state, but in conception of Majelis Umat the representativeness of race is limited, such as in the establishment of the law, a people representative of the non-Muslims can’t contribute to the perfection of the law because they are not representative for analizyng Islamic law, so is the Majelis Umat in his opinion (most votes) is not binding for the Caliph, with other words Majelis Umat don’t have any authority in law as having law is God. In the conception of DPR, any issues relating to the welfare of the people being their authority, certainly not without the approval of the President as the leader of the government. So the differences that really stands out is the authority of the Majelis Umat who are severely restricted by the Caliph and shariah law itself. While in DPR based on the Constitution of 1945, as long as not contrary to the basis of the country, DPR has the right to request the approval of the President.Keywords: Majelis Umat, the conception, DPR, Abdul Qadim Zallum
