Abstract

Corporate Social Responsibility/CSR is the responsibility inherent in every company to keep creating a harmonious, balanced, and appropriate relationship with the local communitys environment, values, norms and culture. However, CSR implemented by PT Riau Crumb Rubber Factory is very minimal perceived by the community of Sri Meranti Village. The problem is how is the legal effort of the community of Sri Meranti to the fulfillment of community rights in Riau Provincial Regulation Number 6 of 2012? This research is a sociological law research. The result of this research is if there are companies in Riau Province that don’t implement CSR to society residing in company location, hence pursuant to Article 32 Riau Provincial Regulation Number 6 of 2012, the company may be subject to administrative sanction by Government of Riau Province in the form of reprimand written and other forms of sanction in accordance with the laws and regulations. Therefore, the legal effort that can be done by the community of Sri Meranti Village if PT Riau Crumb Rubber Factory doesn’t implement CSR, the community of Sri Meranti Village can convey their aspiration to the Regional House of Representatives of Riau Province so that the company is recommended to receive administrative sanction from the government.

Abstract

AbstractThis study aims to determine and understand the provisions of the prosecution of illegal, unreported and unregulated fishing (IUUF) in international law and to analyze the legitimacy of the policy action undertaken IUUF Indonesia in the perspective of international law. This study is a normative legal research using library research and interviews as data collection methods. Interviews were conducted to one of the speakers who have the authority to take actions IUUF in Indonesia. The results of this study indicate that the whole policy of repression IUUF conducted by Indonesia in its territory has full sovereignty and get legitimacy in international law by the application of territorial jurisdiction. While the prosecution IUUF policy in the region is a zone of entry into force of the sovereign rights which can only be applied to the exclusive jurisdiction of several legal actions undertaken by Indonesia has risk contrary to international law.  AbstrakPenelitian ini bertujuan untuk mengetahui dan memahami ketentuan penindakan illegal, unreported dan unregulated fishing (IUUF) dalam hukum internasional dan untuk menganalisis legitimasi kebijakan penindakan IUUF yang dilakukan Indonesia dalam perspektif hukum internasional. Penelitian ini merupakan penelitian hukum normatif yang menggunakan library research dan wawancara sebagai metode pengumpulan data. Wawancara dilakukan kepada salah satu narasumber yang memiliki otoritas dalam melakukan penindakan IUUF di Indonesia. Hasil dari penelitian ini menunjukan bahwa terhadap seluruh kebijakan penindakan IUUF yang dilakukan oleh Indonesia di wilayah teritorialnya indonesia memiliki kedaulatan penuh (sovereignty) dan mendapat legitimasi hukum internasional berdasarkan penerapan yurisdiksi teritorial. Sedangkan kebijakan penindakan IUUF di wilayah yang merupakan zona berlakunya hak berdaulat (sovereign right)  dimana hanya dapat diterapkan yurisdiksi eksklusif beberapa penindakan yang dilakukan Indonesia memiliki resiko bertentangan dengan hukum internasional.

Abstract

The purpose of this paper is to determine law enforcement against child abuse according to the customary law of Siak Sri Indrapura. Bab Al-Qawaid is written laws used to regulate in the area of the Siak Sri Indrapura Kingdom. Article eight in Bab Al-Qawa’id specifically regulate the prohibition of child abuse. Factors of law enforcement against child abuse in Siak Sri Indrapura can be seen from factors of legal, law enforcer, facilities or support facilities, community and culture. Another factor is the political factor of customary law in Siak Sri Indrapura that customary law does not become the main reference in the resolution of the law against child abuse, due to the dominance of national law for customary law.

Abstract

Abstract The purpose of this research is to know the implementation of the formation of customary village governance based on Siak District Regulation No 2 of 2015 on Stipulation of customary village in Siak District, following the obstacles and efforts made to overcome obstacles in the implemetation of the formation of customary village. Based on Law No 6 of 2014 on Villages, Siak District Government has established Siak District Regulation No 2 of 2015 on Stipulation of customary village in Siak District which is a typical local government system based on the right of origin and traditional rights of society in Siak District. Although in its formation has been in accordance with the prevailing regulation, but in its formation is still found weaknesses that affect the effectiveness on the implementation of this regulation, so it needs improvement efforts for better governance of customery village. Abstrak Tujuan penulisan ini ialah mengetahui pelaksanaan pembentukan Pemerintahan Kampung Adat berdasarkan Peraturan Daerah Kabupaten Siak Nomor 2 Tahun 2015 tentang Penetapan Kampung Adat Di Kabupaten Siak, berikut hambatan serta upaya yang dilakukan untuk mengatasi hambatan dalam pelaksanaan pembentukan Pemerintahan Kampung Adat. Berdasarkan Undang-Undang Nomor 6 Tahun 2014 tentang Desa, Pemerintah Kabupaten Siak telah membentuk Peraturan Daerah Kabupaten Siak Nomor 2 Tahun 2015 tentang Penetapan Kampung Adat di Kabupaten Siak yang merupakan sistem pemerintahan lokal yang khas berdasarkan hak asal usul dan hak tradisional masyarakat di Kabupaten Siak. Meskipun dalam pembentukannya telah sesuai dengan peraturan perundang-undangan yang berlaku, namun ditemukan kelemahan yang mempengaruhi efektivitas pelaksanaan Peraturan Daerah ini, sehingga diperlukan upaya perbaikan guna penataan Pemerintahan Kampung Adat yang lebih baik.

Abstract

Tanggungjawab sosial perusahaan(CSR) merupakan kewajiban perusahaan untuk merumuskan kebijakan, mengambil keputusan, dan melaksanakan tindakan yang memberikan manfaat kepada masyarakat. Fakta menunjukkan bahwa banyak sekali perusahaan yang hanya melakukan kegiatan operasional tetapi kurang sekali memberikan perhatian terhadap kepentingan sosial dan ekonomi masyarakat disekitarnya. Tujuan dari penilitian ini adalah untuk mengetahui pengaturan hukum dan konsep ideal tentang CSR. Hasil penelitian menunjukkan bahwa banyaknya permasalahan tentang Corporate Social Responsibility (CSR), untuk itu pemerintah harus membuat aturan yang bersifat jelas dan menyeluruh sehingga bisa menjamin kepastian hukum. Pengaturan tentang besaran CSR, dan bagaimana teknis pelaksanaannya juga harus diatur secara komprehensif. Dengan demikian kepastian hukum terhadap penerapan aturan CSR dan pelaksanaannya bisa dilaksanakan dengan baik dan tidak menimbulkan berbagai polemik di masyarakat.

Abstract

Abstract Article 158 Paragraph (1) of the Employment Act has been repealed by the Constitutional Court in Decision N0.012/PUU-I/2003. Then legal vacuum concerning Termination of Employment for major offenses. Government issued Circular Letter No.SE-13/MEN/SJ-HK/I/2005, which states the Firm Termination due to severe error, can be done after decision of the criminal judge finalized. This type of research is normative. Data were analyzed qualitatively, concluding with the deductive method of thinking. Results First, the concept of Termination On serious mistakes After Section 158 of the Employment Act is repealed by the Constitutional Court Termination Of workers who make mistakes should heavy Decision Criminal Justice Stay. While the workers who perform heavy Mistake that are not criminal acts lack a legal basis. Second, the concept of Termination On serious mistakes After Section 158 of the Employment Act repealed by the Constitutional Court illustrate the lack of protection for workers who perform heavy errors beyond the provisions of Criminal.Abstrak Pasal 158 Ayat (1) UU Ketenagakerjaan telah dicabut oleh MK melalui putusan No.012/PUU-I/2003. Dengan demikian terjadi kekosongan hukum mengenai PHK karena kesalahan berat. Pemerintah menerbitkan SE No.SE-13/MEN/SJ-HK/I/2005, yang menyatakan Pengusaha yang melakukan PHK karena kesalahan berat, dapat dilakukan setelah ada putusan hakim pidana berkekuatan tetap.  Jenis penelitian adalah normatif. menganalisis hukum yang tertulis. Data dianalisi secara kualitatif, penarikan kesimpulan dengan metode berfikir deduktif. Hasil Pertama, Konsep PHK Atas Kesalahan Berat Setelah Pasal 158  UU Ketenagakerjaan dicabut oleh MK yaitu PHK Terhadap pekerja yang melakukan kesalahan berat harus ada Putusan Hakim Pidana Tetap. Sementara terhadap pekerja yang melakukan kesalahan berat yang bukan tindak pidana tetapi diatur sebagai kesalahan berat belum memiliki dasar hukum. Kedua, Konsep PHK Atas Kesalahan Berat Setelah Pasal 158 UU Ketenagakerjaan dicabut Oleh MK menggambarkan tidak adanya perlindungan terhadap pekerja yang melakukan kesalahan berat diluar ketentuan Pidana.

Abstract

The presence of intellectual work as the result of human ability, need to be protected in order to get recognition, appreciated and respected. The amendment to the Copyright Act Number 19 of 2002 is deemed necessary by the Government to provide better protection to the Author and the Owner of the Neighboring Rights. Based on the explanation above it can be drawn the problem formulation ie (1) How Act Number 28 of 2014 related to Copyright (New Copyright Act) regulate Copyrights and Neighboring Rights? (2) How will the Act Number 28 of 2014 related to Copyright (New Copyright Act) protect the Author and the Owner of Neighboring Rights in Indonesia? While the objective of the study ie (1) To review the regulation related to Copyright and Neighboring Rights in the new Copyright Act, (2) To review the form and substance of copyright protection to the Author and the owner of the neighboring rights in Indonesia in accordance with the new Copyright Act. This study is a normative juridical which used literature as the main foundation. The legal materials used in this study are primary legal materials which include the Civil Code and related legislation. Secondary legal materials consist of literature books, journals, and articles are used to describe the primary legal materials. The study found that (1) Act Number 28 of 2014 on Copyright accommodates the interests of the Author and the Owner of the Related Rights by providing better protection in its Articles, and (2) Some crucial changes related to Economic Rights and the change of Criminal offense to Complaint offense gives more protection to the Author and Related Rights’ Owner.

Abstract

Abstract Law protection of the consumer stipulated in Law No. 8 of 1999. In connection with this, in this thesis raised two issues, namely first, whether the Law No. 8 of 1999 on Consumer Protection has provided protection to the consumer in e-commerce transactions. Second, how the law protection for consumers in e-commerce transactions that should be regulated in the Consumer Protection Act. The methodology is used in this study using a normative approach because it is a law research aimed at writing regulations that are closely related research at the library that need data that is secondary. The conclusion of the research is Law No. 8 of 1999 has not been able to protect the consumer because of the provisions contained in this Law not accommodate consumer rights in this transaction. The Government should make a revision of Law No. 8 of 1999 so that it can protect not only conventional transactions but also e-commerce transactions.Abstrak Perlindungan hukum terhadap konsumen diatur dalam Undang-Undang Nomor 8 Tahun 1999. Sehubungan dengan hal tersebut, dalam tesis ini diangkat dua permasalahan yaitu Pertama, apakah UU Nomor 8 Tahun 1999 tentang Perlindungan Konsumen telah memberikan perlindungan  terhadap konsumen dalam melakukan transaksi e-commerce. Kedua, Bagaimana perlindungan hukum terhadap konsumen dalam transaksi e-commerce yang seharusnya diatur dalam UU Perlindungan Konsumen. Metodologi yang dipakai dalam penelitian ini menggunakan pendekatan normatif karena merupakan penelitian hukum yang ditujukan pada peraturan-peraturan tertulis sehingga penelitian ini sangat erat hubungannya pada perpustakaan yang membutuhkan data-data yang bersifat sekunder. Kesimpulan dari penelitian yang dilakukan adalah UU No 8 Tahun 1999 belum dapat melindungi konsumen karena ketentuan-ketentuan yang tercantum dalam hukum ini belum mengakomodirhak-hak konsumen dalam transaksi ini. Pemerintah seharusnya merevisi Undang-Undang Nomor 8 Tahun 1999 supaya dapat melindungi bukan hanya transaksi konvensional tetapi juga transaksi e-commerce.

Abstract

The legal problem in the application of Article 109 paragraph (1) of the CPC is: the absence of legal sanctions for investigators which does not inform the commencement of the investigation of an incident which is a criminal offense to the prosecutor, the reporter and the victim/complainant; the occurrence of extension to things that become the object of pre-trial; lack of legal protection against the reporter/victim; the absence of the principle of legal fiction by investigators; and not yet optimal method of investigation. The ideal concept of law in the application of Article 109 paragraph (1) CPC is: the existence of legal sanctions for investigators who do not inform the commencement of an investigation of an incident which is a criminal offense to the prosecutor, the reporter and the victim/complainant; the existence of special rules regarding pre-trial object boundaries; optimal and genuine role of the state in providing legal protection to the reporter/victim; law enforcers in the implementation of their main duties and functions shall apply the principles of legal fiction; and changes to the method of investigation so that there is no gap for the suspect to use pretrial facilities in an effort to escape from the law.

Abstract

Abstract Constitution mandates that the national economy should be run by promoting peoples welfare. This study intends to analyze the mechanisms and criteria for state intervention in order to provide legal protection to consumers and other businesseman in creating healthy business competition. This study uses doctrinal method research in the form of evaluative research. The approach which is used is the approach of legislation with secondary data sources in the form of primary, secondary and tertiary legal materials. From the discussion and showed that the mechanism of state intervention is likethe delimitation of the price tolerance 10 % for rice, granting subsidies (BLT), market operations, tariff Arrangement of Impor Tax, Price Determination of Government Purchase (HPP), Restrictions of food exports. While the criteria for state intervention is the production branches which are important for the country and dominate the life of many people, the production branches are arranged legislation, organized by the state or body or institution established or designated by the government.AbstrakUndang-Undang Dasar 1945 mengamanatkan bahwa perekonomian nasional harus dijalankan dengan mengedepankan kesejahteraan rakyat. Penelitian ini bertujuan untuk menganalisis mekanisme dan kriteria intervensi negaradalam rangka memberikan perlindungan hukum kepada konsumen dan pelaku usaha lainnya dalam mewujudkan persaingan usaha sehat. Penelitian ini menggunakan metode penelitian doktrinal dalam bentuk penelitian evaluatif. Pendekatan yang digunakan adalah pendekatan perundang-undangan dengan sumber data sekunder berupa bahan hukum primer, sekunder dan tersier. Dari hasil pembahasan dan penelitian diperoleh bahwa mekanisme inrevensi harga adalahseperti penetapan batas toleransi harga 10% untuk beras, Pemberian Subsidi (Harga/BLT), Operasi Pasar, Pengaturan Tarif Bea Masuk Impor, Penetapan Harga Pembelian Pemerintah (HPP), Pembatasan Ekspor Pangan. Sedangkan kriteria intervensi negara yaitu pada cabang-cabang produksi yang penting bagi negara dan menguasai hajat hidup orang banyak, cabang-cabang produksi tersebut diatur undang-undang, diselenggarakan oleh BUMN atau badan atau lembaga yang dibentuk atau ditunjuk oleh pemerintah.
