Abstract

Since fatwa is one of dynamical Islamic thought products, the change of it is something natural. It is formulated by doing ijtihad so that it my change because of the changes of argumentations, benefits (maslahah), and customs that become its base. Therefore, the change of the fatwa of Indonesian Ulama Council (MUI) dealing with kiblat should be faced fairly because the change merely occurs on the dictum of the three points above, i.e. changing Westwards into Northwest as the Kiblat of Indonesian Muslims. Such a change happens not because of the new argumentation or the maslahah change, but the different approach. The first fatwa No.03 of 2010 only uses fiqh approach while the second fatwa No. 05 of 2010, as the revision of the first fatwa, uses scientific approach, astronomy, besides using fiqh. Abstract

One of controversial issues emerged in this country dealing with ethnicity, religion, and race lately is the issue of apostasy and the punishment for the converts. Dealing with this, the religious persons are polarized into two groups; the first group helds the majority opinion of fiqh ulama that the punishment for the coverts is the death sentence. The second one argues that they are merely judged as laden with sin, not a crime case. This article tries to analyze both two views by using hadits approach. Abstract

Hazairin can be classified as a phenomenal Islamic scholar, together with a number of other Islamic scholars, such as Fazlur Rahman from Pakistan, Syahrur from Syria, Fatimah Mernissi from Morocco, Leila Ahmed from Egypt, and several other Islamic scholars. They are called phenomenal Islamic scholars for their formal education are non-Islamic studies, but have contributions and extraordinary and amazing discoveries in the field of Islamic studies. Fazlur Rahman from Pakistan who has the educational background of medical (medicine), Syahrur from Syria who has the formal educational background in civil engineering, Fatimah Mernissi who has the educational background of Sociology, and Leila Ahmed who has the formal education in History at the Universiry of Cambridge, and several other Islamic scholars. The formal educational background of Hazairin is on law, especially Customary Law and Social -Anthropology (Ethnology). However, his studies on the field of Islamic law are very admirable. What has been found by Hazairin can be classified as an invention, not just a development or an improvement. One of Hazairin's remarkable findings is that Islam emerges to build a community based on the bilateral family. His conclusion is contrary to the formulation and conclusion of other scholars and the most mulim in general that Islam emerges to build the community based on patrilineal family. Abstract

Syari'a is religious value expressed functionally and concretely as a way that guides human 's life for virtue both in the World and in the hereafter. Islamic law (syari'a) is naturally put into effect in order to be Islamic law as a sub-system of National (positive) law. Based on the history of Banten, the sultanate of Banten had ever implemented the Islamic law as the law applied in the sultanate. It was based on the evidence that in the period of Sultan Ageng Tirtayasa, the amputation law for the ruslers had ever been applied. The historical religiosity and its actualization in Banten nowadats are potential to implement Islamic law comprehensively. Moreover, Bantenese society remains holding tightly on the Islamic values that have become the culture and principle in regulating their life as proven in the legislative of Banten that has issued local regulations of Islamic laws in the districts and cities of Banten. Optimalization of Islamic law implementation in Banten still goes on up to now through a significant numbers of the religious culture in the society, Islamic education institutions, religious proselytizing (dakwah), muamalah and al-akhwal syakhsiyyah. The challenge in endeavoring the implementation of Islamic law generally lies on the lack of the society's understanding on the detail and the meaning of Islamic law. The human sources of Banten (the strategic elites) support the implementation of Islamic law as both culture and values that can be absorbed in various law and regulations.
